I am rejecting this response because: I brought the car back the days later during that time there was no smoking I brought the car back cleaner than I received it got it detailed the first dayAnd washed wheels waxed air freshener to get the smell out when I believe it was Chris before we went on the test drive he told me about the smell it's been there you guys said you couldn't get it out! I have most of the conversations recorded I would just like to settle this without litigationThere was no repo the car was clean no need for lies

Spoke to Chris at Carmotive, who indicates that the dealer's position remains the same.Says he has spoken to the customer even since the complaint was filed, and Mr [redacted] indicated he intended to pursue the matter in court.As Carmotive has indicated that it remains firm in its position, Revdex.com will be closing complaint at this time.

Received call from Chris at Carmotive, providing business response.Chris explains that when it became clear that Carmotive would not be able to arrange financing for Mr [redacted] due to inconsistencies in his credit verification, the dealer requested immediate return of the vehicle under the terms of...

its Conditional Delivery Agreement.As per the terms of the agreement, he says that when a consumer returns a vehicle in a timely fashion and in good condition, as requested, they generally receive a full refund of their deposit, less any charges for excessive mileage put on the vehicle, etc. (Terms of Conditional Delivery Agreement indicate "Upon return of the vehicle, I will return all deposits to YOU less a reasonable amount for YOUR use of the vehicle and any costs for repair or damage while the vehicle was in YOUR possession.")In this case, Chris indicates that Mr [redacted] used the vehicle for some length of time, and Carmotive had to involve "3 or 4" different repo specialists to track down the vehicle. He says once Carmotive got the vehicle back, it required extensive reconditioning and detailing, including "fumigating" the interior due to apparent smoking activity. (He says consumers who've sat in and test driven the vehicle since its return are still able to detect the smell, even after reconditioning of the interior.)Chris says that due to the time and expense incurred in reacquiring and reconditioning the vehicle for sale, Carmotive is unable to refund Mr [redacted]'s deposit, either partially or fully.
