letter is in response to the customer concern submitted to you by one of our
former tenants, *** ***, on
7-20-15. ***
lived at our rental property located at *** *** *** *** ** in Covington,
KY from 3-29-to 10-1-14. The original
lease ending date was 4-1- When she
moved in she agreed to pay $for rent plus an additional $monthly laundry
fee for the extra water paid for by the landlord. We
received a written NTV (notice to vacate) on 4-2-from *** saying that her
plans were to move out on 5-1- We
advertised her apartment and showed it a few times. We received a good faith deposit of $and
rental application with $application fee from *** *** on 4-17-14. *** planned on moving in the first week of
May for a monthly rent of $ When
it came time for *** to move out on May 1st, she told us that her new place
wasn't ready and needed more time, but didn't know an exact date, but she
needed at least more weeks. ***
asked if we could check with the new tenant that was waiting to move in and see
if she could wait a bit longer. *** told
us that it would be no later than June 1st and went ahead and paid her May rent
on 5-11-with the late fee included.
*** wasn't happy but agreed to wait the additional monthWe explained
to *** that these things happen sometimes and it was out of our control, and
thanked her for her patience. With
the end of May fast approaching, and a very anxious *** asking what the status
was so she could arrange movers, etc *** contacted us and said she would have to
regretfully cancel the notice completely.
*** paid June rent on the 1st.
*** said the move wasn't going to work out because the new place was
not ready, nor close to being ready. She
was going to move into a condo that her sister owned but decided at the last
minute that it was a terrible idea, the commute would be too long to her job,
and she just wanted to stay where she was. We
returned all of the money to *** that she paid (including the application fee
that we were billed for) *** said she
felt terrible for inconveniencing *** (and us) and asked if she could stay
another year and sign a new lease. We
told *** she could stay and let her know that the rent was going up to $effective
7-1-14. ***
was sent a new lease and she started paying the lease renewal rental rate on
July 1st as agreedShe also paid the new rent amount on the 5th of
August. When September rent was late (on
the 6th) we sent her a late notice. On
September 11th we received a text about her car being broken into and that she
was breaking her lease. We sent her a
letter on 9-12-and told her that she'll need to submit a new written NTV
letter to the office but she never did so She paid her September rent on the 14th but
didn't include the $late fee. We
were then notified via text on the morning of 10-1-that her key was in the
box (her mailbox-not our drop box which caused some confusion) and that she was
all moved out. We showed ***'s
apartment later that afternoon (before checking it first-big mistake) to a lady
named *** who was looking for a first floor apartment for her mother. The place smelled horrible. Dead fish smell coming from the kitchen and a
strong dog odor throughout. Dog hair
everywhere, a smelly loveseat, dirty rugs, about bags of trash and boxes of
old sheets and clothes. Glasses and
candle holders left in the kitchenMany nails left in the walls and scuff
marks on the walls Bathroom walls had
what looked like hair dye on them. Appliances
were very dirty, cabinets and drawers not cleaned, dirty bathroom, and all the
floors were sticky. We had discussed
*** leaving the green chair, but we didn't know it smelled like wet dog. We tried for a couple of weeks for someone to
come pick it up but nobody that we asked wanted it. We
sent certified letter #*** *** *** *** *** to *** on 10-31-to the
forwarding address she provided via text.
The letter was signed for by *** ***. The certified letter was a copy of her
Security Deposit statement letting her know how much we charged for cleaning,
unpaid rent, amount of deposit on hand and the amount she still owes us after
we deducted the deposit. That amount
was $and we gave her days to make a payment arrangement or we would send
it to an outside agency for collection purposes. We never heard from *** about the amount
owed to us. Her file went into a stack
"Next batch to be sent to Collections", which ended up being in July
2015.On
July 20, *** had been notified by a collector from the Credit Bureau about
the accountShe made contact with us and tells us that she never brought back
the lease so she owes nothing. During
the time that *** was supposed to sign and return the new lease, we were in
the process of moving the leasing office from *** *** ** *** ***. We had everything boxed up for a few weeks
during the transition, so it is understandable that one lease might fall under
the radar with everything else we had going on. We
have only sent a handful of files to the Credit Bureau for collections in the
last two years, and it wasn't until the most recent batch sent in July
that we got a message about the requirements for each file and what paperwork
needs to be included. We will now be
going by a checklist so this doesn't happen again, or charges are overlooked.With
that being said, I ended up going through all the old timesheets from last
October to make copies of cleaning and repair charges to add to the file and
realized we undercharged *** for cleaning and repairs after she moved
out. I revised ***'s move out summary
and removed the $lost rent charge for breaking her lease, because we did in
fact, never receive the signed lease back.
After removing the lease break charges and revising the cleaning and
repairs charges, the new amount due after move out is $855. Since
we already filed for the $to the Credit Bureau, we will not increase the
amount that we were originally seeking.
We'll just write off the difference of $125, and hope that *** will
understand our point of view on how the events played out and that we have been
very accommodating and believe that we are only asking what is fair. We're very sorry that she has a different
point of view in this matter Thank
