8-29-2015 is the date of your last contractual payment. At that time, the full remaining loan balance is due and payable. If you desire, and at our discretion, we can extend this. Under the General Terms of the original contract that you signed, it states: “The Total Sale Price shown in the Truth-In-Lending Disclosure assumes that all payments will be made as scheduled. The actual amount you will pay will be more if you pay late and less if you pay early.”

The customer’s statement that the contract was for 39 months is incorrect. The contract shows 42 payments starting 3-9-2012. So far, 37 payments have been made. On both 5-30-2013 and 6-30-2014 the customer requested a deferment of payment, meaning that these two payments are put...
onto the end of the loan, plus accrued interest.
Ms. [redacted] stated that she “was no longer working” and then stated “when they took my car I couldn’t get to work.” Her statements are not consistent. In regards to her loan payment history, we stand behind our first response.
I am sorry our offered resolution does not satisfy your complaint. However, the offer is the only resolution we are able to offer you at this time. We have no record which confirms any modification of the agreement as you have described. We of course disagree with your perceptions of the present matter, but do wish you luck in future endeavors.
Mr. Story only made two payments on his auto loan. The third payment was due on 11-4-2013, but was never made. At the time of repossession, the customer was 2 payments past due.
