In breach of our agreement, [redacted] (Carolina Closets Plus) threats to sue me over the payment of a bookcase his employees damaged during assembly.On 28 October 2014 I have signed a contract with Mr. [redacted], president of Carolina Closets Plus (1289 Fordham Blvd, Chapel Hill, NC 27514-6110), for a custom bookcase to be built in my house for a total of $2,500. Upon signing the contract, I paid Mr. [redacted] $1,250.The bookcase was to be installed in one day, on 9 December 2014. Instead, because of several delays due to the sole responsibility of Carolina Closets Plus, work only started on 15 December 2014 and was only finished on 19 December 2014. On the last day of work, Mr. [redacted]'s employees damaged the bookcase while assembling it, causing two visible dents in the front shelves. Instead of letting me know, they hid the damage with caulk and left declaring the work finished. Upon discovering the damage and its camouflage, later on the same day (19 December 2014), I emailed Mr. [redacted], explained to him what had happened, attached pictures of the damage, and proposed him an agreement to solve the issue as follows: (1) I would not trust Carolina Closets Plus to fix the bookcase because, by not disclosing to me what had happened, their builders have shown to be untrustworthy; (2) starting January 2015, I would search for a different company to come in and give me an estimate of the repair; (3) I will pay Mr. [redacted] the difference between the $1,250 I would have owed him for the finished bookcase and the price of this repair; (4) in the calculation of my dues to Mr. [redacted], I would take into account the delays and the inconvenience caused to me. Mr. [redacted] accepted such agreement via email, on the same day (19 December 2014). In that email he described the service he had provided me as one in which "everything that could possibly go wrong on a job has happened". He asked that I talk to the employee who had hidden the damage and left - which I refused - and then ended by stating: "I will gladly take any solution that you feel is appropriate."Since the beginning of January 2015, I have actively searched for a company that would provide me with a quote for the repair of the bookcase. The search has proven extremely difficult - none of the companies I have contacted has responded to my request yet. As of today, I am still actively searching and contacting more companies. On 6 February 2015, I have received a letter from Mr. [redacted]'s attorney, [redacted] (Law Office of [redacted], [redacted]), communicating that Mr. [redacted] intends to file a lien on my property as well as a lawsuit to enforce such lien if I don't agree, by 13 February 2015, to pay him $1,000.Mr. [redacted] letter misrepresents the events in that: (1) it fails to acknowledge the agreement of 19 December 2014 between Mr. [redacted] and myself; (2) it falsely states that I have "refused to let Mr. [redacted] inspect the work" (Mr. [redacted] never asked to inspect the work after I sent him pictures of the damage); (3) it falsely states that I have "not returned any of Mr. [redacted]'s messages" (since 19 December 2014, Mr. [redacted], who has my cell phone and my landline numbers as well as my email address, only tried to contact me once, on 13 January 2015, with a generic email in which he asked whether I had found a company for the repair, which I had not); (4) it implicitly suggests that Mr. [redacted] and I had agree I owed him $1,000, which is false (Mr. [redacted] and I have no standing agreement other than the one of 19 December 2014 cited above); (5) it implicitly suggests that $2,250 out of a contracted $2,500 is a fair sum to pay for the substandard work Mr. [redacted] executed, which is an overestimate (such a payment would leave me with only $250 to get the bookcase repaired - which in itself is, by far, an underestimate, and to be compensated for the various delays and inconveniences the poor execution of the job has caused, and still causes, to me).Desired SettlementAs I have written in an email to Mr. [redacted] on 6 February 2015, I am seeking settlement of this issue by requesting that: (1) Mr. [redacted] respects the terms of our agreement of 19 December 2014; (2) Mr. [redacted] waives at once all threats of legal action, and renounces to file a lien on my property as well as to enforce such lien with a lawsuit; (2) Mr. [redacted] leaves me a reasonable amount of time the to get a quote for the repair (which, given the difficulties I have encountered so far in obtaining such quote, I estimate at 15 March 2015); (3) in case I do not obtain an estimate by March 15, or in case Mr. [redacted] cannot wait until 15 March 2015, I request that Mr. [redacted] negotiates with me a reasonable estimate for the job as executed (out of the contracted $2,500) and that such estimate (a) takes into account the delays and inconveniences mentioned above, and (b) leaves me a reasonable sum to pay someone else for the repair.Business Response Carolina Closets Plus installed a bookcase for [redacted] in December of 2014. At the end of the installation, while making some final adjustments, a hammer damaged one of the vertical portions of the bookcase and one of the shelves. The damage was caulked, as a temporary measure, until a repair could be made. Yes, we made a mistake and have been trying to rectify our mistake since the day of the installation. Both myself and my installer who damaged the bookcase, immediately emailed and called Ms.[redacted] to apologize and offer an immediate repair. She refused to discuss the matter further, stating that "she will not trust our company with the repair". She said she was going to contact someone else to do the repair and deduct the amount of the repair from the remaining balance. I contacted her on 1/13/2015 to ask about the repair status. I received no response from her. We have always stood behind our reputation and would like to find a way to work this out with Ms.[redacted]. If she chooses to not allow us to do the repair, I have offered her a reduction in price as a settlement. I am waiting for her response, which is due by 3/2/2015. Consumer Response Upon receiving the complaint filed with Revdex.com, Mr. [redacted] has waived his legal threats and has contacted me directly with a reasonable estimate for the job as executed, for a total of $1875 out of the contracted $2,500, which I have accepted.Final Consumer Response
