Complaint Home Builder refuses to perform 1 year warranty repairs on new home despite repeated requests by homeowner.I closed on the purchase of a new home built by Carolinian Homes, Inc. on November 29, 2012. As a part of the purchase agreement the builder provided a standard New Home One Year Limited Warranty. Pursuant to the terms of the warranty, I submitted a list of items to be repaired in mid-November 2013 to Carolinian Homes, Inc. On January 23, 2014 and after several requests, [redacted], a supervisor at Carolinian who had coordinated the completion of punch list items at the time of purchase, reviewed the requested repair items at our home and advised us that he would coordinate the necessary repairs for all items on the list, including a gutter leak repair, a new front door threshold, various cracks in molding and grout and gaps on the screened porch. On several occasions since then I have sent email and other correspondence to Carolinian asking that the repairs be started and completed and I have been completely ignored. There has simply been no response. Desired SettlementI am asking that Carolinian provide me with $2500 so that I can arrange to have the repairs completed by tradespeople of my selection since Carolinian refuses to make any attempt to even start repairs. Business Response As soon as Carolinian Homes was notified, we promptly contacted [redacted]. Two of his three requested items had been scheduled and completed. The remaining item for settlement cracks, typical for new homes construction, will be completed as soon as [redacted] gives us some dates that would allow us to schedule our paint crews in home. Consumer Response Carolinian did contact me and completed one item, the gutter repair, on the warranty list. They have stated that they have ordered a new threshold for the front door and will contact me about replacing it as soon as it comers in. That was on March 12th, a little over two weeks ago. I have heard nothing since. With regard to settlement cracks, and Carolinian is quite correct that they are normal in a new home, the last word I heard from them is that they are trying to identify a new painter to take care of the repairs. I have not been advised that they have been successful in doing so and I certainly have not been asked for dates. We will make ourselves available on any date they choose. Consumer Response Carolinian has brought on an additional manager to handle warranty items on the quality homes it builds. The new manager has been very responsive and the few items on our warranty list are either already completed or about to be completed. We are now completely satisfied with the response. Thank you.

Approximately three years ago, Carolinian Builders ([redacted], President) constructed a custom-built, $470,000 house for me at [redacted]. On November 15, 2012, I closed on the house and moved in. Within the first year of occupancy, cracks formed on the walls and ceilings at various locations through the house. The builder was notified, but took no action, other than to advise the cracks were the result of normal settling, but to keep an eye on the situation. The problem only grew worse, and I so informed the builder. But still no action was taken by the builder.Finally, I hired a professional engineer, [redacted], PE, to inspect the house and determine what was causing the problem. His report indicates a major structural problem exists in the foundation of the house and urgently needs to be remediated.Despite emailing a copy of the engineer's report to the builder, he has not responded to my telephone calls pleading for assistance.Desired SettlementI am seeking monetary assistance to pay for the foundation defects as per proper building practices.Business Response The following is a copy of the email that was sent on 11/04/15 to replied to the concern of Mrs. [redacted]; Hi [redacted] and Mr. [redacted],I received your call Mr. [redacted]. Carolinian Homes, Inc. Offered a one year builder warranty with the home as constructed per the new homes warranty manual. I am happy to look at the report, which I have not seen.Carolinian Homes is unfortunately not in a position to assist in any repairs. North Carolina has expansive soils and while every effort to stabilize during construction was made including meeting the NC code and inspections required and adding rebar in the footing as required to prevent such movement. It is possible for soils to move. The next response received was from the Revdex.com and Carolinian Homes is willing to communicate to resolve your concern and provide additional documentation as needed. As stated prior. Carolinian Homes built and constructed the home to all standards to meet or exceed the NC building code. The footings and foundation was inspected and an engineer provided a soil analysis at the time the home was built. All footings and beams were installed according to the engineered specifications. After reading the attached report and per his recommendation, it appears no soils or geo-technical( professional engineer) has examined the site. We strongly recommend a second opinion from the appropriate engineer. A good recommendation would be [redacted]. Per our contract in sections 1.1, any additional soil treatment caused by inadequate soil bearing shall be billed as extra. Carolinian Homes is willing to coordinate the efforts at our cost and waive the 10 percent fee. I am willing to provide any additional information needed. I have a Geo-technical engineer appointment scheduled on Sunday November 8th at 10:30 am to inspect the foundation area and cordially invite you come and hear what they have to say in person. I would also like to understand and discuss what you meant by "Carolinian Homes is willing to coordinate the efforts at our cost and waive the 10 percent fee."Final Business Response I am happy to meet with Homeowner on-site and review concerns.

We had a custom home built by Carolinian at the end of 2014. The punch list and warrantee items were never completed despite multiple contacts. The home was completed at the end of October. There was a long punch list of many items that were not completed and things that were paid for and never delivered (attic fan and bathroom mirror) at the time of closing. There was a leak in the roof resulting in wet dry wall. The roofers fixed the roof under warranty but the builder never replaced the wet drywall. We are now concerned for mold. It has been almost a year and we have done some of the things on our own at our own expense, but the long punch list has never been completed. There is also some warranty work that hasn't been done such as nail pops and trim repair due to settling. There are tiles missing in bathrooms and non functional outlets. Desired SettlementWe would like the punch list completed. We should be reimbursed for things that we have already completed on our own. Wet drywall needs to be replaced and the warranty items need to be completed per the contract. Business Response Carolinian Homes Inc. is commented to resolve the concerns of Dr. [redacted].At the time of closing, there was a pre-settlement closing document signed and agreed to by both parties in regards to the punch list items and procedures for warranty. Also provided was a " New Home Warrant Manual" and a contact sheet for important trades/ vendors allowing for immediate contact should a concern arise. Carolinian Homes has tried to reach out to her in an effort to resolve the concerns and also we have had our attorney reach out to allow us to resolve. Our requests have been rejected. Based on the documented information we believe the items are complete. In an effort to resolve, I am happy to schedule a visit to the home to review the closing punch list and home inspector list which we have used as guidance to complete her list. We are happy to send the documentation we have to help resolve. Consumer Response I have several emails documenting my attempts to have our issue resolved. I also have documentation that I sent him copies of the punch list which he claimed he didn't have. I have emails and text messages where he states that he cannot afford to complete our items. He had his attorney contact me so that I could help him with evidence in his ongoing court cases with companies that are suing him for non-payment. As I write this I have emailed, called and texted him once again today on 10/28/2015. Final Business Response I am happy to meet with homeowner on-site to review concerns and morning.

Carolinian homes has not completed their contracted work to complete our home that they sold us ([redacted]).We purchased [redacted] from Carolinian Homes at the end of Nov 2013. We've been trying to complete many just basic items (screens for the windows, for example) and continue to get the run around. Below is a summary of the minimum agreed upon items that needed to be repaired as of our correspondence Aug. 3. The nearly absent and recently sporadic communication continues to promise but has not delivered. We still need to have our missing screens ordered and the wrong sized screens exchanged for the correct size. In addition, our desk area including the wood trim and a non working outlet is still not installed or fixed. Our disposal button is also still not attached on one of the sinks. Is there a time that you can have some of the work done including measuring for the screens and figuring out how to handle that? I contacted the screen company myself several months ago but they never returned my call. There are other issues that need to be done likely sooner than the 1 year warranty time (which is November). We were informed they were to be out of town much of the summer and would call when they returned to schedule a one year walk though prior to the settlement date.I promptly responded via e-mail and phone to Mr. and Mrs. [redacted] E-mail from last night. I am pleased to meet at there home and review the items of concern in order to provide the best possible customer service to promptly resolve the warranty request.
