Complaint:
I am rejecting this response because: I got in touch with the distribution center that Gatehouse uses, and they informed me that they would NEVER send a year old remote or anything used to any of their fulfillment centersThey assume that Gatehouse is pocketing the items being sent to them from the manufacturers as new, and then sending used or off-brand products and keeping the money Their vendor then said they would send me a new remote since they haven't used that remote in years.There are people in my building who also purchased this same exact remote from Gatehouse all around the same time, and all of us got that exact same remote they sent meAs for excessive wear and tear, I find that extremely hard to believeIt's a pocket remote that I kept in my pocketThe only 'wear' on it that I was able to see is the cheap rubber button that was NOT supposed to be a part of the remote started to peel offNo other damage was on the device before I sent it.I've contacted an attorney who is in the process of collecting victim statements from the other people in my building that were scammed by GatehouseTheir vendor is working withe my attorney as well to see why they are sending old and/or used items and selling them as new.In the event that they want to stand by their story that they're getting these items from their vendor, they need to contact their vendor and find out why their vendor is sending old and/or used items to them, thereby causing Gatehouse to send out old and/or used items.Basically what this comes down to is: Gatehouse is a fulfillment center for vendorsAs a fulfillment center, they have the obligation to ensure the product being sent out is the product the customer orderedIn at least cases in my building, this was not doneThey sent different old and/or used remotes to the of us This is a textbook example of consumer fraud.All in all, this is a $remoteThe fact that a company would defraud their customers over $shows the moral value of this companyI'm doing my best to work with my attorney and file a complaint with the Attorney Generals office for consumer fraud

Tell usWhen the customer ordered the remote on 8-11-17 see order labeled AWe did not have any in stock so we ordered a new one from the manufacturer on 8-16-see inv labeled B.When the remote came in on 8-22-see UPS tracking included labeled C.We shipped out the
brand new just received remote on the next day 8-23-to the customer see Gatehouse ship manifest attached labeled D.These remotes carry a one year manufactures warranty.The remote the customer returned on 4-11-showed excessive signs of wear see photo labeled E-it did not appear to be the one that we had mailed to him last AugustIf you look at the photo of the rear cases Labeled E-2 you will see that the remote he returned has silkscreen information that is formatted differently than the new remotes that they currently make.Upon seeing this we emailed the customer asking if he sent us the wrong remote back by mistake see email labeled F.The customer then called and we told him that all we could do at that point was to send the remote back to the manufacture to see if they would warranty itHe demanded that we send him out a brand new unit directly from us and we informed him that we could not, it would be up to the manufactures determination after we send it back to them as they handled all warranty replacements.The customer later emailed us see email labeled G, asking us to return his remote which we will be doing today via usps first class mail tracking # 9402110200828711595179 Based on the above information and clear paper trail of the transaction we feel that we handled this matter correctlywhy here

We will stand behind the paperwork trail submitted in previous reply. The customer ordered the remote from us we intern ordered it from the manufacture and sent out exactly what they sent us.The final choice on how to handle the matter was the customers.We offered to send it back to the manufacture for them to determine whether or not to warranty it, the product is theirs and clearly supplied by them we are just the middleman.The customer did not want us to do that.While the customer is entitled to his opinion that he doesn't like the fact that we send the products back to the manufacture to handle the warranty claim, he should be careful about making claims about our company especially given the clear cut paperwork trail that we submitted.

I am rejecting this response because: There are no claimsFour people in the same building bought the same remote from the same place and all received year old remotesSo, either Gatehouse is lazy and doesn't inspect items that are delivered to them before they fulfill them, thereby breaking customer trust and the law, OR they are pocketing the new items they get, and sending out old items, as their distributor believesJust because they have a paper that shows they ordered the item doesn't mean that's what they sent me.I, in turn, stand by my factual claim that my attorney and I believe that The Gatehouse is involved in consumer fraudA complaint was also raised with the attorney generals office with notarized statements from the other victims of the Gatehouse showing they got the same remote I did.My issue was not that they would have to send this item to a manufacturer, although they omitted that's how they would handle it, my issue was they sent me a year old remote and refuse to admit that THEY screwed up and now will not honor to fix THEIR mistakeThe fact that they want to fight customers over a $remote and call their customers liars shows that this company has no intention on resolving this on good faithTheir own distributor has to fix Gatehouses mistakes.? It appears that Gatehouse has no intention on fixing issues they've caused by sending out defective, old and/or used equipmentI'm going to continue this through my attorney at this point and will happily see them in court over consumer fraud.I, just like Gatehouse have a paper trail that shows a lot more data than theirsI have timestamped messages from August of to others stating that the remote was different than their picture online and that I was concerted about damageI hope they're ready to prove that the exact remote that was sent to them matches the serial numbers of the one they sent me, along with everyone else they've defraudedWelcome to paperwork nightmare, GatehouseYou picked the wrong one to rip off this time.Including a picture of one other the other remotes that another tenant in my unit received, which is also a ten year old remoteThey have an invoice as well showing this was ordered around the same time as mineSo...how many fake parts is Gatehouse sending out and pocketing the new items?Again, my overall concern is that they are not honoring a warranty repair or a refund for sending out incorrect equipmentThem treating me like garbage, calling me a liar, and continuing to stomp their feet and cry over a $remote to me shows they have no good faithThey know they got caught, and are now being defensive.Please see attached message from my maintenance man here in my building (another person who got a year old remote and has since stopped working as well) along with a screen shot of another persons remote they ordered in 8/and got a year old remote as wellI have enough proof to show they are sending out year old remotes to at least peopleSo....see you in court!Regards,

The Gatehouse has a policy on their website of no returns on electronics including circuit boards.? If the customer would like to discuss this further, please have them call us directly
