Hector received the assignment from State Farm and he set up an appointment to estimate the damage, take measurements, send samples of the existing floor and send information to State Farm. Approximately one month later Hector had to return and make an estimate for a 3 x 5 bathroom area. His estimate to repair the bathroom was 294.73 for the insurance.
The customer then picked all her materials which were upgraded to wood and laminate. Hector showed her the samples and they matched the materials we had in stock. She signed the contract and we ordered the material. We always order materials as soon as we have the approval from the insurance company and a signed contract from the insured. The insurance companys like to resolve these claims as quickly as possible. For us to provide good service to the company it is very important that we have the materials and avoid any delays. -
She came in around the first week of March and told our estimator, M[redacted], that she wanted to change her order from laminate to wood. M[redacted] told her the material she had contracted for in January was ordered in January as a special order for her job and that the stairnose was custom made for her house and could not be sent back. The laminate could be returned but she would have to pay a restocking fee and freight both ways.
The customer called State Farm and said that she was going to cancel the entire order with us and go elsewhere. We have billed her for the custom order and restocking fee and freight. To date she does not return phone calls.
In regards to the wood not matching the existing width of her existing floor. Hector took the sample that matched what we have for her job. She approved the sample and order at the time she signed the COntract.
I had a conversation with the State Farm Adjuster on April 30 regarding the cancellation of this claim and she told me she had discussed the cancellation with the customer and informed her that there would be restocking fees etc. if she canceled. The damage was done to the house and replacement was necessary so the cancellation did not make any sense to the adjuster,

Review: Carpet One/Valley Flooring was contacted to assess and write up a proposal for repair and replacement cost value of material and flooring that was water damaged on November 8, 2014 in my home (this was sent to State Farm Insurance). On November 20, 2014, they inspected the damaged area of my home and measured for replacement of a carpet. At that time, I very clearly explained that I was not going to replace the area with carpet and would like to discuss alternatives such as hardwood or ceramic tile. I explained that I wanted a long lasting solution, not something that would have to be replaced in a few years. On January 14, 2015, I asked Carpet One to re-measure the upstairs and give me a new estimate that did not include carpet. They provided me with a second proposal to furnish and install hardwood on my stairs and laminate in the bedrooms. My understanding is that a proposal is an offer put forward to a client for consideration or acceptance. A proposal should describe the types of goods or services offered by the seller and the estimated period of delivery and the budget. (This proposal did not even give any estimated time periods, measurements, or size) The proposal is an offer not a contract. It is the first step towards the making of a contract. This proposal was hand written paragraph with general information. Certainly not like the proposal that Carpet One originally sent to State Farm back in November. That proposal included measurements, costs with materials and labor. When I stopped by the store several weeks ago, to discuss the proposal, I was surprised that Carpet One had ordered materials (oak planks that were 3") which do not match my existing oak 5" planks along with stair noses that they said had to be "custom made". They also informed me that these stair noses cannot be returned and I will have to pay $855.12 for them as well as $203.12 restocking fee for the laminate and $220.00 for freight. They are now telling me that their proposal is their contract. I disagree.Desired Settlement: I would like them to settle this by sending the materials back to the Armstrong Fifth Avenue Company. The materials do not match my existing floor and should not have been ordered before contacting and discussing all details with me. This proposal from Carpet One/Valley Flooring should have been helpful in making a decision to purchase flooring based on the details of the proposal, not used as a contract to order materials.
