Initial Business Response /* ([redacted], 5, 2016/09/23) */
Sept 21, 2016
My name is [redacted]: I am the owner of "[redacted] Custom Auto Upholstery"
I will start by answering all insinuations made by [redacted]. I first drove to [redacted] Feb 2016 where I met [redacted], I gave him a rough...

estimate of $[redacted]. We drew out rough drawings of what he wanted, [redacted] dollars was exchanged to order materials. At this time he was informed it could be less it could be more. I have pictures of everything he drew which are nothing like the fifth and final door panel pattern that he finally drew after many requests to come to my shop and show me what he wanted. He finally showed up after me telling him I am not doing anything more to his car until he is physically standing in my shop.
When I did the first door panel and showed them it "was Beautiful and they loved it", then after talking to their autobody man, they changed design and told me to change it. I was also told at this time they were extremely happy with quality of work.
As far as life experience with communications break down I bet he does have a lot more experience than the average person, because most people after they change their mind they come show you what they want, but I have laid eyes on the man twice in 8 months, He did not communicate with me at all face to face.
When original design was made Insert material was green so I ordered 3 yards of green @$** per yard and main colour was to be 10 yards @ $** per yard and 1 yard lime green for cording @ $** per yard
I had ordered all material and had one seat cut out and was informed that the inserts were to be in white @ $** per yard and main colour is now green @ $** per yard. So I tossed in a pile the pieces I had cut out and ordered 6 more yards of green @ $** per yard.
When the autobody man came to tell me what he would like he told me back of back seat was too high so I took apart again and redid it with insert shorter. When they saw this they informed me it was too short so I took it apart again and put it back to exactly the way it was and they loved it.
The panels have been changed a multitude of times due to the five different designs I have been sent. I have all the old seat materials and door panel covers and patterns they changed. Him saying that I would keep changing things until he liked it and I admitted.? was wrong and would do so at my cost, is not what I told him. He was informed changes were his cost and that door panel changes were costing him [redacted] dollars per door panel for labour.
At this point in time I have 74 'A hours of labour at $[redacted] per hour and $[redacted] dollars in material. I have also charged him storage for the months I had his interior and didn't get paid, because the paint on his car wasn't finished yet.
I tried on two occasions to settle this not charging him for 35 hours of labour but I was told "Not going to happen" I was also told their was no way he was paying HST "Not going to happen"
Then I knocked some more off my bill for the lack of installation. It was agreed from day one that I could only install the interior in my shop, but he insisted on me doing it at the dusty auto body shop in [redacted]. I told him that this wasn't going to happen numerous times. So he took his car home to [redacted], completely the wrong direction. He then texted me and asked when I was coming to [redacted] to put in his interior. I told him I was not, that it would take me 4 times as long to do it in [redacted] due to 3 1/2 hours travel, lunch breaks, etc. He was informed it would cost him $** per hour to have it done in [redacted]. His answer was "Not going to happen" So I was again left in limbo.
There were also extras that were not in the original rough estimate etc. fender welts and dash vinyl and seat belt covers.
I tried to resolve this by breaking even and not making a single cent on a complete car interior, but this was not good enough for him. He offered me $[redacted] for my 74 1/2 hours of labour!
Therefore I am talking to[redacted] on [redacted] and since this is going to[redacted] I wrote out a bill for all materials and labour plus tax and storage. This man has belittled me, called me a thief, defamed me at every car show and I am going to talk about a slander law suit. I have repeatedly asked him to serve me with a summons and take me to court and decide who is right but he refuses.
do want this to go to court to undo the damage to my business already done. In 35 years of business I have never had problems with a customer like this.
He said that this has gone on long enough so he drove an hour and a half to negotiate. What really happened was he couldn't find my place because he had only been here once before (All other people I do interiors for ask if I mind if they show up now and then to see how the interior is going).
[redacted] stopped at a place a couple of km away, that bad an old car out front, and asked if they knew where I lived, he did, because I have done a few seats for him. And then the ranting went on for a half hour and he left. He came over to my house, I wasn't home, He went in my closed shop and stole 6 pieces of his interior then went through my kid's tree house, my shed, and my house and couldn't find the rest of the interior, So he went back to the original house where he got directions and ranted for another hour, He inquired if there was a storage shop where I would have stored his interior, He asked where the interior out of the old car is that was in the drive way ( [redacted]) He told him it was in his kids bedroom then he was told he wanted to see his interior and was asked "do you have my interior in your bedroom?" He was asked to leave after scaring the whole household. He then said he was going to call the police and left. He then came back over to my place and I was now home...A truck drove in my yard blacked out and three guys got out and rushed to the door demanding to see his interior.. My girlfriend asked him what his intentions were and if he brought money to pay his bill. His reply "what do you think I'm [redacted] stupid?" I told him I would show him the interior but it is not corning out of my van, where it has been stored for six months (couldn't use my van because his stuff was stored in it) He said "Oh its in the van" the only place on property he didn't look. I told my girlfriend to keep an eye on him while I got the pieces from my shop, which were no longer in my shop, but in his truck!
He admitted to taking them but didn't tell me he walked all over a customers couch to get them form behind it (it was muddy outside, couch had to be cleaned before it was delivered). When I found out he had been in my space I closed the van and told him to get off my property. He said he was going to phone the cops. I said "I wish you would and if you don't I will" The cops were phoned. The police told him and I that this is a civil matter and that it can't be resolved here you will have to use the courts. This I have wanted all along is what I told them. Then he came up on the steps again and offered me $[redacted] for my 74 'A hours labour. I told him he can pay his original bill of $[redacted] plus tax plus $[redacted] for storage, and now $** for cleaning the couch he walked on minus the $[redacted] deposit. "Not going to happen" he said.
The Police then went into his truck and gave me back the pieces he stole. He says in his complaint that I was raging at him and this guy a foot taller than me and his two 250 pound buddies were scared by my girlfiiend and I sitting on our porch? He did yell that he was suing me for $[redacted] and left and phoned you.
You will notice that in our text exchanges there is no reference to bad worlcmanship until the confrontation at my house because until then I was told they were happy with my workmanship. The only time he has seen his full interior is 9:00 at night piled in my van in the dark.
Therefore [redacted] can only settle this by giving me cash or certified check in the amount of $[redacted]. I would rather take this to court and get all that is owed me due to this being no fault of mine, proving him wrong is now to repair the damage he has done to my good reputation. Taken to court cost will be $[redacted]5 plus $** for cleaning the couch.
[redacted] has already received back window dash, soundproofing, Dash Wing and Fender welting and if this does not go my way, I would like those things back because they were never paid for.
A third party will have to come to get his interior because I am getting a [redacted] in his name.
I gave him a rough estimate
Breakdown of original estimate $[redacted] to $[redacted]
40 hours to do interior at $[redacted] per hour for shop time. $[redacted]
10 hours to install interior in car. Cost only covers interior installed in my shop. No traveling costs, no closing my shop, no carting heavy tools, no meal costs on the road. 10 hours at $[redacted] per hour $[redacted]
$[redacted] for material
If you are trying to like he told me and the police, "he came to bargain in good faith" He went into my place, stole from me, came here in the dark with [redacted] with no phone call and walked on a customers newly reupholstered couch and offered $[redacted] cash
I have all receipts for materials bought and ordered which comes to $[redacted]
It says on your phone recording that if you are making a complaint, you must state all facts of the case, no omissions or the complaint will not be filed. I would say there is a lot of untruths and omissions in his complaint.
Enclosed are all texts and messenger texts that were exchanged between us. I think you will find bargaining in good faith was the last thing this narcissistic man has on his mind.
Yours truly [redacted]
Initial Consumer Rebuttal /* (3000, 7, 2016/09/30) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Thank you for your response [redacted] . No I do not accept this response. It has no fairness in it for your customer only you. This is not negotiating , this is demanding me to pay for something that I did not request ,and does not match my drawings , and u are requesting me to pay for an install that did not happen. The original price was $[redacted] plus tax for all items of the [redacted] to be upholstered & installed .He agreed to do 1 door panel for me to inspect before proceeding to the next step .He failed me that day back in Feb 16 2016 .he sent me a pic of seats & panels done .my wife told him in a text call [redacted] ASAP .upon our arrival to inspect in April I wasn't happy and I told him in the nicest way I could but he was enraged at the thought of having to incurred changes as his customer was not happy because upholstery did not match the pics I sent via text and [redacted].he agreed that with my $[redacted] deposit that there was enough material to fix his errors .I thought we parted ways civil.he agreed via a phone call to come to [redacted] to install my headliner instead he called me in a drunken rage. Business relationship with this company dissolved after that phone call .
I drove 1.5 hr in Sept to negotiate with this business .Business door was open I walked in yelled [redacted] name ...no one around. I felt a right to have my parts that are not upholstered back .when I called the RCMP on [redacted] due to his nasty nature I gave theses pc's back to the RCMP. And decided at that moment to report him to the Revdex.com and court if needed I have every right to have my pc's, parts back to my [redacted] plus my $[redacted] did design that I did not request. The customer should be able to choose what they like. Should a painter paint your house black if you want it Blue ?
Much of [redacted]s report above is inflated and not factual. The neighbors were very kind to my husband and filled him in on the lack of business ethics by [redacted] and his wife [redacted].
If [redacted] could be civil and fair I'm sure we could come to an agreement somewheres near the original price if he had followed my design as requested but since he didn't and won't I think it's best to give me back all my parts that I own and my $[redacted] deposit. If the it original price was $[redacted] installed then it should be $[redacted] not installed . We have talked to many of [redacted]s customers , they all say $[redacted] total installed .we have 4 very unhappy customers that would like to come to court with us . I'm willing to pay $[redacted] minus my deposit of $[redacted] but this is truly just trying to be civil .I think the 1st option to dissolve is best . I will be filing [redacted] unless I hear from the Revdex.com or [redacted] .The 4 customers also have told me that they also will be filing for court for unsatisfactory work . As for slander, your business and how you deal with customers is what u are making for yourself. Your future is in your hands , I can't help what people are saying - it's freedom of speech.
Thank you [redacted]
