Initial Business Response / [redacted] (1000, 9, 2015/10/09) */ The Honda CRV was not advertised or sold as a 4wdThe customer who was [redacted] , came in with her sister [redacted] , the filer of this complaint, and her husband and the three of them test drove the car and then purchased itAbout a month later the sister, [redacted] called and said she did not realize [redacted] had bought a Front wheel drive and wanted to trade it in for a 4wdWe agreed to this if they wanted to pay the difference in price and cost of returning their car and preparing it for sale [redacted] did not want to pay the differenceSince that time, [redacted] , who was not the purchaser of the car, has been posting bad reviews on social media pretending to be the purchaser of the car and making claimsWe have contacted our attorney and are in the process of filing a lawsuit against Ms [redacted] [redacted] , the purchaser of the car, did have some problems with the car that were not covered under warranty: Tires balanced and the Air conditioning servicedWe repaired the car in good faith at no charge to the customer even though these items were not covered under the warranty We are still willing to trade the vehicle for a 4wd if they are willing to pay the difference in cost Initial Consumer Rebuttal / [redacted] (3000, 11, 2015/10/16) */ (The consumer indicated he/she DID NOT accept the response from the business.) First of all I do agree- the CRV was not advertised because the car we originally were looking at had sold, so Dave stated he had two "just like it" coming inI told him we would be interested in seeing themWhen my husband and I came it look them, they were not ready yet, in fact one had the interior torn outWe picked one of the two we were interested in and put money down on it, stating we would be back with my sisterWe talked to Dave about the vehicle my sister was driving now which was a big four wheel drive pickupHe even gave us an idea what he thought it would be worth We came back to look at the vehicle with my sister as the vehicle was for herMy husband did not test drive the vehicle as Dave claimed; he stayed behind and talked to Dave while [redacted] and I drove the vehicleWe noticed the issue with the tires and Dave stated that the vehicle had been sitting a while and to just drive it and the tires would stop vibratingMy husband and I purchased then this vehicle for my sister [redacted] as it seemed to be what we were looking forWe were trying to get her into a smaller, more practical vehicle than she had and then we would sell her big truck for her as she is unable to afford to buy something outrightShe lives out of town and requires a vehicle for adverse road conditions so she can travel to workWe put the car in my sister's name as it was going to be her carI was certainly considered the "buyer" when Dave took the checks from my hand and I have the statements and cancelled checks to prove we did in fact pay for the vehicleI believe that does make me the purchaser of the car and not as Dave statesWhen my sister went to insure the vehicle, they informed her it was a front wheel drive according to the VIN numberWhen I contacted Dave about it not being an all wheel drive, he said he thought it was an all wheel and even checked in his file to make sureI asked him about trading for an all wheel CRV that he had in stock and he said he was not interested because he already had another wheel drive on the lotI believe this is because they are harder to sellI questioned him about the price of the wheel drive we purchased being the same as the all wheel he soldHe quickly stated that all wheel was not a very nice vehicle cosmetically but he then said he thought the customer that bought the all wheel CRV we were looking at was not happy with it and maybe would trade for ours and he would contact him and inquireAfter waiting and questioning about that possible trade, Dave just texted me the other customer's number and said to contact him ourselvesWhen we did the customer had no idea what we were talking about and declined a tradeWhen we questioned Dave about this, he suggested we offer the other driver $and he would probably tradeI thought this was very odd and did not contact the other customer about this "deal." After that Dave offered to "help" us sell our vehicleOnce we sold it we could then purchase the all wheel drive he had on his lot he saidHis "help" consisted of telling us to copy and paste his ad for the other wheel CRV he had on Craigslist My husband went to the dealership again to speak to Dave face to face about trading for an all wheel driveThis time he recorded the conversation with his phoneDave clearly stated he was not willing to trade and stated he already had one (wheel drive) With reference to the warranty work-when we bought the vehicle Dave stated it had a bumper to bumper warrantySince it was a previous salvage/flood vehicle we thought that was reassuringWhen we brought it for some work I asked for something in writing stating that things would be fixedHe said that's why you have a warranty and offered nothing writtenI gave him list to fix things that I am sure he would have charged us for "to prepare it for sale" as he stated if we tradedThe car has some engine issues as it backfires or pops upon starting (was on list-still does it)Also one of the biggest complaints we had is the car either was not cleaned (maybe just vacuumed) or put back together wet because it smells extremely mustyThat was not repaired, nor was anything else on the list except the air conditioning was probably just recharged, and tires just balancedI'm sure we will have to replace the carpeting and pad on the vehicle to make it even bearableIn regards to Dave's "pending lawsuit"- I prefer MRS not MS as I am proudly married to my husbandI would certainly welcome talking to any attorney, judge, court, jury or whoever elseI have nothing to hide, nor have I done anything wrongI have posted reviews stating only factsI was sharing my experience the same way you would with any other business, hotel, restaurant, etcI believe in people having the tools to make informed decisions and they can take my advice or leave itI am not aware of that being illegal.When I read Dave's response to my complaint, I tried again to contact Dave thru text and email and received no responseIn the end, this whole transaction has been one fiasco after anotherIt should not be this stressful buying a car from a dealerI would think they would stand behind their vehicles and if nothing else honor their wordSince we cannot trust getting another vehicle for this dealership, we would really just like our entire purchase price returned for this vehicle

month later the sister, [redacted] called and said she did not realize [redacted] had bought a Front wheel drive and wanted to trade it in for a 4wd. We agreed to this if they wanted to pay the difference in price and cost of returning their car and preparing it for sale. [redacted] did not want to pay the difference. Since that time, [redacted], who was not the purchaser of the car, has been posting bad reviews on social media pretending to be the purchaser of the car and making false claims. We have contacted our attorney and are in the process of filing a lawsuit against Ms [redacted]. [redacted], the purchaser of the car, did have some problems with the car that were not covered under warranty: Tires balanced and the Air conditioning serviced. We are still willing to trade the vehicle for a 4wd if they are willing to pay the difference in cost.

After waiting and questioning about that possible trade, Dave just texted me the other customer's number and said to contact him ourselves. When we did the customer had no idea what we were talking about and declined a trade. When we questioned Dave about this, he suggested we offer the other driver $500.00 and he would probably trade. I thought this was very odd and did not contact the other customer about this "deal." After that Dave offered to "help" us sell our vehicle. I was sharing my experience the same way you would with any other business, hotel, restaurant, etc. I believe in people having the tools to make informed decisions and they can take my advice or leave it. I am not aware of that being illegal.When I read Dave's response to my complaint, I tried again to contact Dave thru text and email and received no response. In the end, this whole transaction has been one fiasco after another. It should not be this stressful buying a car from a dealer. I would think they would stand behind their vehicles and if nothing else honor their word. Since we cannot trust getting another vehicle for this dealership, we would really just like our entire purchase price returned for this vehicle.
