Page 1In August 2015, I left a check for $10,(amount requested by Mitch C***) and the hand written note (pg 2)on the back porch for MrC***The gutters were not removed and re-hung as per the agreement The photo reveals the resulting problem I question that this is a legal contract based on what is required by the PA Home Improvement Consumer Protection Act.Page 2Mr C [redacted] verbally agreed to the items on this hand written note He failed to enlarge the gable vent.Page 3Several months passed without any communication or explanation from MrC [redacted] as to why there was a delay in starting my job About this same time, MrC [redacted] had recently done a job for my sister-in-law and was requesting final payment from her I suggested he take that amount out of my deposit He refused to do so but did agree to accept a penalty clause in order to receive final payment from my sister-in-law Because this penalty clause was now in place, work finally began at my home in April 2016, months after holding $10,of my moneyPage 4In May, MrC [redacted] seeks final payment even after I called to his attention that the siding was installed too high as it did not completely cover the house He agreed it should be lowered In good faith, I gave him $7,but explicitly pointed out the numerous additional areas(see pictures) that I expected to be correctedIt was clearly evident, had I not done so, he would have eagerly taken final payment at that time without doing any further work.Page 5This is my response to his letter on page He called after receiving this letter (refer to recordings file) and my wife and I had a conversation with MrC [redacted] explaining our concerns.Page 6There was no further response or follow up from MrC [redacted] after that conversation I sent this letter to him as a last effort before seeking third party assistance.Page 7This is the letter that was sent by the Alliance for Consumer Protection of Beaver County

First of all the customer agreed on price which included labor materials and clean up the material price and labor price are my business.Second the customer said there are issues with the workmanship but would not give a list of the issuess.Yes we did remove siding on front of house because it was started inch to high.We installed it on Friday and removed it on Monday and he says its used siding.Im not sure anyone can please this customer.The customer owes me $4,because he claims the siding on front of house is used because we removed it and moved it down inch the siding is new.Thank you Mitch C***

I have been in business for many years and have a reputable company with MANY satisfied customersOur work is done professionallyI have always responded in a timely manner to take care of any problem the customer might have.To my knowledge, the work done at Mr& Mrs [redacted] s house was completeI have been to their house a couple of times already but cannot satisfy them.Thanks,Mitch C***

Dear [redacted] of the RevDex.com, This is Mitch C [redacted] of Carver Construction, and I am responding to a complaint filed against me ID# [redacted] . We formed and poured a sidewalk for [redacted] at [redacted] *** last year. This... spring, a hairline crack, 36” long, appeared in his sidewalk. Although there is no guarantee that the concrete would not crack, I said that I would replace that small section. I stopped by the [redacted] ’s and talked to ***’ wife, and I explained to her that the next time I had a cement truck in the area we would remove and replace it. *** *** It is now 12/09/and I've yet to receive a date and time that this rework will be completeMitch the owner, did visit our home as indicated in his responseYet we are no closer to resolution of this issue than we were months agonow the ground is frozen and repairing this concrete will have to wait even longer (spring at the earliest)this is pushing back other projectsnot to mention the complete lack of professionalismas a consumer, it is concerning that the business is claiming that they will stand behind their work, yet when push comes to shove we get excuses like 'it's hard to get a concrete truck out here for such a small pour'frankly, I don't care what challenges are being faced by the construction companyI want the sidewalk that I've paid for

These responses are numbered to match the last response by the business Thurs, June 29, 2017. The contractors bid and contract was to remove and reattach the guttersAfter replacing the entire roof, and yrsof experience, he called our home and asked how the gutters were attachedThen stated that he is not taking them down. Properly installed fascia covers the entire fascia board and extends up under the drip edge.(refer to the pictures) We were shorted twice hereGutters were not removed as per the contract and we received 1/of the fasciaThe sequence the contractor chose to do the tasks was incorrectThe roof, soffit and fascia needed to be worked at the same time in conjunction with one another Estimates and contracts are two different things Guidelines for writing remodeling contracts were set in and were not adhered to The gable vent was not enlarged enoughThe gable vent on the back of the house was to be enlarged to the size of the attic exhaust duct (duct 15"x18")(vent opening 10"x15") pictures are available The communication started when WE reached out to MrC*** He took $10,in August and promised to start in September When he did not start there was no apology, explanation or offer of a refund that you would expect from a reputable businessHe had our $10,for months before anything startedA contractor can require no more than 1/of total job cost as down paymentWe only made reference to my sister-in-laws job to explain why MrC*** agreed to write a penalty clause containing liquid damagesA copy of this is in cust.docs.pdf We are not sure what MrC*** is saying hereIt could mean that standing by your work is when you throw a job together then return and fix the items the customer points out as being unsatisfactory 5.He needs a list? A yrprofessional needs a list after returns to the job and us telling him to look the job over and make any corrections 6.If he looked at his job as we asked him to, why would he need pictures? We do not know where he is coming from with the "total redo" demandWe mailed a letter to him dated August 23, A copy of this letter is in cust.doc.pdf This letter offers two POSSIBLE solutions to settle the disputeAs I mailed this letter, I sent a text to his cell phone alerting him that the letter was on its wayWe did not receive a response to the letter or the textWe were ignored 7.Refer to 5andresponses Vinyl does expand and contract and that is why it needs to be installed correctlyThe materials are manufactured to allow for these movementsGaps as a result of uneven cuts is due to poor craftsmanship This is why we have doubts that the removal of the siding on the front of the house was done properlyThis is in reference to the vinyl, what excuses are being offered for the aluminum work? We are not being unreasonable with our expectationsI have worked in the industrial construction industry for yrsand can determine what is acceptable and what is not

Dear [redacted]:     We DO NOT wish to enter into binding arbitration.  We understand that it could mean we may be forced to let the contractor that we do not trust back to our home to correct the issues.  In addition we do not want to give up the right to pursue legally.      We understand the contractor most likely needs to agree to arbitration or risk loosing Revdex.com accreditation.  Our hope is that the Revdex.com will review this complaint and reevaluate as to whether Carver construction is upholding accreditation standards.                                                                                                        Thank you,  [redacted]

Mr. C[redacted]'s response does not address the issues at our home.  He has returned to our home seeking payment and we would point out unsatisfactory work(one being the lowering of the siding on the front of the house).  As mentioned in one of our earlier responses, regardless of how bad, he was willing to let a deficiency go unless we pointed it out.      He is now saying he is done, my work is professional, I'm not going to redo anything else.  Listen to the phone recordings we have provided then look at the pictures. Our hope is he responds to them. We are not satisfied and are left with a problem.      A response in regards to the contract agreement.  Does it comply with what is required by the Pa. Home Improvement Consumer Protection Act?  The contract says the gutters will be removed and reinstalled.  This was not done.    We hope Mr. C[redacted] will make responses that addresses these issues.  Thanks [redacted]

My response to the complaint:1.  It was too difficult to remove the gutters because of the way they were installed on the overhang. Mr. [redacted] wanted to keep the same gutters on the house. I explained this to him and he agreed that the gutters were too difficult to remove. Therefore, what we did was lift the gutters and installed the aluminum fascia behind the gutters.This is my way of doing estimates which I have been doing for over 30 years. Mr. [redacted] signed this estimate and agreed to the total cost which has not been paid.2.  We did enlarge the gable vents.3.  I did communicate with Mr. [redacted] regarding the starting of the job. The materials were ordered and in the warehouse paid in full by the $10,000.00 deposit. By the time I was ready to begin work on his house the weather got bad and wasn't able to start until spring. I explained this to him and he agreed.Regarding Mr. [redacted]s sister's job - that has nothing to do with this complaint therefore I will not comment on it.4. The siding was removed and lowered. We went back twice and addressed the issues that he was concerned about. At that point, I thought everything was good. We always stand behind our work.5.  At that time he would not give me a list of their issues regarding the work that was done on the house. What he wanted was a "total redo" of the entire job. I told him that was not going to happen and for him to give me a list so I could address the issues.6.  The first that I received any pictures of the siding and soffit & fascia was from the Revdex.com. Mr. [redacted] refused to pay the final payment because he wanted a "total redo" of the entire work.7.  If Mr.  [redacted] would have told me what the issues were from the beginning I would have addressed them therefore not dragging this out.As far as the pictures go, vinyl siding expands and contracts. When we left the job there was no gaps and no buckling.
