This is my response to mr*** Carville's letter of October 2nd ,.#***
Mr *** Carville states that he includes a work sheet for the items checked on my car from Carville Auto Mart,he states that my car was "fully reconditioned"I enclose ***s from Big tires,where they state the tires were cracked & oldDangerousI enclose ***s from Mini Cooper of Loveland, where they did an evaluation , the liquids had to be flushed ,they were were dirty and badly , needed changing .The trim over the front fenders were not attached to the cars body and had glue on them, the paint which was promised to be "like new" so said Mr *** Carville, "we have an artist who will make it look like newwas far from acceptable " The drivers side door,interior has a separation of about inches and a large crack in the panelThis does not sound like "fully reconditioned." Mr Carville mentioned an airbag problem,that Carville took care of ,not so, it was taking car of in Mimi Cooper of Loveland dealership,where I took the carThe ***s I enclosed reflect this repairTo add fuel to the fire, I googled blue book and found out that *** Carville,told me he was selling me the car for "$below book value" when I checked I found that I trusted an untrustworthy person, it turned out to be $more then the book value
In answer to" the favor they did me" by delivering the car to Aspen & holding the car for two monthsMr *** Carville was most anxious to hold the car for the wks Id be away,and he seemed most happy to deliver the car to Aspen, I said it would be better to deliver it to Glenwood Springswhich was one hour closer for driverWhen the car was delivered it had Oil sprayed on the front, from what the driver told me was a faulty delivery truckMr *** Carville states the driver offered to get the car washed for me,not so, He said "YOU should get this car washed",
Mr*** Carville stated he usually charges $for such a delivery,he seems to forget he delivered my friend *** *** car Just a 2yrs ago for freeI was gone from June 1st til the 21st of JuneI called *** *** for a delivery date,he told me he was trying to find someone to deliver the carI continued to call every days or so because I never heard back from ***He always apologized and told me how he was busy with other customersWhen I finally got a delivery date he informed me the temporary license plate was outdated,apparently no one told the person who makes this license up to hold off for a few weeksSo I had to drive some miles back to Aspen„ in my friends car ,to get plates and come back and install them myselfThe period of time for delivery turned out to be two weeks, before they could get the car to me*** *** had lots of time to set up a delivery as I was gone wksHe never said he would do the paint over,as Mr *** Carville states in his letter.,left messages for both *** Carville & *** *** ,and never got a message back
In conclusion The paint on hood was not the right color& not properly filled in, what *** Carville Said",it will look like new." was not trueTo say the car was fully reconditioned is far from true, as Mr *** Carville said in his letter.A fast deal was made
I will drive the car back to Grand junction ,I have already replaced all four tires,which you can re-enbursh me.forI wasn't going to drive around on tires that were not safe
I would like the door on drivers side to have a replacement inside panel& attached to the outside door.properly
I would like the paint on the car to reflect what was promised "We have a guy that's an artist,it will look like new." I frankly feel the paint on the hood needs to be sanded down and repaintedI think this is not asking for much, being that I payed you $more than the book value.As per *** " I'm selling you the car for $under book valueI trusted *** Carville and *** *** who were so charming, until they had my money
As I added a clear bra,on the day the car was delivered,invoice is included,not to incur more chips in the paint, please carefully remove and replace the bra when paint is done properly
Carville Motors should be doing business in a more responsible manner

As President and Owner of Carville's Auto Mart I am writing in response to ID#*** concerning *** ***.
The year old Jeep Grand Cherokee Mr*** purchased occurred almost years agoThe vehicle was priced at $12,and Mr*** negotiated a $
cash discount upon purchase for $10,Mr*** had a choice of over vehicles at our dealership and after inspecting the vehicle and taking a test drive he chose to purchase the Jeep.
The Jeep was sold "as is" with the dealership agreeing to $of repairs listed on Carville's "Repair Agreement"In addition Mr*** signed off on multiple disclosures listed on the "Repair Agreement" and rejected the offer to purchase a Service Contract or Repair Policy.
The subject Jeep had very low miles (57,000) and was in extremely good condition as evidenced by the enclosed inspection worksheetCarville's Auto Mart did not do any paint or body work on the JeepI am disappointed that Mr*** experienced the problem with his Jeep but after years of ownership we will not refund his purchase price as he requestedHowever, Carville's will be more than happy to give him an above average trade in allowance for his Jeep on the purchase of a different vehicle from our dealership.
Thank you for your concern and help in resolving this issue with Mr***.

As President Owner of Carville's Auto Mart I am responding to ID# ***As is often the case, persons who write complaint letters often tell only one side of the issue, or worse, misrepresent the facts. Certainly "Bait and Switch" is unfair and in certain cases illegal and is not
permitted at Carville'sThe Challenger in question (along with several other vehicles) was offered on line as an internet special from January 9th thru January 24th with a special price reduction from $25,to $23,(our actual cost is $23,410)The Challenger is currently back on line at $25,NADA retail value is $27,700.00, Kelley Blue book value is $27,The allegation that the vehicle was advertised for months on websites for $23,is absolutely false. On January 17th Carville's negioated at deal with the ***'s at $23,for the Challenger and $16,for their Toyota Scion based on final inspection of their trade vehicle which was not at the dealership. Here is the real issueThe ***'s did not disclose that their trade had major hail damage which apparently they tried to hide by covering the hood, roof and trunk with carbon fiberThen tried to tell Carville's it was a special package from Toyota which it was notLater they admitted to *** *** (manager) they had been paid different times from the insurance company for hail damageThe Challenger was offered to ***'s at the sale price of $23,without their trade but they refused the offer and yet they are questioning the integrity and practices of Carville's?? We do like doing business with persons who have a willingness to lie or misrepresent facts and then try to defame our business in doing soIt is Carville's Auto Mart employees that should receive an apology from the ***'s for Carville's wasted time and effortIn addition to their attempts to pass off their hail damage Toyota thru deceit blaming Carville's for their inability to make a deal. I will not debate all the items Mrs*** continues to bring up and certainly do not accept them all as true or revelentShe purchased an year old vehicle and my original response addressed the issues she brought up in her original complaintIt appears her and Mr*** (ID***) are friends in Aspen so I would like wise recommend that she seek legal advice if our offer of assistance is not acceptable

I am rejecting this response because: The allegations made are completely and I find it reprehensible that Carville Auto implies I was dishonest I stand by my original statement and refute just about every line of their reply below:MESSAGE FROM BUSINESS: As President Owner of Carville's Auto Mart I am responding to ID# ***As is often the case, persons who write complaint letters often tell only one side of the issue, or worse, misrepresent the facts Everything I stated was absolutely true and in no way a misrepresentation of factCertainly "Bait and Switch" is unfair and in certain cases illegal and is not permitted at Carville'sThe Challenger in question (along with several other vehicles) was offered on line as an internet special from January 9th thru January 24th with a special price reduction from $25,to $23,(our actual cost is $23,410)The Challenger is currently back on line at $25,NADA retail value is $27,700.00, Kelley Blue book value is $27,The allegation that the vehicle was advertised for months on websites for $23,is absolutely false My original statement was the vehicle was advertised on three web pages for $23,- it was, I have hard copies of the advertisements I stated originally that the vehicle had been advertised on *** *** for months - which it was, again, I have hard copies of the advertisements that show the number of days it was listed on *** *** I NEVER said the price was $23,for six months - in fact, I noted that the price had continue to drop over the course of timeOn January 17th Carville's negioated at deal with the ***'s at $23,for the Challenger and $16,for their Toyota Scion based on final inspection of their trade vehicle which was not at the dealership Not true, there was NO negotiated deal There was an ADVERTISED price of $23,500, the trade value of the Toyota Scion was to be determined upon inspectionI did submit photos to *** *** days before we visited the dealership Here is the real issueThe ***'s did not disclose that their trade had major hail damage which apparently they tried to hide by covering the hood, roof and trunk with carbon fiber The issue of hail damage was NEVER hid, in fact - photos were submitted prior to arrival. Then tried to tell Carville's it was a special package from Toyota which it was not NOT true, we explained that we purchased the vehicle, new, from *** Toyota in *** with the Carbon Fiber Hood - which we did as *** Toyota opted to repair their hail damage with a replacement hood. Later they admitted to *** *** (manager) they had been paid different times from the insurance company for hail damageAbsolutely NOT TRUE - We explained to *** *** we filed ONE claim, (I can provide proof as I have ONE claim with my insurance company) and repaired the hail with additional carbon fiber parts - the roof panel and the trunk deck.The Challenger was offered to ***'s at the sale price of $23,without their trade but they refused the offer and yet they are questioning the integrity and practices of Carville's?? NOT exactly true - while the dealership said they would sell US the vehicle for $23,they insisted we were getting a discount We were not, it WAS in fact, the advertised price However; when we questioned and complained it WAS bait and switch - the price on line suddenly changed - on all three web pages - that very afternoon Again, I have copies of the advertisementsWe do like doing business with persons who have a willingness to lie or misrepresent facts and then try to defame our business in doing soI am completely offended and demand an apology I did NOT lie nor misrepresent any facts I actually bought a very similar Challengera newer Challenger with less miles for $23,just three days later at *** *** *** in *** ** They inspected the Toyota Scion and we agreed on a trade value of $15,They acknowledge the hail damage, did not deem it "major" however; valued the damage at about $- right in line with Kelly Blue Book trade in valuesIt is Carville's Auto Mart employees that should receive an apology from the ***'s for Carville's wasted time and effort Nonsense! I placed a $deposit on a vehicle, placed my trade in vehicle on a trailer and drove miles from *** Co to Grand Junction with good intentions of buying the Challenger for the price advertised We would have purchased the vehicle had we only been treated with a little bit of respect In addition to their attempts to pass off their hail damage Toyota thru deceit blaming Carville's for their inability to make a dealNever did I try to pass off hail damage The pictures submitted to Carville days in advance clearly displayed the carbon fiber replacement parts The additional damage (that occurred after the carbon fiber roof and trunk were replaced) was not even noticeable in the photographs *** *** Jeep deemed the remaining hail damage could be repaired via paintless dent repair for about $1000.00 Lastly, there were several ADVERTISED (and to note -STILL advertised) vehicle options that do NOT exist The ad clearly states: *** Premium Floor Mats w/Logo the floor mats in the vehicle were NOT *** logo mats The ad also states *** Car Cover however; there was not a car cover in the trunk of the vehicle The tires ON the vehicle were below 2/of remaining tread, the right front tire had a wear bar showing - barely legal We asked for an allowance to purchase new tires, we were told, "there are plenty of challengers on the lot, we can put another set on your car"I MUST emphasis - I DID purchase a NEWER Dodge Challenger just three days later I paid LESS than Carville's advertised price I paid $23,for a (years newer) Challenger - Hemi, VAutomatic - I was also given $15,for my Toyota Scion trade and told the existing hail damage - was NOT major - and could be repaired for about $ The EXACT same scenario- I emailed pics of my trade to *** The carbon fiber replacement parts are clearly displayed in the photos I was told the advertised price, I was told my trade value would be determined upon inspection. I am responding to your ID reference #*** sent on 9/15/As president and owner of Carville's Auto Mart I generally respond to customer issuesI have been out of the office on a trip since 9/and just recently received this complaint.
Since our beginning in
Carville's has done everything reasonably possible to keep our customers satisfied and happyUnfortunally that is not possible in all cases or apparently in this case.
Mrs*** is not being completely truthful in her complaint letterMrs*** came to our dealership on 5/16/and test drove and elected to purchase the 06' Mini Cooper, She requested some items to be checked and requested minor repairs on tire rims and some touch up paint, this is evidenced by the attached Repair AgreementI have also enclosed a copy of our Inspection WorksheetThe vehicle was sold "as is" and she rejected the offered Service Contract or Repair Policy
Mrs*** said she "gave us weeks to complete the work they agreed to"The truth is she put down a $deposit and asked Carville's to do the agreed repairs and hold the car for her for months while she was out of the countyWe do not normally do this but agreed as a favor for herYou will see by the attached *** from Colorado Automotive Reconditioning Specialist that the paint and rim repairs were completed by 5/23/or days after she signed the contract and repair agreement at a cost of $Likewise the airbag light was completed at our shop prior to 5/23/14.
Stating she had to wait an additional weeks for delivery is also misleadingAfter being out of the country for an extended time she called Carville's without notice and asked for delivery to Aspen, a miles round tripWe do not make free deliveries of this nature but did so as a special favor for herA delivery of this nature is normally $Unfortunately the truck pulling the delivery trailer developed an oil leak which left a small number of specks of oil on her carI spoke with our delivery person who stated that he offered to take the car to a car wash to remove the oil spots and Mrs*** said "not to worry about it" because it was not his fault.
I spoke with *** ***, her salesperson, who said he answered calls from her friend, ***, concerning the car and even ordered a car cover for Mrs*** at her requestWe do not lie to our customers and I cannot respond to her accusation of lies without specificsWe also do not sell vehicles with rotted tiresI personally drove this car for weeks in April and it is a safe, fun car to driveShe also gave no specifics about the $she said she spent to make the car safeI am requesting copies of the invoices in order to address this statement.
If Mrs*** will bring the vehicle back to Grand Junction I will replace the front tires she is concerned about, clean any oil residue from the car, and have Colorado Reconditioning redo any faulty work on the paintShe was told this by *** *** before she filed the complaintIn closing, the outdated license plate she referred to was a temporary paper plate given as a convenience until she purchased her permanent plateThe 2D Mini Cooper is not factory equipped with a spare as there is no place to put one other than on the roof or the backseat*** was obviously unaware of thisNone the less Carville's will furnish the spare if we can obtain one or rebate $to Mrs*** on her request.
Ms*** purchased a very nice, low mileage (56,mile) car that was fully reconditionedI understand buyer remorse as I have dealt with it for over years from a small amount of customersCarville’s has performed as agreed but will further work with Mrs*** with a simple call and delivery of her vehicle to Grand JunctionCarville’s will not refund her money as a matter of company policy, long established for many years

TO THE Revdex.com,RE RUST ON MY CAR
When I purchased my Jeep GC , I specifically called to ask if you had this particular model and was told you only had one such carYour comment to me about having over cars to choice from, has no baring whatsoever on this case I drove down from Aspen to see this particular car.As I circled the car I asked your salesmen "is there any rust on the car, he said no"I took him at his word ,and had no reason to view it from a liftFive months later I noticed rust spots coming thru the paint just behind the right back door.l took the car to a repair shop in Glenwood Springs and was told there was considerable rust under the car in this area, which was the source of the outbreak and that it would reappear even if patched,unless the main source was cut out After it was patched ,indeed ,it reappeared in four to five months,just as predicted All of this took more than one year to play outBoth the body shop and *** *** ,told me the cost to get all of the rust removed would at least $5000.00.Concequently the cost of the car should have been less than I paid by @ least $The reason you lowered the price originally was because my son-in-law pointed out the asking price was far above the blue book priceMy son-in-law & I did not know of the rust or we would never had bought the carAdditionally ,I have spent more than $on the car ,new tires ,patching, rust area twice , all which make it a wonderful car to driveHowever the rust that still exists devalues the car greatly.
In your letter to me you state that I refused a service contract which was offered me,l did in fact accept the service contract you offered me.
I do like the car, very much, and do not wish to return itI would like reinburshment or repair to eliminate the existing rust.

For the past years involving the sale over 45,vehicles Carville's has handled customer's problems in a very straightforward and honest manner going above and beyond in material and labor
repairs required by the law and/or our contract agreementsInvariably when a customer has to seek settlement from an outside source is because their requests are totally unreasonable or are outside our contractual agreement.
Mrs*** s closing statement concerning principles, morality and ethics gives you a clue of the type of person we are dealing withTo judge our business and the dedicated persons that work here by her experience with a year old vehicle is ludicrous.
Mrs*** came to our store with $1,and terrible creditShe chose the subject vehicle after a test drive and signed numerous documents concerning the "as is" condition of the vehicleShe financed a repair policy into her loan which will cover the repair of several items including the transmissionThis does not include the right to return the vehicle if a repair is requiredThis is true even on a new car.
Mrs***'s letter has many misstatements and half-truthsThe purchase price of the car was $6,not $ $8,*** *** did not say "we can do this the easy way or the hard way"As she was sitting at Mr***s desk cursing at him he said " there are ways we can approach this problem, the easy way of following our procedures or you continuing your cursing which will accomplish nothing"Mr** *** is not the owner of Carville's Auto Mart and was completely unaware of Mrs***'s car issueHe was simply calling as a favor letting her know an extra key was available for her car.
As I was writing this response l phoned *** Automotive (a repair shop that handles all Carville's major engine and transmission works for our customers)He said Mrs*** s car with a newly rebuilt transmission will likely be ready tomorrowCarville's covered the entire cost of the transmission at a retail cost of $2,on the $6,carThe same result that would have happened without all the drama and waste of everyone's time and effortCarville's handled this situation as we do all others, Her demand of a different car or her money back is completely unwarrantedObviously being the age and miles on her car she will face other maintenance and repairs as we all doIf they are not covered under her repair policy they will be her responsibility.

The car arrived with the trim over the two front fenders not attachedThere was glue all over the trimThe paint which when Mr*** Carville assured me "would be touched up by a person who is an artist and will make the paint look like brand new" was faultyInstead I had mismatched paint which was not even filled in, in the deep points.The crowning comment was when my friend, *** ***, who brought me to Carville Auto Mart, asked Mr*** Carville about the price of the carAnd his response was, "I am selling you the car for $below the blue book price," when in fact I paid, $3,over the blue book price.I am not sure what part of the dialog Mr*** Carville finds "untrue and irrelevant." In a prior letter written to the Revdex.com I was asked to send copies of my receipts for the reconditioning of the car, which I didThe manager of Big Tires wrote a note on the receipt for the tires which I purchased regarding the rotted condition of the tires that were on the carI would think that after making a hefty profit on the sale of the car to me, MrCarville's would be willing to reimburse me for what I paid to recondition the car and fix the paint along with the removal of the clear bra, I had installed on the day I picked up the car also the drivers side door which is not attached to the exteriorDoes that sound like a fair solution, as I believe that it is?All of these additional expenses were guaranteed by Mr*** Carville to have been performed before my paying for the carI suggest that MrCarville settle these unethical procedures as soon as possible, so that I may drive my car to Grand Junction for the reconditioningIn summary, MrCarville's prior letter atteted that this car was fully reconditionedIt clearly was not! I am sure that a man of your ethical standards will perform as your promised in the initial agreement. Respectfully submitted for your approval, *** ***

I will not go thru restating my position concerning his complaintCarville's position of giving him an above average trade in on a different vehicle remains the same
To set the record straight Mr*** did not buy a service contract from Carville'sIt appears he did purchase a Warranty Solutions service contract outside our agreement however no used vehicle contract I am aware of covers rust
I do not want to debate Mr*** on what a salesman told him years ago although I don't believe it was as simply as "no"Mr*** purchased a highly desirable low mileage vehicle and the market dictates the price not the Blue Book
If Mr*** is not willing to accept Carville's offer of trade I recommend he seek legal advice as to his other options
