Had a house built and it had a broke water pipe and leak inside master's bedroom closet and wanted to cancel contract and get back my $1000.00 moneyWas suppose to close on house on Feb 14, we did a walk through on Feb 14. Discovered a water leak inside the master bedroom closet want my earnest money and money from the builder [redacted] on the [redacted] and extra sq ft on the house, that I do not want because of default. Desired SettlementWant my full refund back from Casey Esrow of $1000.00 and my full refund that I paid builder [redacted] of $1360.00 from get the driveway[redacted] and extra sq ft. Business Response In response to the complaint from complainant. The builder & I met with the complainant for the purpose of building them a home. They talked to the builder about one house plan, but changed to another plan that they liked better(which was one that the builder built and they asked for the exact home except for a few changes. The builder informed them that was fine, but if any of the changes were extra then he would price it and tell them the difference in the price and the owner said that would be great and they would pay him directly for the difference. They asked for a change in the kitchen cabinets(which normally would be the darker wood) to change to white cabinets, no tub in the master bathroom, just a large shower, normally the builder would have a large soaking tub and a separate shower. They changed the driveway also. I know of 3 things for sure they asked for in mid-stream they discussed other changes w/the builder, but then they called me and said to have him build it identical to the other home, but with the above changes. In regards to closing, the buyer stayed out of town a lot w/his job, but my understanding is that the mortgage company talked to him several times about getting the money for the appraisal, so that they could get everything ready for closing and he refused to do so. He told her he wanted to make sure everything was complete on the home. She informed him it was and anything that needed to be finished that the appraiser would point that out and have to be completed before closing, but he wanted and waited until the day before to walk the property so we couldn't close the next day because the appraisal hadn't been completed but he was the on that held it up. But there was a water leak in the master bathroom which made the carpet in the master closet a little wet, which the builder had fixed the next day. We stressed to the buyer that they had a one year builders home warranty. The buyer point blank the next day informed me the house wasn't built like they way they wanted and wanted their earnest money back and nothing else. This phone call was made with witness'. I have shown the house to 3 couples. 2 of the 3 couples didn't like the cabinets, nor the fact of no tub in the master bathroom plus the driveway is different from the other driveways. I have been contacted by the buyer per email stating that he would put on the radio and newspaper that know one should do business with my firm. I sent an email back to him that I had contacted by attorney on the matter and that I didn't want to hear back from him, but from his attorney.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)He said she said situation. I have learned a valuable lesson, next time do not take any body word. The house was suppose to be center in the lot,septic tank was suppose to be on the left side of the house, trees in back suppose to be cleared out. Builder didn't wrap house before putting vinyl siding up,No down spouts on house, did not put rebar down before pouring concrete. But I know now next time I will record everything. Also my loan was suppose to be $119,900.00, and builder [redacted] was suppose to pay closing cost, but instead they charged it back to me to make my loan 124,900.00, and their answer is that is what we do. [redacted] Construction [redacted], TN XXXXX-XXXX and Casey Realtor hope they enjoy that money. Just hope everyone else who goes through them do not make the same mistakes as we did. People need to go to http://www.[redacted].com to see the realtor marks up their houses $20,000.00 more, that way they get a great profit at consumers cost. Learned a lot from this situation, never again will we make the mistake of trusting people. We are done close this case. Thank you for your valuable time and assistance.
