[redacted] with Lopek did indeed hire Top Shop Granite to install quartz countertops. On March 11, Lopek mailed a check...

to TSG's shop address, which was deposited upon receipt and subsequently was returned for Non-sufficient funds. In addition, Lopek started falling behind on payments owed to TSG. Once TSG started demanding payment for the NSF check, and for other money owed, Lopek canceled the contract. In addition, Lopek delivered a trailer to Garfield Ar for use on a project in Nebraska. The tires were in poor condition, and subesquently blew out on the trip to Nebraska. Fearing that there may be damage to the trailer, it was towed on a flatbed. Once Lopek refused to pay NSF check, and fell behind on their account,and canceled our contract in Missouri, I chose not to pay the tow and repair bill on the trailer. With regards to Insurance, TSG has maintained insurance at all times with Acuity. Their claim that we did not have insurance is a complete lie. Lopek also recruited TSG employees, and attempted to recruit others.
[redacted] claims that work was substandard is also insane. I have a copy of a punch list covering units in Springfield Missouri produced by superintendant [redacted] In this punch list, 2 seams were mentioned and were repaired prior to cancelation of the contract.
As of today, [redacted] owes TSG $4551.01. This is after an adjustment for the NSF check which finally cleared. In addtion, per Missouri statute, Lopek also owes for the balance of the canceled contract, less costs which would be approx. $16000.
The problems all began when Lopek wrote a $4000 check with Non sufficient funds.

Top Shop Granite owner [redacted] is running a scam.
1st scam: NSF Check
[redacted] very upset stating check was lost in mail, begging for money to be wired, in good faith Lopek
wired funds while [redacted] was depositing "lost" check same day, knowing Lopek wired funds.Never was this NSF check mentioned until fired 2 months later. No calls, emails, text, or certified letter. Invoice for $9411.00 was paid in full. [redacted] has bank ststements for proof of all work paid in full. [redacted] Imports has operating accounts to pay sub contractors, funds are only available what is owed that week. Having wired $9411.00 to Top Shop Granite, a additional $4000.00 would not clear. A side note: [redacted] called the next day stating the check was found at his neighbors house, trusting [redacted] we discussed he would tear up check, [redacted] scaming knowing now this was a lie/scam he had already deposited check the day before.
2nd Scam.

I was requested to drop the trailer back with [redacted] in Garfield Arkansas, which I did.
Trailer: had brand new tires/perfect condition
Trailer per his employees never went to Lincoln. Lopek has been told to pick up stolen trailer in Garfield,AR, as well as Marionville, MO.
Sheriff has been to both locations to find trailer was not at either location.
Springfield, MO Police department explained the scam was, towing company will take trailer, say they picked up in another State and charge large amounts of money to release to owner.
[redacted] at [redacted] ask me to send him $3100.00 and we could come get our trailer. Decetive in Springfield,MO told me not to send a dime.
Decetive in Springfiled, MO mentioned [redacted] did not corporate when he spoke to him.
[redacted] hired a bill collector, which he was fired by after receiving proof of lies, as well as has stated he retained a Attorney, which is not true due to non payment.
Lopek Imports stays will original settlement.

Per [redacted] employees and emails there was no towing of the trailer. The trailer has been stolen, and has not been at either location [redacted] has said it was per Sheriff Department in Garfield, AR, and Springfield, MO. [redacted]'s towing wanted me to pay $3000.00 in advance to come get trailer. Detective in Springfield has tried to contact [redacted] with no response. [redacted] paying all of towing fees with exceptions of $100 is simply another scam to collect additional [redacted] has not been contacted by Mr.Norrid since we submitted information with pictures and statements from several witnesses. I have not been contacted by anyone stating [redacted] paid false towing charges or location of trailer. Trailer was a loan with good faith from [redacted] and is considered stolen property by [redacted] until returned to Dallas, Texas by [redacted] in same condition as he received it. Original resolution stands. [redacted] Imports has the right to terminate any sub contractor preforming such bad, horrible, sub standard work being done at any of their job sites. [redacted] takes pride in workmanship and expects no less from a subcontractor. This is why we have been importing and supplying for over 18 years with repeat business from all General Contractors we have done business with. [redacted] will not tolerate a sub contractor/installer that does not take pride or have any care for their work or employees.

Once again [redacted] is going on with her lies. I have indeed retained Attorney [redacted] XXX-XXX-XXXX regarding this issue. I went and paid all except $100 of the tow bill against the trailer. She needs to get her trailer before they start adding on storage again. If Lopek would like to pay the amount due of $4551.01, I will release Lopek and Aspen of all claims. Otherwise, I intend to file suit to pursue the amount due, plus attorney fees, and damages for wrongful termination of the contract.
