Under the provisions of the Fair Credit Reporting Act, this business is not adhering to the collections portion if that law. I was called and told if I did not respond they would call all my references.Desired SettlementBusiness needs to be contacted and their collections practices should be cleaned up.Business Response Thank you for the opportunity to review this matter. When a customer misses a payment, we attempt to contact our customers regularly to stay up to date on their situation. Our goal is to keep the customer's account current so their loan doesn't go into default or past the maturity date. If we cannot reach a customer or have trouble contacting them, we will call the numbers in their application to seek updated location information only. If the complainant wishes us to not call his references, we would be happy to update his contact preferences.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)This is the first that I am hearing if I request they not call my references, they would abide by this. This is a predatory lender and will do anything to collect their debt.Final Business Response As stated previously, we only contact references when we have difficulty reaching the customer, and that contact is only for updated location information. This is expressly stated on the loan application signed by the customer. We value our customer's loyalty to CASH 1 and we apologize if our message regarding contacting other number provided was perceived as the threat. That was not our intention. Our goal is to remain in contact and prevent their account from going into default. Understanding that contact of references is a concern for our customer, we have removed all references from our customer's account. We appreciate the opportunity to respond to his concerns and we welcome a call from our customer if he feels this matter is not resolved to his satisfaction.

I have never pulled a payday loan before until May 22, 2015. I borrowed $500 from Cash1. I was able to make a couple of the payments, but then I defaulted on the loan. It went to Cash1's collection agency. I spoke to a women named [redacted] and I told her that my bank account had been hacked into and I wouldn't be able to make any payments until I got a new debit card. The bank had told me that it would arrive 5-7 business days. She originally gave me until Friday, July 31, 2015 and I told her I wasn't 100% sure that the card would have arrived by then. I called her on Friday and told her the card had not arrived and that I had called the bank and they thought it would for sure arrive either Monday or Tuesday of Aug. 3rd or 4th. I asked if there was any way she would be able to push back the date until then. She absolutely refused to do so and threatened that they would run my SSN and contact my employer and try to garnish my wages. That is board line harassment and she violated the FDCRA. I have already filed a complaint with the Federal government and the Arizona Attorney General's office. This is not right for them to do. When I am trying to make the payment, but do to a problem that was completely out of my control she is not willing to work with me.Product_Or_Service: payday loanDesired SettlementI want to make the company aware that this is how someone who is a customer gets treated when trying to resolve an issue by paying, but do to circumstances out of my control not able to fix right away and this is the answers I get and the refusal to try and help is not right. Also for making threats like she did, this company should drop my loan all together. My husband [redacted] has given authorization for anyone to speak to me about this situation. When this loan was taken out we had to provide his pay stubs showing to date that he gets paid and how frequently. It showed that he gets paid twice a month the 5th and the 20th for awhile the payments came out correctly, then it just went from twice a month at $161.78 to $80.89. I called and could not get anyone to explain to me why this happened, but was told it would be correctly and I was given a credit of $100 for the mistake.In the mean time the payments also started to come out of my checking account anytime the business or your system wanted it to. For instance the March payment came out 3/1 which caused our account to over draft, which has never been his check date. February's payment came out 2/8 and January's payment came out 1/4. See the pattern for whatever reason the payments are coming out on the wrong dates and since that occurred this loan has gone on longer than it would of. Per [redacted] in the mesa office if the payments were taken out as they should of and twice a month we we of been done December 20,2015. Helena the district manager talked to me and assured me that I was not over paying on this loan and that is not true. I would of been done and not had to pay all the interest assessed if the account was fixed. Now it has not prolonged the loan and we still owe. Helena gave a credit for $36 for our overdraft fee, but for some strange reason she applied to the loan we have with cash 1 instead of giving it back so that I could pay my bank fees, finally I got the cash credit back. She advise us to bring his check stubs again so that it is fixed in the system once and for all, so I did. One 3/8/16 I was called from the office saying that my account is 3 days past due. I just gave them the information again and instead of making sure I didn't get any calls. I have been waiting for her to call me back since 3/8 to figure out why we got a call and what is going to be done to settleDesired SettlementI would like to get the account zero'd out and discontinue business with cash one at this time, because I have paid interest that I would not have and been done with this loan 3 months ago if anybody at the office would of cared or had customer service and looked into or fixed the problem along time ago. I have asked for the corporate office number or contact person several times and was told that the company policy is not to give it out. I applied and was approved for a [redacted] payday loan via the cash1loans.com website. The documentation was completed, signed, and submitted and the form stated I had been approved for $400 that would be deposited the next business day pending my phone call for verification. I called in to verify, and was informed that the company no longer lends to the state of [redacted] by a worker in customer service named [redacted]. I explained that my loan had been approved and was agreed upon and she just kept repeating the statement that they no longer provide services in my state as of the new year. I asked for verification of what she was saying from a supervisor. She stated her supervisor, named [redacted], was not in yet but that she would "pass along my concerns." Becoming concerned that this is not a legitimate operating business, I also requested verification from her supervisor in writing that all of my personal information would be deleted from their system due to the false loan application process they put online for [redacted]. Our state regulators require certain information/disclosures which are contained on those pages. We have however indicated on those pages that we are no longer accepting new applications.We believe that we've complied with all requests and consider this matter to be fully resolved in accordance with the customer's requests."

Contract paid in full and overpaid, Cash 1 refuses to release my vehicle and refund.. If this doesn't resolve my issue I will file in small claims.My name is [redacted], I opened a loan with Cash 1 at the [redacted] location in [redacted] on a 2003 Chevy Cavalier. I had payments of 87.00 every two weeks deducted from my payroll sent to Cash 1's checking account ending in 56. I sent a total of 52 payments totaling $3654.00 on a 1000.00 loan. I have copies of my pay stubs proving this. I have attempted to resolve several times and the clerks are clueless. I have throat cancer and cannot speak so they got frustrated with me and told me to leave which is a violation of the disabilities act. I was told my account was in collections and NOT accruing interest any longer. One year later, ZER contact and loan has doubled.I originally took this loan out in October or November of 2013 for a few hundred bucks. I paid on it for two years. Then I was in a car accident and my car was totaled. I called them to see if they wanted it because they had been threatening repossession due to non-payment for the previous and current month. The legal department said they didn't want a totaled car just my money and there would be action without money. I specifically asked if the current status of the loan meant it was not accruing interest. They said it was not because it was in collections. I said I would call to set up a payment plan when I can afford it as I did not even have money to get a new car, I was riding the bus. Now I am gainfully employed, called to make good on this loan and was told not only was the person I spoke to previously wrong but my loan had gone from $3,000 and change to almost $7,500!! On an original loan of like $300.l that I've already paid thousands of dollars on. I repeated the conversation I had had previously and added that in the year I had defaulted I received NOT ONE SINGLE piece of paperwork in the mail. Renee stated they don't have to send me mail, they have record of voicemails they left me. Unfortunately, with all the telemarketers in this day and age I NEVER answer calls from 800 numbers and I NEVER listen to their voicemails either. I realize it's 2016 but some people don't like handling business and bills over the phone. Renee was unbelievably rude when I explained that I don't think it's right that they gave me such incredibly misleading information. I asked if there was any way I could settle for way less than that amount and they said they would take like $3,600 in TWO payments. I don't know what kind of people they think are getting title loans but I don't make that much money! I asked if we could settle in 5-6 or maybe 7 payments and they said NO. I offered to pay $400-500 a month to just settle this loan and they won't even budge. At this point my only other option is to file bankruptcy as I can not afford to be paying on this title loan for the rest of my life!! Which at this point is what I feel like I'm going to be doing due to their horrible communication policies and business practices. Desired SettlementI would like to settle the account and pay it off. In March of 2014 I made arrangements with [redacted] an employee of Cash 1 to agree to a payment plan agreement to pay off the amount of debt we agreed with that I would pay. On March 26 I signed paper work with him stating that I would make six $50.00 payments with them and my debt would be settled. Now [redacted] is no longer with the company for whatever reason and they are trying to say after I have made the agreed upon payments that I still owe them. They have taken another payment from my card that I did not owe. I am presently and have been unemployed since Jan 29, 2014. I am not receiving unemployment or any other assistance therefore I technically and truly have no income. I had a payday loan that was due at the time of my unemployment. I made that one payment and advised them that I was unemployed and had no income to make further payment arrangements. They placed my account on hold and followed up with me weekly sometimes bi-weekly to see if the status had changed. To date nothing has changed. I'm still not receiving unemployment and have been living off the help of others to pay for basic needs such as food, utilities and mortgage. I last spoke to someone at the local store Saturday, March 22nd and advised them my financial situation had not changed. They stated in a previous conversation that they would have to forward it to corporate office if I could not pay by the next time. I said okay so I told them to go ahead and forward it because I was not able to pay. Someone called and hung up on my cellphone a couple days ago and when I called back they answered Cash 1. I felt it was too early to have the same conversation and didn't talk to them. I received a call today from the local store manager, [redacted] stating that an auto payment draft had been sent in from corporate in the amount of $230 on March 25th the day before which is the full amount due. I told her I never spoke to anyone to authorize it and I still had no income to even discuss payment arrangement. She said the notes on my account read that and said corporate should have also seen that. She asked if I wanted the phone number to corporate to talk to them. I did not take it at first and then later called back to get it. I called corporate and spoke to the manager, [redacted]. She said they have authority and right to take the payment because of the initial agreement I signed when I took out the loan. I told her that because of my financial situation a payment arrangement and agreement was in order. She repeated it. They seemed to disconnect from reality with people struggling or down and out. The manager [redacted] said she knows first hand that they make payment arrangement with customers however in my case nothing was even attempted to be made. I would like the money credited back to my account and a payment arrangement made when I have some source of income to make it. Which is the ethical and humanly thing to do. Business Response While the amount withdrawn from [redacted]'s account was contractually owing, we understand she is enduring a hardship. We have spoken to [redacted] and have made arrangements for her to receive the withdrawn amount back, so she can use those funds to cover her mortgage payment, as originally intended. We have also had preliminary discussions regarding a repayment plan, allowing her to satisfy her balance with small monthly payments.
