We are in receipt of the customer’s Revdex.com complaint regarding her GreatPlains Finance ,LLC dba Cash Advance Now account and have reviewed her concerns carefully in an attempt to resolve this matter
The central drive of Ms***’s
concerns seems to be that her Cash Advance Now loan terms were inconsistent with the laws of her home state. But state law does not apply to her Cash Advance Now loan in any manner. As clearly indicated on our website and expressly and clearly provided in the loan documents executed by the customer Cash Advance Now (the “Company”) is a wholly owned and operated entity of the Fort Belknap Indian Community (the “Tribe”) located on the Fort Belknap Reservation of Montana (the “Reservation”) and the loan agreement provides for the application of FtBelknap Tribal law. The consumer signed loan agreement is entirely consistent with applicable law.
The Company is wholly owned by the Tribe, was established for the Tribe’s economic benefit, and is organized under and operates pursuant to Tribal law. As an economic arm of the Tribe, the Company is not subject to State enforcement actions described in the customer’s inquiry
The Tribe is a federally-recognized Indian tribe and a sovereign nation, as expressly recognized under federal law. See FedReg4748, (Jan29, 2014). Cash Advance Now, conducts its business under all applicable Federal laws and Tribal lawsFurthermore, we can attest that our Tribal lending business does not engage in excessive or abusive collection practicesRather, we are proud of our strong customer service record. We diligently work with our customers to resolve any inquiries and issues that have been brought to our attention in a timely manner
Although Ms***’s loan is entirely legal under applicable law, the concerns expressed in her complaint caused us to further review her accountAfter examining her account we note that the customer has never contacted us regarding her payment method after 5/10/16, the inception of her loanFurthermore, to date she has made a partial repayment of the loan based on the terms and conditions within her consumer signed loan agreementStill, as a goodwill gesture we will agree to accept and apply all payments made to date toward the principal loan amount, waiving all remaining finance loan fees, and now regard Ms***’s account as paid in full.
