RE: Case # [redacted]
Cash Country of Sikeston, Missouri received the above-referenced complaint and appreciates the opportunity to respond. The complainant, Ms. [redacted], is not our customer. Rather, she is our customer's daughter, and has been authorized by our customer, Mr. [redacted] to make payments and discuss account details with the office staff. Therefore, we respond to this complaint as follows.
Ms. [redacted] complains that the title loan created on July 11th, 2015 accrued improper interest, that the receipts issued did not reflect correct information, and takes issue with the terms of default for the agreement. Please be assured that Cash Country takes pride in providing the best possible short-term loan experience to our customers and makes every effort to assist our customers in their time of need.
This particular account was discussed in depth on several occasions with both Ms. [redacted] as well as her father, Mr. [redacted] At the time of the first payment on the loan, Ms. [redacted] attempted to make a payment that would cover three months' installments in advance; however, this is a simple interest loan requiring monthly installment payments. Any money received in excess of the minimum payment is applied to the principal balance. Partial pre-payment does not advance the due date beyond the next scheduled payment.
Ms. [redacted] is correct. There is no prepayment penalty. In fact, pre-payment is encouraged because it reduces the principal balance more quickly, thereby reducing the amount of interest paid over time (making the loan substantially more affordable). To operate as Ms. [redacted] suggests (to apply a payment toward future debt) would make early principal reduction impossible and would force the customer to pay more interest over time. We believe applying payments as Ms. [redacted] suggests would be a disservice to our customers. We do not charge interest (a portion of the monthly installment amount) which has not accrued yet. Any overpayment therefore must be applied to the principal balance, not to future obligations.
Pre-payment and interest accrual were discussed with Ms. [redacted] and our customer on more than one occasion. Unfortunately, Ms. [redacted] found herself "in between jobs" and was unable to continue making her installment payments. The office staff worked with Ms. [redacted] and Mr. [redacted] to the best of their abilities, within the scope of the contract, and followed all applicable company and state policies. When verbal "promises to pay" were broken and after Mr. [redacted] notified us that he would not be paying us any more money, the vehicle was assigned for repossession.
Ms. [redacted] also made reference to receipts being issued that did not reflect accurate information. All receipts that were issued did in fact reflect accurate information. The amount shown at the bottom of all receipts issued reflects the remaining principal balance on the account. The receipts do not reflect current or future interest.
We made every effort to work with Ms. [redacted] and Mr. [redacted] to resolve this account and did not repossess the vehicle until it was months past due and became aware that payment would not be forthcoming. A lawful repossession was affected on January 13, 2016. Thereafter, Ms. [redacted] unlawfully took possession of the vehicle and the local authorities required her return the vehicle to avoid criminal prosecution.
Once again, customer complaints and concerns are of utmost importance, and never treated lightly. We have endeavored to satisfy our customer and his daughter and have operated in full compliance with all applicable laws. We again appreciate the opportunity to respond to the customer filed complaint. Please feel free to contact me directly at (XXX) XXX-XXXX if you have any additional questions or concerns regarding this matter.
