contractual agreement to lease aproperty in Portland, TX and the lease expires on October 31, 2015. She entered into thisagreement with the owner/Landlord. Cass Real Estate Rental is the Property Ma ngementCompany obtained by Landlord to manage this property and Ms. [redacted] is the Realtor for thisbusiness. At a later date, around the Christmas holidays, Ms_ Hands reported to Ms. [redacted], shehad married arid that her husband, [redacted] J. [redacted], would be residing on the property.It was then an application was requested by Ms. [redacted] for Mr. [redacted] to fill out and sign.The marriage was reported after he moved in. Our office ran his application, as per office policyand the owner/Landlord approved him as an occupant. A marriage license was not provided.In response to the complaints from the now, Mrs. [redacted], we will address it asbest we can.1.There is no retaliation from our company towards the tenant.2. All repairs reported in writing by the tenant were completed in accordance with paragraph18-B of the Texas Association of Realtors Residential Lease form TAR-200' which was initial andsigned by [redacted] Hands.8. A remedy was available and offered to the tenant under paragraph 18-B, same as above, buttenant declined.4. It is "normal practice" that our office policy is to verify all military,orders provided to ouroffice and/or Landlord from any tenant as per the Texas Association of Realtors ResidentialLease Application form TAR-2003 signed by then Ms. Hands, as well as [redacted] J. [redacted]on page 4 Authorization to Release Information Related to a Residential Lease Application. Thiscontradicts Mrs. [redacted]` statement that, Cass Real Estate Rental violating the Freedomof Information Act. Which by the way, The Freedom of Information Act (FOIA) is a law thatgives you the right to access information from the federal government. It is often described asthe law that keeps citizens in the know about their government. (See attached). Therefore, wedid not violate (FOIA).5. Mrs. [redacted] preception of Maria [redacted] discriminating againt military families isincorrect and here again her perception. Ms, [redacted] has 8 brothers that four served in the USArmy, Navy and Air Force. They served during the Cold War, Gulf War and The War inAfghanistan. She appreciates what ALL military service men, women and their families sacrifice10/08/2015 10:17 ;~ [redacted]CASS PEAL ESTATE PAGE 04/10on a daily basis for our freedom.6. The itemization was completed and signed on September 18 as indicated by the tenant butwas not mailed out. The security deposit was mailed, register mail return receipt, to theforwarding address provided by the tenant via text. If she has not received it, we need to followup with the U.S. Postal Service arid reissue another check. By the way, the property was left inexcellent condition. Nothing needed to be done to get it to marketing status.7. As per the lease, Paragraph 28 Early Termination, signed by then [redacted] Hands, the militaryclause is for, and I quote:If Tenant is or becomes a servicemember or a dependant of a servicemember, Tenant mayterminate this lease by delivering to Landlord a written notice of termination and a copy of anappropriate government document providing evidence of: (a) entrance to military service: (b)military orders for a permanent change of station (PCS); or (c) military orders to deploy with amilitary unit for not less than 90 days. Termination is effective on the 30th day after the firstdate on which the next rental payment is due after the date on which the notice is delivered92.017, Property Code governs the rights and obligations of the parties under this paragraph.No such orders were provided! Therefore, it does not fall under the military clause for earlytermination, paragraph 28A (1).Please refer to our emails attached, to and from [redacted], CIV US Army HRC, that reflectthe orders provided to our office were not authentic. [redacted] words not ours, and they do notfall into any of the categories a, b or c of the Military Clause.8. The itemization date of move out was a typolI hope this clears any misinterrpretation that may have been received by the tenant on thelease she signed.In resolution, the Owner did return the security deposit in the amount of $1.350.00. Cass RealEstate Rental is a management company. We represent the Owner and are directed by theOwner. Cass Real Estate Rental does not make any decisions to withhold1 deny, forward, payany monies without the Owners direction to do so.if you have any other questions, concerns or need more clarification, feel free to contact ouroffice and ask for Ms. [redacted] or Mrs. [redacted] (Broker).Thank you for your time!
