Before we signed our work agreement on April ***, I provided Client with the project program outlines for my services, detailing what Client receives and how the service is rendered through each phase of our projectWe spoke on the phone on April ***, where I provided Client with a walk-through
and discussion of the services rendered within each phase of our project, ensuring Client understood the work we would complete during each of those phases, and what was needed from both of us in order to complete each phase of the projectI invited Client to ask any and all questions that would ensure Client understood the project program and our work agreement, specifically ensuring Client understood that while design is commonly regarded only as a deliverable at the end of a large project like this one, it’s more integrally a process and a service; and one which we actively engage in from our project start date onward.Our work agreement plainly states that Client is hiring me to design Client’s business entity, and design and develop Client’s website for the estimated total price of $3700, as outlined in our previous correspondence, within which I provided the project outline to Client in PDF form, in step-by-step interactive map form, and on the phone as we walked through each phase of the project togetherOur work agreement states our projected payment schedule, including an estimate of Client's final payment, which is $1480, and also states that this invoice is to be paid upon project completion, which is usually to weeks from the start of a projectOur work agreement does not, however, explicitly state any firm date project or deliverable schedules.In our work agreement, Client agreed to "give me everything we need to complete the project as and when and in the format we need it”, and to do so in a timely mannerI was not provided with website copy compositions, and as such, it was impossible for me to complete the page layout phase of our project together, as outlined in our project program and previous correspondence, though I did produce as much work as I possibly could without receipt of Client's copy: I designed and delivered Client's logomark and business entity branding, I designed and delivered Client's digitally-rendered service experiences and the technology implementations they require, I developed and delivered Client's customized Wordpress CMS administration dashboard, within which I integrated the selected technologies, installed plugins to support Client's service functionality requirements, installed easily-accessible tools and resources for the administration and gen eration of Client's services, and designed and developed Client's branded administration dashboard.Throughout this project, I was understanding, patient and accommodating of the time Client needed to complete my requests for information and the essential documents and prompts for many steps in our project:On May ***, I requested information from ClientOn May ***, Client asked for the request again, and on May ***, Client stated they needed more time to fulfill the requestOn May *** Client stated they needed more time to fulfill the request because a section was difficult, and so I happily created a new format for this request in document formWe agreed to discuss the form and goals of this document together on a call, and on June ***, we met for two hours on a call to do soAt the end of this call I requested the responses to this document so that we could move forward to the next phase of our project.On June ***, I again requested responses for this document, needing them to prepare for our next scheduled call, to move forward in the projectA day before our scheduled call, Client asked for more time to complete this request, and I explained that I required lead time in receiving Client's responses, to properly prepare for our next callWe agreed to a new call date and time, which was canceled by Client minutes before we were scheduled to begin.On June ***, I requested responses to the document once more, explaining it was needed for us to move forward on our next call, and again on June ***, requesting at least hours with Client's responses to the document to properly prepare before the callClient delivered responses on the ***, and we scheduled and had our call on June ***During this call, Client notified me that they would be unavailable from end of July through the month of AugustThis was the first time I was notified of this delayDuring this call I requested additional information, so we could complete as much work as possible before Client was unavailable for the month of August.We scheduled our next call for July ***, to give Client adequate time to fulfill my requestsOn July ***, Client asked me to re-send the requests for information, and on July ***, our scheduled call did not happen because Client did not show, and gave no notice whatsoever that they would not be able to make the call.I understood, and we rescheduled our call for the ***, during which we worked through content form and function together, and designed solutions for better technology implementationsAt the end of the call, I informed Client I would continue developing our administration system to accommodate and integrate those pieces of technologyAfter this call Client became unavailable, agreeing to get back in touch at the end of August to continue our work.On September ***, Client notified me they were back online and that their business plans and services had changedOn September ***, I informed Client that I would be available on September *** to address these changesOn the *** Client requested a time change for this call, which I was happy to accommodateDuring our call, we determined the breadth of adjustments and re-calibrations we would need to make to accommodate new business plansAt the end of this call, I requested information from Client as necessitated by Client's new business direction and services.On September *** I requested this information again, and provided a specific outline within that email of the information I still needed in order to move forwardOn October ***, Client provided some but not all of the information requestedWe scheduled a call for October ***, during which we examined Client's information, assessed all the new moving parts, and re-calibrated technology integrations and service functionality requirementsAt the end of this call, I offered to work intensively on designing experience solutions and deliver them to Client as quickly as I possibly could, so that we could condense the time needed to move the project forward, in lieu of Client's changed business plans.We then scheduled another call for October ***, to work through experience design solutions I produced, which I delivered to Client as quickly as possible on October ***, and to tailor these solutions to the needs of Client's new business plansOn this call, we successfully worked through these solutions and developed strategy for moving this larger project forward effectivelyI requested content and copy from Client, so that I could then create the accompanying images and render page layout.On November ***, Client ask to reschedule our planned call due to a last minute scheduling conflict Client was experiencingI understood and agreed, offering a frame of availability for November 9th, and when asked, Client confirmed our original production and publication plans, in which Client would deliver all copywriting compositions to me, and after receipt of Client's compositions, I would create and deliver all accompanying graphics for these compositions, after which I would then lay out pages, as outlined in our work agreement, project outline, and previous correspondence.Client requested to move our call again to November *** or ***I understood, and offered to schedule the call on the ***I did not receive a response from Client confirming a call, and so I contacted Client on the *** offering to re-schedule the callWithout receiving any copy compositions from Client, I attempted to contact Client again on November ***In response, I received an auto-responder stating that Client would be unavailable for two weeks, from November *** through the ***Client did not provide me with any advance notice of this period of unavailability.Client then contacted me on December ***, three weeks after my last request, asking to connect that weekClient did not inform me of any progress on copy compositionsAt this time, I was traveling and out of state, and contacted Client on December ***, requesting a call scheduled for the ***That call never took place, and I never received the information I requested to move our project forward.Our work agreement states that Client will have opportunities to review our work at each phase of our time together, as outlined in our project program and previous correspondenceOur work agreement also states that if at any time Client is not happy with the direction my work is taking, Client will pay me in full for everything I've produced until that point and cancel the contractI provided service and produced work to the best of my ability, with great care taken to accommodate Client’s needs and changing schedule, up to and including all possible production, identity design, experience design and development as outlined in our work agreement, project outline and previous correspondenceI have been appropriately compensated by Client for everything I have produced up until now, and as such, our project has come to a close
