Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below The statements made by business are inaccurate I was not told that additional excavation would be required The installation cost should have been $ This is the amount written on the bill of sale for the actual pool & was confirmed by this business, prior to my completion of the pool purchase After business came to my property & looked at my backyard, we mutually agreed that the pool would be better However, I was told by business that if I purchased the pool, he would not need to dig into the slope This did not occur Business did in fact dig into the slopeOnce business started digging, he then decided that he would need to rent a machine This was not discussed with me and when I asked crew member if this would be additional cost to me, I was adamantly told it would not be Nothing was ever mentioned to me about the additional $for each inches I only saw installer time prior to installation day and he diid not make me aware of it either time or give me anything in writing to that effect Only after installation was complete, he required $ I was never given any receipt for the cash paid I was not made aware of the significant amount of dirt and rocks that would be left in my yard due to excavation Had I been made aware of this and the substantial cost to remove it, I would have reconsidered the pool purchase or would have had provisions in place for removal I was not told it would require tools and machinery to remove it I had to hire another business to remove the YARDS of dirt and rocks.This also ruined the grass in my entire yard from where the piles were left, which needed to be re-seededAlso, because this business dug into slope, I was forced to have a retaining wall built around the pool to protect itA retaining wall was NEVER mentioned to me at all by business Business also left a ft deep trench around half of my pool that had to be leveled & filled in by another company I had different contractors and landscapers advise me that the pool was unstable without a retaining wall built due to business digging too far into slope [To assist us in bringing this matter to a close, we would like to know your view on the matter.] Regards, [redacted] ***

As you can see by the pictures the pool was installed properly The pool was never in jeopardy of collapse or being washed away The pool is perfectly level The customer and her mother were told they could back fill the dirt when the pool was full of water They were told on several occasions that there was going to be a lot of dirt and that I do not take the dirt A retaining wall was not necessary but a nice idea Some customers get retaining walls when pools are over inches out of level, but most choose to just back fill the dirt that was removed from pool area Customers choice There pool was feet out of level The reasoning for the small machine is the area could not be dug by hand We initially began digging by hand, but under the top soil was concrete, brick, blacktop, large stones, and other tough materials that made it impossible to dig by hand So I rented a small dingo, to help get area dug I did not charge the customer anything extra for the dingo rental I ate that cost We had agreed on 800, which is my round price plus for the extra digging This was agreed on months prior to the installation date

I absolutely did need a retaining wall, and had several opinions from professionals confirming this

The customer would have paid more than the $450 if they went with a 21 round pool. The consumer was told on multiple occasions that the install would require additional excavation. When installing a pool the company covers the first 6 inches of excavation, any additional excavation is completed at a cost of $200 for each additional 6 inches of dirt for the leveling of the ground to prepare for the pool install. The consumer was concerned about the additional cost for excavating for the pool so the business agreed to do the additional excavation for the cost of $450.00, consumer was advised that there would be a lot of dirt. Consumer was further told the company does not remove the excavate dirt from location. Area was excavated and 18 round pool was installed.  Consumer was unhappy about the dirt but she was made aware of such on a number of occasions. Consumer chose where to have the filter placed, later determined that isn't the best spot she contact the business and ask that he move it which he did at no additional charge. Typically there would have been a $125.00 service charge, which would have been charged for the re-position of the filter, however the business did not charge the consumer for re-position the filter. There was no written contract on this job.  Pool was installed per verbal agreement.

I was not told that additional excavation would be required.  The installation cost should have been $800.  This is the amount written on the bill of sale for the actual pool & was confirmed by this business, prior to my completion of the pool purchase.  After business came to my property & looked at my backyard, we mutually agreed that the 18 pool would be better.  However, I was told by business that if I purchased the 18 pool, he would not need to dig into the slope.  This did not occur.  Business did in fact dig into the slope. Once business started digging, he then decided that he would need to rent a machine.  This was not discussed with me and when I asked crew member if this would be additional cost to me, I was adamantly told it would not be.  Nothing was ever mentioned to me about the additional $200 for each 6 inches.  I only saw installer 1 time prior to installation day and he diid not make me aware of it either time or give me anything in writing to that effect.   Only after installation was complete, he required $1250.  I was never given any receipt for the cash paid. 2.  I was not made aware of the significant amount of dirt and rocks that would be left in my yard due to excavation.  Had I been made aware of this and the substantial cost to remove it, I would have reconsidered the pool purchase or would have had provisions in place for removal.   I was not told it would require tools and machinery to remove it.  I had to hire another business to remove the 20 YARDS of dirt and rocks.This also ruined the grass in my entire yard from where the piles were left, which needed to be re-seeded. Also, because this business dug into slope, I was forced to have a retaining wall built around the pool to protect it. A retaining wall was NEVER mentioned to me at all by business.   Business also left a 3 ft deep trench around half of my pool that had to be leveled & filled in by another company.  I had 5 different contractors and landscapers advise me that the pool was unstable without a retaining wall built due to business digging too far into slope.
