Complaint: ***
Upon initially signing the lease agreement on 24SEP2016, we
informed the only Castle Club employee assisting us (*** *** ***) that we
were most likely going to terminate our lease early, and specifically asked for
details regarding the policy for early termination. At that time, he directed our attention to
the Special Provisions addendum attached to the back of the lease agreement
document stating that should the lease not be fulfilled to term, the lessee is
to repay any on boarding concessions and forfeit the security deposit paid prior
to moving in. Our question was very
clear, as was the answer provided to us by Castle Club Apartments, which was in
accordance with the addendum we signed.
The contents of this addendum do not agree with Castle Club’s statement
that lessees are not provided with the right to early termination. To be more specific, the signed lease agreement
states that tenants should refer to the business’ (Castle Club) policy for
terminating the lease early. As
previously stated, we were told that this policy appears on the signed Special
Provisions addendum to the lease agreement We'd also like to add that the lease agreement we signed on 24SEPwas not signed by the property manager at the time we signed, and we never received a copy of our lease agreement signed by both parties
Alas, the addendum stated that our security deposit would be
forfeited, whereas we were informed by Castle Club via e-mail that it would be
returned pending no damages to the property.
It was our understanding that the security deposit is to cover any
damages, but we were still told to pay $on top of that upon early move-out. It is extremely misleading and suspicious that
there exists an elusive “company policy” which cannot be revealed to tenants. Concerned and feeling as though we were being
taken advantage of, we requested to review an official copy of this company
policy on many occasions, but were refused.
For that reason, we informed Castle Club that we were unwilling to pay X
amount of money because that was the “company policy” for that day. Information regarding early termination and any
associated penalty charges should be very public to tenants, documented
elsewhere if not clearly stated in the lease agreement, and should also be
accompanied with a valid effective date.
If this is not the case, logical tenants will ask questions and demand tangible
answers
In totality, our experience with Castle Club Apartments has
been immensely stressful and unpleasant.
We can honestly attest that we sincerely regret ever becoming involved
with Castle Club, a place we initially thought was our “saving grace” during a
trying time in our lives. Castle Club’s arbitrary policies are unjust and lack business ethics We would never recommend to anyone signing a
lease with them We are still waiting to be provided with the above-mentioned early termination written company policy for verification

covers the period of 9/24/through and including 9/30/The issues regarding *** ***'s occupancy and/or her requests for early termination of the lease are covered by her written Lease Agreement, Her obligation to pay rent runs through September 30, per the Lease Agreement and pursuant to real property lawFurther, the Lease Agreement does NOT provide *** *** with a right to early termination of the Lease Agreement; to the extent she wishes to terminate the Lease, this termination is at the sole discretion of the Landlord, on whatever terms the Landlord determines appropriate to compensate the Landlord for the lost rent and the additional expenses associated with early termination of the Lease.I trust this provides an adequate explanation of Landlord's position on this issue-which is governed by a written instrument and hundreds of years of real property law, if you need further information, please contact me.Very truly yours,Mitchell R
