In short, this breeder has NO CREDIBLE VERIFIABLE EVIDENCE OR DOCUMENTATION by a trained & licensed professional veterinarian that our dog [redacted] was not “well cared for” at any timeThe defendant physically accepted the dog twice for two successful litters without objectionIf [redacted] was ever “not well cared for” to the extent of violating our Agreement as she now claims, then why did this breeder not take IMMEDIATE action to Take the animal to a veterinarian to treat the animal Document the alleged problem (vet exam & diagnosis, photos, etc.) and Why did she not IMMEDIATELY notify us of the alleged breach so we had the opportunity to verify the claim and, if necessary, get a second vet exam/opinion? SHE DIDN’T, SHE COULDN’T and now SHE CAN’T because IT NEVER HAPPENED! The Defendant also does not address the TWO COMPLETE FULLY-DOCUMENTED ANNUAL PHYSICAL EXAMINATIONS that gave [redacted] a and healthy result each time The first annual exam was given performed by HER veterinarian in the spring of at Pearson Animal Hospital and the second complete physical exam by our veterinarian at the Surfside Animal Hospital in May of - just weeks prior to the defendant’s abductionThese legal vet records - and if necessary their professional testimony - will fully document the perfectly physical condition and well being of [redacted] Regular grooming, nails, ears, eyes, teeth, weight, bathing, feeding, exercise and training all took place as requiredAll of which were checked every year by a licensed veterinarian When unable to produce evidence to justify her abduction, this self-proclaimed “breeder” she has responded with undocumented wild claims, blatantly statements and citing conversations that never happened - in a desperate attempt to somehow justify the outright theft of our dogThe defendant has never once stepped foot in my home and, ***ly, claims of issues at home are so ludicrous we found them laughable In my opinion, the defendant’s Foster Family Agreement” is an intentional consumer scam and potential criminal fraudHere is how it worksShe finds families to “foster” breeding dogs so that she does not have the significant costs of boarding them and still takes in a $deposit which pays for the dog upfrontShe then get to breed the dog repeatedly and keep all the future puppies (3-per litter) which can be sold for approximately $eachIt was only after the second successful and healthy litter – when she was required to transfer ownership of the dog to us – did she then abducts the animal and claims the foster family did not care for itWhile previously enjoying two litters (seven puppies or $17,500) to sell, she now is further enriched by keeping the AKC pure-bred dog ($2500), refusing to refund the remaining deposit ($1400) and can even keep a third future litter to sell (3-pups at $each) THIS FOSTER FAMILY HAS LOST ITS DOG AND IS OUT FOURTEEN THOUSAND DOLLARS IN RELATED COSTS Either the defendant fully and completely compensates us for all of our losses - as detailed in our original complaint - caused by her wrongful breach resulting from her abduction of our dog [redacted] - or we formally request binding arbitration/mediationIf all alternate attempts to resolve this dispute fail, we will file a lawsuit.Regards, [redacted]

I, *** ***, from Castle Creek Cavaliers, placed *** with *** ** as a Foster Breeder (via Foster Breeder Program contract) on 3/12/with the understanding that I would remain Owner of *** until the
terms of the contract agreement were met
My priority is to find caring adopters for my dogs to ensure their well-beingMy observations led me to see that *** was not well cared for as needed by contract
*** was months old when she left here; she had had five (5) months of training with *** ***, and *** was his favorite Castle Creek dog*** passed Canine Good Citizen training, so all the plaintiff (hereafter *** ** needed to do is learn what the dog did*** was and still is one of the first dogs to greet people here, never a barker, and is very loving and affectionate*** * mentioned that *** was doing well with her kids at school, but was still having problems with a male in the household, I believe her husband*** was afraid of him and barked at himLater, *** ** mentioned on 3/26/that he would yell at *** and at times was abusiveShe mentioned that he did not want ***, and they had many arguments over *** ** promised me that *** would be going with her to work at her school and not be kept with him during the days
*** has had ear infections continuously for over 2years, which has been painful for *** is now deaf, and has been gaining harmful weight; is 5-6lbsheavier than when she was placed with *** ** Her weight has been a concern, is very unhealthy and hard on her heart, thus is a threat to her lifeI have mentioned and even warned *** ** several times that if *** was not cared properly, healthfully, I would find another home for her
On the evening 5/20/*** ** and her daughter dropped off *** at my placeI noticed her hair was matted, On the next day while getting her ready to be groomed, the groomer noticed that her ears were badly infected and matted; her nails were not cut, were overgrown and curled, digging into her pawsI have four witnesses and picturesI called *** ** in tears and informed her I was feeling sick that I had trusted her and had given her several chances to properly care for ***I added that this time I will not entrust *** to her due to the observed insufficient care which was abusive to ***There were several breaches of our contract, as listed below

5/23/Dog groomer came here in the morning and worked on *** to groom her in preparation to have her pups (shave her belly)Her nails were uncut, were curled all the way around and digging into her paw, and one claw was embedded into her leg*** ** was called and informed of what the groomer and I saw, and was told I was going to keep her this time*** deserved better care and love
#Owner shall be solely responsible for all expenses relating to breeding, pregnancy and whelping, including related testing, examsFoster Family shall make the Dog accessible to Owner for these purposes, providing transportation as needed
*** **, through email, confirmed the eye-clinic day and time she would be able to have her companion take *** to the eye clinic; however, he never showed up
#Foster Family will turn over the Dog to Owner upon request, for purposes for breeding and for whelpingThe Dog shall stay for approximately up to a week at Owner's discretion for breedingDog shall stay with Owner for approximately one week before expected whelp date until the litter is approximately 8-weeks old; exact dates to be determined by Owner in accordance with what Owner deems best for the Dog and her puppies

It was a routine and common issue in floppy-eared animals that does not indicate the animal was not well cared for - just needs a simple treatment to address a routine condition
Children routinely get ear infections which a doctor clear up with simple ear drops too - but parents are not stripped of their children by Child Protective Services for not adequately caring for the well-being their child! It is ludicrous and outrageous for an ignorant breeder to claim a dog owner should be held to higher standards than the parent of a childWhile this breeder may believe in her own mind she knows more than a Licensed Veterinarian practicing in an established and reputable animal hospital, no objective judge or jury would ever agree
This breeder has proven herself to me to be unscrupulous, unethical, unprofessional, vindictive, threatening, untruthful and willing to say or do anything to justify her wrongful Breach of ContractRight from day one, she gave us a dog that was significantly hearing impaired, lied and misrepresented the fact that she was not the breederShe, in fact was forced to admit she purchased the dog wholesale from another party who may have sold her because of the hearing impairmentShe initially denied that the dog was hard of hearing then, later when if became obvious, blamed us for causing the deafness!

Presence of a painful ear infection left untreated for years is grounds for breach of contract. [redacted] scratching her ears in pain and not taking her to a vet for exam and treatment is abuse and cruel.
Yes Cavaliers are prone to ear infections but weekly checking and treating when you see they are dirty will eliminate a painful ear infection. Infections left untreated will cause deafness. Treatment is not just flushing with a cleaner. If after cleaning ear brown dirt immediately comes back you must go to vet to examine. Vet may want a culture done to see if it a bacterial or yeast infection and perscription med's will be given. Vet may need to sedate and clean out debris way down below your are able to reach or may be too painful for dog. Med's are used and Vet usually wants to rechecks until gone. [redacted] came here with bad ear infection and after one week of me treating them her infection is totally gone and has not had one come back since. She is no longer scratching and matting them up and hair has grown back.
The contract we both signed states:

All of the above were not done: This is a breach of contract

Ears were always dirty and infected each time I saw them. [redacted] never took [redacted] to her Vet for her ear infections for over 2 ½ years, never had culture done for her persistent ear infections, nor med's prescribed and given by her Vet. The only time [redacted] went to her Vet was two months before she dropped [redacted] off here to have her pups per my request. That was over 2 years [redacted] had to endure the pain of ear infections until she finally went deaf.
[redacted]'s nails were so long they were curled and poking into her paws and dew claw was sticking into her leg, was causing pain to walk.
There were more than one breach of contract, but seeing that [redacted] had been abused, was more than I could bare, for [redacted]'s sake I felt she needed to be where she was loved and cared for and not abused. I called [redacted] the day after [redacted] dropped off [redacted] and noticed [redacted]'s nails sticking into [redacted], told her I was very upset and asked her to call me later. [redacted] never called me back nor tried to contact me for 6 months , only contact was a email asking for money.
An ear infection can be caused by several factors and are not solely caused by a "dirty" ear. The date these photos were taken - even of what dog - is unsubstantiated and witnessed by a licensed veterinarian. They could have been taken anytime since we turn over the dog last summer. [redacted] HAD EAR INFECTION 5/20/14 When [redacted] dropped her off to have her first litter. I showed [redacted] that [redacted] still had her ear infection and matted ears. I told her I would clean and treat them and charge her for med's, invoice was given for $45 is proof [redacted] had an ear infection.
[redacted] HAD EAR INFECTION 9/21/14 I have testimonials from [redacted] CGC instructor (Revdex.com was sent) & two students in [redacted]'s CGC class.
[redacted] HAD EAR INFECTION 3/26/15 When [redacted] was brought here to be bred. [redacted] was shown and was instructed she must take [redacted] to Vet to help her get rid of it.
[redacted] had ear infection 5/20/15 when [redacted] was dropped off here by [redacted] to have her pups. That night I saw ear infection and next day I took a picture of [redacted] standing and laying on table and her infected ears. My helper was witness, she also is witness I called [redacted], s held [redacted] while I was talking.

Please show me a copy of [redacted]'s comprehensive physical exam. I was told by the vet tech just a ear exam was done. It is hard to believe the Vet doing a full exam would not notice that [redacted] was way over weight and nails curled and pressing into her paws. Did a Vet ever do a culture to see what kind of infection [redacted] had? I was also told by vet tech that [redacted] was to bring [redacted] back for rechecks, which were never done.

I feel that that would be a total waste of time. What do I have? A dog that is deaf, over weight, I have had 3 people come to see her and did not want her due to her deafness. She is very sweet and loving to both men and women but they fear her handicap.
[redacted] dropped [redacted] off here in a rush with her daughter crying, looking back it was because she had no intent in picking her back up. There has been no concern to check to see how [redacted] is doing, no desire to pick her up. I did not abduct [redacted], [redacted] told me [redacted] did not want [redacted] and was verbally abusive to [redacted] and they were constantly arguing about it. Please show proof that [redacted] ever requested to see [redacted], wanted her or requested to pick her up in the last 9 months
[redacted] had the option at any time to return her at 60% of what was still due to her $1,300, that would have been $780. Due to the condition [redacted] was in when she was dropped off I feel nothing is owed due to the abuse and permanently damaging this dog. [redacted] has been here now 9 months, the costs of her care has been much more than the $780. [redacted] $ value is zero now. She will need to be spayed and teeth cleaned ($450). She eventually will be place in a loving home.
If this goes to civil court there will be a compensation for the damages [redacted] and [redacted] has caused to [redacted], myself and my business.
It is clear this backyard puppy mill breeder has no intention of compensating me for the blatant and outright abduction of our AKC Registered Cavalier King Charles Spaniel and outright criminal theft of our cash deposit. Failure to accept binding arbitration will result in the immediate filing of a civil lawsuit in San Diego Municipal Court.[redacted]
