I have reviewed the offer and/or response made by the business in reference to complaint ID 10671095, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[redacted] I have never received a refund from other contractors.  When I have had an issue with a prior contractor, not only did they return to fix the problem, but they did so at no charge.  If he said he charged $65 for each additional hour, then why did he tell me $75 and take my check for $150.  I'm glad that other customers have been satisfied with his work, but this job was not done properly.  I never said the tile was on paper; what I stated was that he glued the newspaper he laid down to protect my countertop on the back of the tile.  It is clearly visible when you look at the tile in question.  If my recollection of events is proven correct by the text messages I receive from my cell phone provider, I will present that information and pursue this matter in small claims court.  Again, I have never had to sue nor have I ever received a refund for other services.  It is very, very sad that this provider continues to misrepresent himself and the events which transpired.  We all reap what we sow.  When, where, and how is not revealed to us, but it does occur.  I thought because of his demeanor that we could resolve this amicably, but I was mistaken.  I did not contract an honest, decent, upstanding individual.  Instead, I contracted with a dishonest, manipulative, non-integral individual and for that I am very saddened.

In response to the complaint that was filed by Justina Copeland to the Revdex.com as well as Angie’s List.
 
“I sent him a copy of the back splash (approximately 11.5 feet of space) I wanted installed and several pictures. Before arriving, the provider was sure he could install backsplash tile (1.5 to 2.0 hours) AND remove and install a ceiling fan (1.0 to 1.5 hours).” 
 
She was told repeatedly that the backsplash would take longer than 4 hours and that the grouting would have to be done on the next day.  She also repeatedly stated that she needed a ceiling fan replacement, nail pops, and other jobs to be completed.  I told her from the onset what could be completed within four hours and that my hourly rate after the four hours would be $65. 
“He would then have to review additional work we needed done in the home.  He arrived on time and courteous. He took several phone calls while he was working which was an issue since taking these calls was interrupting the time he should have been working.”
 
Upon my arrival, she complained about every contractor that had performed work in her home stating some of the same things she has stated here.  Throughout the time I was there (approximately 6 hours) I did receive two emergency phone calls from my wife informing me that my 10 year old daughter was being rush to the emergency room in respiratory distress and the second call that she was being admitted to Pediatric Intensive Care Unit (I have the documentation to prove this fact) and that she was hospitalized until June 10).  During that call I stopped for approximately 5 minutes no more than 10 minutes but I worked for an extra 2 hours.
 
“About an hour into the job, I told him the tile wasn't level, as you could clearly see it was not in a straight line.  He stated it was the wall, but even if that was the case, the tile is not evenly spaced.  After about an hour, I mentioned again that the line was not straight.  He took out his level and admitted that he could make an adjustment, but that there was not much else he could do.  I pointed out that the spacing was also not even; he had no response for that.  He kept working.  Close to noon, when his time was almost up, I pointed out that he had left three big empty spaces untiled.  I also pointed out how crooked and uneven the tile cuts were.  He stated, "I guess I should have had a wet saw to cut the tiles."  The tile cuts are visibly crooked and uneven; the spacing between the tiles is completely uneven and inconsistent; there is paper protruding from the bottom of three tiles where he did not remove the backing; he does not do the outlets, meaning he doesn't have the longer screws so the outlets can extend outward in order for the covers to be replaced.  He said he could return the next day, at a cost of $75/hour to grout.  I told the provider that I was extremely unhappy with the job he had done and his response was "I wish there was something I could do to help you feel better."
 
This portion is completely untrue. 
1.     The tiles come on a mesh backing.  There is no paper on the back.  By being on a mesh backing the tile is evenly spaced and level.
2.     I never stated "I guess I should have had a wet saw to cut the tiles." 
3.     The paper she is referring to is the newspaper I taped down to protect her countertops.
4.     The outlets are pulled forward after grouting (24 hour curing time for the paste to dry) and I have the long screws in my possession.
5.     I also never said, "I wish there was something I could do to help you feel better."
Below are the pictures I took as a customary practice on every job that I perform.
 
This customer has been untruthful. I believe this customer has a track record of complaining about contractors and getting unjust refunds for work performed.  Within two hours into the job she had told me about two previous contractors she had gotten refunds from and then started to nitpick everything I had done to that point.  My intentions were to return the next day complete the grouting and handle the ceiling fan which she understood prior to my arrival could not be done within the 4 hour Big Deal Special.  You can call my past customers and they too would find this customer’s story completely out of character for who she describes as me.
Attached are my ratings from my past [redacted] Customers are attached.  I pride myself on being an honest man with honest dealings.  I worked more than the allotted 4 hours as well as two extra hours – but in my opinion she never intended on my completing the work.

We were taken advantage of by this provider. In all, we've lost $670 ($400 labor; $260 materials) and still do not have the ceiling fan installed.Desired Settlement: N/A
