Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
[redacted] is entitled to no more than the $2,500 he invoiced me for consulting.  He did not deliver what was expected of him.  Non-performance warrants at minimum a $5,280 refund.  In addition, he asked for a NDA from me.  In retrospect, the person who should be asking for an NDA is me.  I'm the one with the intellectual property.  As a paying customer, any discussions shared between myself and [redacted] contractually belong to me.  I informed [redacted] that I would consider allowing him to act as a territorial sales representative once I am able to resolve the mass production challenge that [redacted] promised to develop but failed in all respects.  I offered him a chance to settle today for a discounted rate of $4,800 if the check is mailed with a postmark date of 3/20/15.  He responded that he would like have this matter settled by next week - which I take as a solid refusal of acceptance.  I look forward to a peaceful resolution but if that outcome cannot be reached, it is my civic duty to seek an open and comprehensive disclosure of the full facts and circumstances of Mr. [redacted]'s actions.  I will have more evidence against [redacted] in the coming days as I learn more about his wrongdoings with myself and other individuals with whom he is currently providing a consulting "service" to in the sporting goods industry.  He should not be allowed to operate with impunity.

Thank you for your time today. In terms of taking take of [redacted], here is what I am willing to do As [redacted] had agreed on before, I will pay him $3480 on the following terms. 1. A signed non-discourser2. That he will not use any of my contacts moving forward3. Statement that we are 100% finished and done working on this project4. List of everyone he has contacted to slander my name, plus the content – emails and such5. An apology to my wife and myself for the viral language, verbal and written abuseIf this not agreeable than I will retain a lawyer and sue him for his false and slanderous actions. Thank you,[redacted]

[redacted] project in terms of setting up manufacturing and product. I was very clear that it would take a great deal of time, effort and cost. Over the course of when we first talked I have put far more time and resources than he has paid for. The reason I did not [redacted] for that time is because we agreed that I would receive 7% of the company earnings once it hit the market. [redacted] received vital information on the market, where he should target sales, production options and much more. This advice and knowledge was shared with the trust that I would benefit from the 7%, for if that agreement was not in place I would have charged him at least $15,000 for my time and information shared. I can say with all certainty that [redacted] would never had found a US manufacture or a market plan to sell to the educational market without me. Over the time spend on the this project I contacted a great number of people and programs, sharing some of that knowledge with [redacted] however never did I say we have a deal with one group or the another. I did ask and received a set amount of funds (that had a cap on it ) which I told [redacted] would be used for tooling or would roll into first product orders. This is needed to get factory’s to work with your without a huge amount of upfront cash. I am also looking after [redacted] best interest in saving him a great deal of cash to manufacture this product. It is very common to spend over $60,000 to get a product to market. [redacted] will tell you he has nothing in the manufacturing side and his retail sales target would have been a disaster. His patent is weak and any company could pop out a copy-cat product. [redacted] had no idea about the private label market, why made in USA is so important and also the OEM ability to make this product for other companies – all this came from me alone, of which I need to paid for. There is no scam here and I really like the product (and [redacted]), the shuttle concept has a market. If [redacted] wants $5280 back I will agree, however I need to paid for my time and knowledge. There also must be a NDC signed and I want the ability to finish production with a percentage of the company. I like [redacted] and understand his concerns, would like to continue working with him under a formal agreement.  Thank you,[redacted]
