Although we are sorry to hear that a customer was unsatisfied with our customer service, we believe that her complaint regarding our
lack of posting Prop Warnings is meritlessAs shown in the attached pictures, every Cathy Jean store was directed by corporate office to place a posting in highly visible areasThese areas are:
1. Affixed to the storefront window near the entrance, where customers can see the warning prior to entering the store2. At the first wall on the customer’s left when walking into the storeIt is placed clearly next to the merchandise at a level that is viewable by customers3. At the first wall on the customer's right when walking into the storeIt is placed clearly next to the merchandise at a level that is viewable by customers4. At the cash desk, as the customer has already statedIt is placed directly under our pole display that tells the customer their total, as well as next to our refund/exchange policy
We have been more than diligent in making sure we are compliant with the Prop LawIn addition to these postings in the store, every shoe box in our stockroom has the warning clearly printed on the box lid, where a customer would see it as she was trying on shoes, and it is also printed on the bottom of each receipt that prints out

I just recently sent a complaint to you about the Comfort Suites at Westgate Mall Spartanburg SC. It seems that there's a policy between booking.com and Comfort Suites that has to do with a no refundable policy. It was in the email sent to me but further down I did not read that part it's kind of...

like fine print. But nevertheless booking.com and Comfort Suites are blaming each other. they are refunding me after jumping through many hoops. Thank you for your help

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and although I do not find it satisfactory, I do not wish for you to waste anymore of your valuable time communicating with this business.  I wish I took photographs of the store the day I made my purchase.  I did not see a sign at the store's front window. It either wasn't there when I walked into the store, or it wasn't big enough to attract attention. The signs that are supposedly located at the front and on the walls should be larger. All the prop 65 signs should be as large as the "70% off" signs that are at the front which attracted my attention in the first place. This is my first purchase at Cathy Jean and it will certainly be my last. Thank you, Revdex.com, for taking my complaint seriously. At the very least, this experience has made me more careful. I now look for Prop 65 signs at all the stores I go to.
Regards,
[redacted]

Review: For the primary nature of my complaint, I chose Customer service failed to provide assistance. I am directing this to the customer service representative who replied to the email I sent Cathy Jean. I am also referencing the store's failure to place the Prop 65 sign in a more visible place for customers to see.

The warning sign for Prop 65 was placed next to the cash register. It is no where else in the store. So customers do not see the Prop 65 signs until after they have already purchased their items, and it is too late to change their minds because everything in the store is on sale, and there are no refunds on sale items. The sign for Prop 65 should be placed near the items so customers can see it while they shop, not after they have already paid for their items. I saw the sale signs clearly at the front of the store. But I did not see any Prop 65 signs near the front or around the merchandise. When I went to the front to pay, and I gave the sales person my card, she told me as she was swiping my card already that there were no refunds. And there was the little Prop 65 sign near the register. I only saw it after she had swiped my card and told me there were no refunds. The sales person was nice and polite. I am not complaining about how she treated me. But I am complaining about the visibility of the Prop 65 sign and about how I was not aware of Prop 65 or about the no refunds policy until after I already paid for the shoes.Desired Settlement: I would like a refund because had I seen the Prop 65 sign before I made the purchase, I would never have bought the shoes in the first place. The sign should have been visible around the store. I have seen that sign in other stores. For example, in [redacted] I saw the Prop 65 sign once near the purses. It was actually right there next to the merchandise. Cathy Jean should make the Prop 65 signs visible to customers while they are shopping. Signs should be located by the actual shoes, at least one sign on each side of the store. I asked for a refund via email, but I was denied. The customer service representative who replied to my email said that the signs were just a precaution and were nothing to worry about. However, when I see signs warning about cancer and birth defects, I find it difficult not to worry about using Cathy Jean shoes, nor would I want to give those shoes to someone else to use. Cathy Jean should make their Prop 65 signs and their No Refunds policy clearly visible.

Response:

Although we are sorry to hear that a customer was unsatisfied with our customer service, we believe that her complaint regarding our lack of posting Prop 65 Warnings is meritless. As shown in the attached pictures, every Cathy Jean store was directed by corporate office to place a posting in 4 highly visible areas. These areas are:

Review: I purchased 2 pairs of boots that have been labeled on the lid of the box and receipt, "This product contains chemicals known to the state of California to cause cancer, or birth defects or other reproductive harm." At no point was this warning made visible to me. The sales associate had the box in her possession at all times until after I purchased the boots. Even at the register, she had the boxes on the floor, out of my sight, while ringing me up and put them in a bag immediately. After I returned home and removed the boxes out of the bag, I noticed the warning label. I found the receipt, which was placed in the bag, and I noticed the warning on the receipt as well. Had this been disclosed to me before my purchase, I would not have purchased them. I called and the assistant manager told me my sale was final. I told her that I never had an opportunity to know of the health warning label and she still replied that I could not be refunded. Thinking back at the whole purchase, I feel as if they were hiding the disclosure. Disclosures of these sorts should be made visible to the customer before purchasing an item that is nonrefundable. These boxes were NEVER in my hands until I made the purchase. The label was well hidden.Desired Settlement: This business should provide full disclosure to their products. Finding it on the receipt and on the box lid that was never visible to me is unacceptable.
