Review: We dined at CAVA yesterday night with a party of 5. After several things went wrong we noticed we had a 20% gratuity added on our check. Our waiter [redacted] didn't even tell us that he had added it. We asked about it and were told we had to pay it. It was not documented on the menu or anywhere in the establishment that a 20% tip would be added on parties 5 of more. This "tip" equated into over 60.00 Working in the food service business you have to have it noted that gratuity would be added and 20% is unheard off..When the Credit card reciept were recieved the total that was charged was shown not tip showed up blank. So unless you caught it before hand you would have double tipped the waiter. Very bad sneaky business.Desired Settlement: I am requesting a refund of our Gratuity. We were miss lead during dinner were served cold food. Had plates shattered around us and debris landed in our purses and shoes with no acknowledgement. The waiter [redacted] was rude and augmentative. The State of Connecticut defines The nature of gratuities: Gratuities (more commonly known as "tips") are defined as a voluntary monetary contribution received by the employee directly from a guest, patron, or customer for service rendered. Notice that this definition says that in order for a payment from a customer to be considered as a tip, the employer cannot exert any control over it.

To whom it may concern,
The following accusations on Cava are false. In our past five years in business we have never forced any guests to pay gratuity on a table if a manager is notified. Our staff is trained to inform gratuity is included when bringing the credit card slip to the guest just incase the guest did not see it on there itemized check. On the day of October 22, 2013 no manger was notified of any complaints on service or cold food by any guest. Also no manager was notified of any dispute of paying gratuity. By signing a credit card slip the guest is agreeing to the charges that have made to their itemized check and at this point we can not refund any charges once it has been signed. After looking up this transaction [redacted]'s credit card was charged $70 and the remaining $310 was split with the other 4 guests in different increments. We do sincerely apologize that we did not meet your expectations and do wish that we could of resolved any issues on the day that the event took place.
