Review: The car is not gorgeous but more to the point, as stated by every person at the LA’s most respected independent Ferrari service center who saw the car, trained professionals, the car needs a restoration! It clearly does not give the impression of a "well cared for" Ferrari. The car is NOT legal for use in California! On the contrary, it will probably take another $2,000 to $3,000 to make it California emissions legal again. The interior is not "nicely RENEWED" as any person knowledgeable with Ferrari will attest. The seats are the wrong pattern, color and material. The door panels are completely wrong. The door locks are wrong. The rear shelf and window surround and roof panel are all wrongly finished and in terrible condition. The red carpet is tattered and worn. The dash aluminum anodizing is ruined. This Ferrari was anything but well cared for. The wrong interior with cheap materials, the abysmal paintwork, etc. The Business failed to disclose in its advertisement that it needs a $6,000 service! I have taken dozens of photos that substantiate the vehicle’s dilapidated condition. Even the rear bumper needs to be replaced! It was apparently hit in the middle and is severely bent! Upon seeing the vehicle’s condition I wrote “void” on the sales forms and handed the keys back to [redacted] then re-loaded the Ferrari and left.

Even their employee who delivered the vehicle, “[redacted],” stated he was an ASE certified body and paint professional and that the car had lots of serious issues and things wrong with it. ([redacted] was the only honest person I have dealt with from this business!)

Now the business has the car and nearly $30,000 of my money and they are refusing to return my money!Desired Settlement: Refund my money.

The customer was fully aware of all the issues he is complaining about. It was fully disclosed in the listing that the car, although certified by the California Bureau of Automotive Repair for use in the State, is not currently compliant with emissions test regulations. There were over 25 detailed pictures of the car in the listing. The car was fully available for inspection, but the customer declined the opportunity to inspect it. This disclosure was in the listing:

"This vehicle is being sold as is, where is with no warranty, expressed

written or implied. The seller shall not be responsible for the correct

description, authenticity, genuineness, or defects herein, and makes no

warranty in connection therewith. No allowance or set aside will be made

on account of any incorrectness, imperfection, defect or damage. Any

descriptions or representations are for identification purposes only and

are not to be construed as a warranty of any type. It is the

responsibility of the buyer to have thoroughly inspected the vehicle,

and to have satisfied himself or herself as to the condition and value

and to bid based upon that judgement solely. The seller shall and will

make every reasonable effort to disclose any known defects associated

with this vehicle at the buyer's request prior to the close of sale.

Seller assumes no responsibility for any repairs regardless of any oral

statements about the vehicle."

The customer tried to have the car delivered in California while in full awareness of the requirement that the car was sold for out of State use only, using a fraudulent out of State address in an effort to avoid the California sales taxes, license fees, and emissions requirements. When informed that he needed to transport the car out of State, he began to make specious claims regarding the condition of the car in an effort to illegally rescind the transaction.

This is purely a case of buyer's remorse. The customer is attempting to slander Cavallo Motorsports to cover up his own deceitful and illegal actions. Cavallo Motorsports has acted fully in compliance with California law, as well as the rules each seller and bidder on ebay contractually agree to by using ebay's site.
