The [redacted] brothers moved into our community in April of During their stay of months in our community, the electricity in their apartment was shut off for non-payment on four different occasionsThey were notified each time that non-payment of the electricity was a breach of their lease contract with Cave Mill Apartments and if it was not turned back on, they would be faced with evictionInstead of evicting them, the company decided to non-renew their lease when the year was up so that the eviction would not affect their recordIn the beginning, I tried to help them by giving them grocery money and even paying their electric bill two month in a row, out of my own pocketBut each month, they didn't pay, the electricity was disconnectedOther residents also helped them on several occasions, but nothing ever changed They were given a non-renewal notice to vacate on March 19, with a vacate date of April 30, They held over for three days in the apartment causing us to have to push back a move in for a new resident coming inWhen they finally left the apartment three days later and a walk through was completed, the apartment carpet was damaged from a pet, the urine smell took our breath awayThey had not cleaned anything in the apartmentThe countertops were so discolored from the lack of cleaning and the small knife scratches that it will have to be replacedThe apartment was brand new when they took possession in April 2013, we had just opened the property so any and all damages assessed, were caused by the vacating residents, [redacted] *** The lack of electricity does not alleviate the responsibility of taking care of the apartmentWe have no control over the electricity, and repeatedly explained to them to contact the electric company if they have questions or concerns about the bills [redacted] was very vulgar in the office, repeatedly shouting obscenities in front of residents, as well as staff membersHe continually harassed my office staff even knocking on the door of my home early one morning to yell obscenities at me in front of my children [redacted] [redacted] broke into the clubhouse after hours on more than one occasion because he wanted to use the business center and we were closedThese offenses could warrant an arrest, but instead of causing more problems, we decided to non—renew their lease and gave them plenty of notice [redacted] is very disrespectful and always blamed the staff for their problemsWhen their electricity was shutoff repeatedly, they practically moved into our clubhouseThey were on our business center computers for hours and by doing so, no one else in the community had the chance to use themThey repeatedly brought their dog into the clubhouse even after they were told to stop and when they were confronted by it, [redacted] became irate and yelled at the staffThey came into the clubhouse to use our refrigerator and microwave for every meal because they didn’t have electricityThey asked me to use an extension cord and pull power from another unit because they couldn't afford the electricity l repeatedly told them that I would let them out of their lease with no penalty so they could find something cheaper and wouldn’t have to struggle so much each month but they never gave notice to vacate and just continued to default on the contract l have filled out rental verifications for them since their departure and l have never stated anything but the truthThey did pay their rent on time, but they were non-renewed because of other defaults in their lease and they left owing us over $in rent (for the three days they heldover) and damages to the apartment, a full paint, a full (heavy) clean, as well as a final water bill and the cost of the electricity reconnectionThe security deposit of $was put towards their final balance dueThe pet fee of $was listed as a non—refundable fee and is not used towards damages upon move out Although we had grounds for a legal eviction, we never pursued that avenue and only non-renewed their lease, which we have every legal right to do when a resident is in constant default of their agreementWe did not “throw them out"They continually defaulted on their lease agreement and they were asked to move out with a proper legal notice Thank you for your time Regards, [redacted] Property Manager

Instead of evicting them, the company decided to non-renew their lease when the year was up so that the eviction would not affect their record. They did pay their rent on time, but they were non-renewed because of other defaults in their lease and they left owing us over $700 in rent (for the three days they heldover) and damages to the apartment, a full paint, a full (heavy) clean, as well as a final water bill and the cost of the electricity reconnection. The security deposit of $250 was put towards their final balance due. The pet fee of $300 was listed as a non—refundable fee and is not used towards damages upon move out.
Although we had grounds for a legal eviction, we never pursued that avenue and only non-renewed their lease, which we have every legal right to do when a resident is in constant default of their agreement. We did not “throw them out". They continually defaulted on their lease agreement and they were asked to move out with a proper legal notice.
