Builder Pushing Buyers to the Limit To Keep People's Deposits-
This review was posted on Google. The worst builder in Florida. This company are like the scammers out there. They will keep your deposit. They do not care about the people buying their homes they only care about the money. Watch out. Worst experience of my life. A zero rating is what I give them.

This response is from the builder: Dear Claudia - We wish that your experience could be different, and we worked with you every step of the process to help you meet closing requirements. Once your finances are in order, we will still be here to build for you and fulfill you with a new home.

Reply: My finances are in order and they were always in order. You knew the mortgage details and still decided to push the sale earlier. And you knew what you were doing. All your responses to cover up what you did doesn’t cover it. It is crystal clear what you did and on top of that you act as if it’s okay and normal. And that’s because you got used to keeping people's deposits. And that will stop. You shouldn’t be in business.

And then you offer to build a home for us? Asking me for an additional deposit to buy another house? You should be ashamed!

How can you sleep at night doing what you do? Narcissistic and gaslighters is what you are.

Shady unethical practices
First and foremost, every person you will deal with is a liar. They only want your money. Quality is horrible. No one there can retain anything to memory which is good for when you file suit against them. The sales people are not licensed realtors so they do not have to work in an ethical manner. They deliberately play games with the buyer making you accumulate thousands in damages. It's funny because innocent people do not hire attorneys only the guilty.

Been told that most of issues are normal/expected. Broken floor tiles, leaking windows, a/c ducts improperly installed. I've replaced a/c unit once
Leaking Windows that lead to mold. A/c ducts pinched in attic due to poor installation per contractor I hired to inspect. 15% of tiles broken/cracked and grout failing. I've had to replace the brand new a/c unit within first three years. I was just quoted 18000 to fix all a/c issues due to poor install by company that ccdevco hired. Water leaks on side of house were addressed once by ccdevco but still leaking.

Desired Outcome

All I wish if for quality repairs for things that I expected to be right when I signed over 420,000 to mortgage this home. Simple. No more no less.

Mr. closed almost 5 years ago. A/C duct work was done according to the mechanical engineers specifications and was inspected and passed by a Collier County Mechanical Inspector. All A/C units are under a one year warranty, but they also come with an extended warranty of 10 years on certain parts, as long as the homeowner registers the A/C unit with the manufacturer once they take possession of the home. The home was serviced on many occasions replacing damaged tiles as well as roof tiles, including after the home took a direct hit from a hurricane.

What engineers may have approved but inspectors did not properly do their jobs! The installers are at fault although engineers planned well. Leaking windows are due to poor install as well. There is no caulk behind windows. They must have been put in dry! There are plenty of home owners that are complaining! It's only a matter of time before we go to the local news with pictures and proof! Floor tile are also a big concern of many owners as well. Poor installation and poor inspections

Our previous response details how we have done everything we can for the consumer but the consumer remains unhappy.

Subpar water valves and leaking around windows and door due to not properly installed. CC Devco only has a 1 year warranty on construction.
House is less than 5 years old and have had three separate water leaks. One was due to water valve in laundry room, one to leak around windows & one leak around door.
Laundry room leak caused over $6k of damage. The leaks around the door and windows has caused more than $6k of damage and possibly more cause repair is still in progress.
When I contacted CC Devco to see if any of this was covered under a warranty, all I was told from Customer Service is, "Sorry, we can't help you because your house is past the one year warranty". The house is less than 5 years old and these issues have caused over $12k worth of damages that we are aware of. The plumber who installed the faulty water valves is still plumbing for this builder.
I know of several other homes in this community that have had issues with water leakage and thousands of dollars in damage. All of this has been brought up to CC Devco but they are unwilling to help or admit that they are using substandard building materials and substandard labor crews.

Desired Outcome

Repair leaking issues and cover damage to the property; There are several other houses that are in the same community that with water leaks and damage. Would like for the company to do the right thing and repair all problems due to substandard materials and service. We pay too much money to have this amount of issues on houses that are less than 5 years old.

It has been close to 5 years since *** purchased a home from our company, we serviced the home replacing a leaky shower door and some other minor repairs. In the years that followed between mid 2016 until April 2019 required maintenance on the home was neglected by the owner and we were not contacted regarding any major construction issues. Again, it has been close to 5 years since the home was purchased as new construction.

Faulty water valves and leaking windows is not neglect on the owner. The subpar (cheaply made) water valve that was built into the home burst earlier this year and I did contact CC Devco's customer service to which they replied that the one year warranty expired so they were not responsible for the damage. Now CC Devco is denying anyone contacted them. That is not true. Other calls were made to the customer service of CC Devco when the windows started leaking and causing black mold in the house. Same reply was it is over a year and warranty is not honored. There are numerous houses here in Ave MAria with mold, leaks around windows and this is not due to neglect by the owner but rather neglect from the building crews that CC Devco hire to build these houses quickly and economically for them. The neglect by owner is just a cop out. These windows were improperly sealed and have caused major damage to my home.

Again, being 5 years old, home windows and other features are no longer covered under warranty by our business and trade partners. Please note that the neighborhood took a near direct hit from a category-4 hurricane in 2017 and at this time many homes were serviced beyond warranty in the wake of this natural disaster event. However, at this time ***'s property was not being maintained by ***. Our customer service department responds and records all communication. We receive very few complaints regarding water damage from our Ave Maria homeowners.

First and foremost, it is Mr. and not ***. Devco has not accepted any complaints of problems because every time a problem is called in, the first thing Devco's customer service says is it is not covered because it is out of warranty after one year and will create any service calls. Once again, this is substandard building with not sealing the windows correctly upon installation. This is a sorry excuse by trying to blame it on the owner as not maintaining the house. If that is the case, I wouldn't have spent over $7k of my own money fixing repairs associated with the hurricane. Devco did not do anything for me for the hurricane and I most definitely didn't want them to because it was an act of God.
Devco is using the bogus excuse that there were no complaints and the owner (Myself, Mr.) has not maintain maintenance of my house. I have the repairs and receipts to prove otherwise. Devco is trying to imply that they do not have any service calls recorded from our property because they refused to service our house due to the one-year warranty and not the inefficient materials or substandard builders.
There are numerous homeowners in this neighborhood that have water leaks, but they are getting shut down by Devco as they reply with the continuous remark as "it is over 1 year old and out of warranty".
For Devco's information, my job is to perform preventative maintenance on life saving hospital equipment. I know the importance of maintaining buildings and equipment. I find it an insult that Devco would use the bogus excuse that the homeowner did not maintain the property.
I am requesting that these issues with Devoc be submitted to mitigation due to Devco's unethical business practices. Devco should not be bullying the homeowners with bogus excuses.

Is that all that the business can say, "There is nothing else we can do for this consumer." Sadly, Devco never did anything to try to make this right. I will be sure to tell every potential buyer I see to stay away from this builder at all cost.

Request builder refund security deposit for property never purchased since moved overseas to work for DoD military-connected children on U.S. base.
Summary: In June of 2013, we provided a down payment (security deposit) on a new home in Lake Worth (Osprey Oaks subdivision). A few weeks later, I was notified of a DoD job opportunity overseas on an American military installation in Japan (teaching U.S. military and civilian dependents at a high school on base). Technically, since our circumstances changed (from primary residence to investment property), our loan should not have been approved (thus nullifying the terms of the contract. I immediately contacted the builder since it was still early in the process (early July 2013) and offered to compensate them for any monies invested (of the $22,438.28 submitted as a security deposit and permit fees, etc.). The home did not even break ground at the time of my request. After describing my situation they chose to reject my offer and retain my security deposit. My choice was either to proceed with building the home as an investment property (even though I was not going to be in the country) or forfeit my deposit. There were many unscrupulous statements made by both the builder and their mortgage lender which is co-located with them, but I will not mention those at this time. We retained the services of a realtor in order to review our options; however, it was evident we could not flip this home without a tremendous loss.
Request:
We respectfully request you contact the builder directly and ask them to return our security deposit in full based on moving out of the country and working for the DoD (as originally requested). It is a hardship for me and my family to lose our hard-earned money and the manner in which the builder handled the situation was unethical and unpatriotic. There was no legitimate reason to deny the request to terminate the contract under these circumstances. No profits were lost by the builder. In fact, the builder continued to build the home without our consent ... they didn't even notify us they were building the home. We contacted them before leaving for overseas in early August and at that time were told by the saleswoman the house was already under construction. They were intending on keeping our security deposit and building the home as a spec. home in order to maximize their profits. It was then we realized what the intentions of the builder truly were. They continued to build the house even though they considered us in breach of contract in July based on their interpretation. We felt we had no choice other than try to salvage the contract at that time. Afterwards, we found out our interest rate was going to be increased and the previously promised closing costs were not going to be honored by the mortgage lender (who is a preferred lender who attends the builder's meetings and has representatives co-located with the sales staff onsite). This would typically seem to be a conflict of interest. In any event the mortgage lender manager informed me even if we were rejected for the loan (which would obligate the builder to reimburse us in full), we would be considered to be in breach since our situation changed (i.e., we moved out of the country). They then proceeded to increase our closing costs, fees and interest rate based on this being an investment property (which we were not interested in pursuing) but were told we would be considered in default if we did not do this and they would keep our deposit.

Desired Outcome

The builder should return our security deposit in full $22,438.28.

It's been 5 years since Mr. executed a contract with the builder, and 4 years since the builder's final home closing in the community, thus it is untimely for the company to offer a monetary resolution in response to the said situation that the buyer encountered several years ago. We tried to resolve this immediately before moving overseas for the Fed. Gov't.; however, the builder did not want to cooperate despite not having any legitimate reason to keep our deposit. This is why it has lingered for years. We don't feel the excuse of years passing is appropriate. A wrongdoing is a wrongdoing no matter the time-frame. This builder has done this to other unsuspecting victims as evidenced by the Revdex.com. They should be held responsible and rectify their unethical behavior by returning the security deposit as substantiated. We are not satisfied with this unethical response. The documents have been provided. Please let us know what we can do to get our over $20K back.

We stand by our decision and request for this case, which is more than five years old, to be closed and removed. In June 2013, *** signed a contract to buy one of our new homes and qualified to do so. At the time he was employed as a professor. Our records show *** then changed his mind about pursuing a cancellation, and six months later in November 2013, when the home was nearly finished, he communicated that he still intended to close on the home. *** backed out of purchasing the home after it was already built just before the home closing, thus we did not and will not return his deposit.

Once we accepted a job with the Fed. Gov't. overseas serving military-connected children, we could not possibly qualify for the loan. At this time and prior to breaking ground, the builder was contacted in order cancel the contract. However, based on their in-house loan officer's erroneous and self-interested decision, the builder coerced us into continuing with the home although we could not afford it. If we did not do so, we were threatened with losing the security deposit. Ultimately, we could not convince the builder or loan officer we could not afford the home or legitimately quality for it. My income and the fact that we owed a mortgage on a home and property made it impossible to qualify which should have rendered the contract null and void. Please refer this to a mediator since the home builder does not want to accept responsibility for his actions and is not being forthright regarding the facts of the matter.

We purchased our home in 2014 and the whole process was fantastic! This is our first home purchase and so we were a little nervous, but the whole team at CC homes was just great!! From picking our model, then our lot, then our options everyone was extremely helpful, and very informative. Our home was finished in the time that was promised, and we have loved living here. The reason I felt the need to write this review is because of the amazing customer service, and awesome support we experienced after hurricane Irma hit. We stayed in our home during the storm, and it was a very scary, and very strong hurricane. We stayed because we knew these houses are built to withstand these strong hurricanes, and we were not disappointed. After the storm Mr. himself was here making sure to get what little damage there was to peoples homes and property taken care of as quickly as possible. I could not be happier with the neighborhood, and home we chose to build with such a great company!

I want someone to be able to give me a solution since the involuntary companies already said the last word, but this is an injustice.
Hi my name is *** from the month of November 2017 we went to the models houses of Maple ridge in Ave *** florida, we fell in love with my wife and I with model Balboa, right there with our Realtor *** we looked for information we were taken care of by *** excellent person, and she referred us with the loan Officers of American Eagle Mrs. ***, from the beginning we let you know that we were first buyers and we had no down payment , We filled everything they asked us and supposedly we were pre-approved for a loan called USDA, we signed a contract we paid and we reached an agreement to pay $ 500 a month that until today was 5,564.50 There are included the up grades of the house. Everything is perfect until March 24, 2018, which, unfortunately, is foreign to me I get fired from my job after 8 years, from that moment all our dreams were lost because the only thing I thought was so little that it is missing for the house and I get fired it is very painful,But I can not sit back and wait for the government to keep me , We are workers and we are used to work, The point is that the same day that I'm unemployed my wife calls the loan officer *** who is an employee of Ms. *** and she is notified that I had been fired and As soon as I got another job, he notifies me, Thank God that I find a job but unfortunately not with the same salary as before, but a lot less, he asked me for all the information Of how much I was going to win and obviously he said that he does not qualify for any loan with that money that he gives me. With the new salary. Now the problem is that they do not want to repay me the money they pay so hard, now Ms. *** says the loan was not denied, but I changed the loan.If not that I changed jobs, when it was not like that and I have proof of unemployment in Florida which was approved by dismissal. He just sent me an email and said he had to go to the builder. Of the I wash my hands and now nobody wants to return my money, please it's not my fault in No time that I lost my job of 8 years and less reaching the goal of buying our first home. That's why I'm writing to see if anyone Can you help me. Then I sent an email to the vice president of CCHomes, Mrs. ***, and I told her what happened and she only told me that she felt it and that it was 2 months before the house was ready and that she would get me another job. so easy to solve it. Ms. qualified for the home and signed a binding contract. Two months before the home is complete she informs us that she got a job that pays less and she wants to cancel. At this point the home was almost ready and it is her obligation to close on the home. She still has 2 months to find another job or get a second job. At this point she already wants to cancel her contract when she still has time to find a job. We built the home for them on good faith with colors and options customized for them. We will now incur loses if we need to resell it if she cancels.

I signed a purchase contract back on April 2017 to buy a property located in Miami-Dade, they failure to approve my loan, but told me so almost when the house was ready (just one month prior to closing) I initially gave them a deposit of $10,000 to hold the property, meanwhile, I had to choose the property options/upgrades, which totaled an amount of 25,000 which I had to pay wright before the property was ready to close, Since they were unable to send me a final approval, I decided to get out of the deal and now they want to keep my deposit, and even worse they want me to pay for the options/upgrades on the house, which they finally sold for $30,000 more of the selling price due to the options I picked. This is totally unfair, $35,000 is my lifetime savings and I am seeking for help since I don't have the money to hire a lawyer! Please help!!

Ms. purchased a home on April 14th . According the binding contract that she signed she was to give additional deposits which she failed to do as she bounced 2 checks given to us. It was not until August over 4 months after she initially qualified and after we built a home for her with her color selections and upgrades that she hired an attorney to try to cancel the purchase and get her deposit back.

Our attorney explained to Ms. attorney that his client defaulted on payments due us according to the contract that we had already built a home for her and there was no reason for her to cancel. Her attorney decided not to continue with the case. In addition CC Homes had to sell the home at a lesser price than the price Ms. paid for the home.

To recap it is our contention that Ms. signed a binding contract to purchase a home and CC Homes built a home for her and when the home was almost complete she decided she no longer wanted the home and tried to cancel through no fault of CC Homes thus entitling CC Homes to rightfully retain her deposits as liquidated damages

CC Homes approved lender was not able to approve my application, they kept working on it, telling me that everything was ok, that I was going to get approved shortly, they never did, I have two denial letters from their corporate office that is when I decided to confront them and the only option they provided was unrealistic, to find a co-signer for the loan. The truth is that I gave them a last check and of course I had to put a stop payment on it since they were unable to approve the loan application. I provided them a $10,000 check at time of contract signature, a later payment for upgrade options for an additional $25,000 and as far as I understand they sold the property shortly after meeting with me for a overpriced amount of $40,000. So, I was left with no options to get back any or some of my lifetime savings for retirement, this is extremely unfair. This is how they do business, keeping people's money, buying time for people to believe that they will be approved and ALL this Company/lender wants is to get away with the money!

Again what Ms. is stating is categorically false. Even the attorney she hired did not proceed with this.
First the home did not sell for more money as a matter of fact it sold for less and we also had to incur interest commissions and carrying costs. The contract Ms. signed was clear she initially qualified for the loan and then did everything in her power to get disqualified along with bouncing payment checks she gave us.

Second, we at CC Homes built her a home on good faith with her color selections and options and she defaulted on all the terms. We did in fact have to sell the home for less money than she purchased the home for and in addition we incurred additional costs. It is a matter of public record that we sold the home for $400,000 when Ms. paid $430,000 for the home and in addition we had interest, carrying costs and additional sales commission. Her deposit did not even cover our loses in this.

The seller did not honor the $5K seller concession I was told I would receive.
We recently purchased a new home in Ave Maria, Fl. I am writing this complaint in regards to the treatment we received from *** the Senior VP of CC Homes in the hopes that potential buyers are aware of what may occur should they choose to purchase here.

We met one the sales consultants in Ave Maria who had a home he'd like to show in our budget and the seller was eager to sell it because it was on the market for over a year. Also, they were offering $5K toward closing costs should we use their in house lender.

We loved the home and I said I'd be back the next day to sign the documents. He reminded me about the seller concession of $5K. It was at this time that I explained we had pre-approval from another lender and for the time being, we will still pursue using them.

A few days after we gave the 10% deposit however, we were informed that Ms. would not sign a required VA loan document as part of the loan paperwork. I asked my realtor to have a meeting to see what could be done. While there, she was met with both the in house lender and the sales consultant. They called me to offer a quick solution, which was to go with the in house lender since Ms. always signed off on all their VA loans, and there never were any issues. Both the sales consultant and the in house lender also offered the $5k toward closing costs if I were to agree to their solution. I asked the in house lender what kind of rate he thought we could get with him and he stated 4.75%. I informed him that we were getting 3.5% and that I would rather try to work out the paperwork issue with my lender before pursuing using them.

As time went on, my lender was not able to find a solution to the required VA paperwork issue. We were forced to pursue using the in house lender (or risk loosing our deposit for not closing on time) with the much higher interest rate. To make matters worse, when we received our loan disclosures the $5k seller concession was not indicated. When inquired with the new lender and told that it's probably because we didn't use them first. We explained a time restriction was not given so then we were told to contact Ms. personally.

Our realtor called Ms. After being asked about the missing seller concession, she started to question the legitimacy of my claim and denied that I had ever heard it. Our realtor assured her that I was not lying because she too was privy to at least 3 conversations in which we were both told about the $5K seller concession by not only the sales consultant but their preferred lender too on the phone and in person. Not being able to contradict that, Ms. then exclaimed that due to the fact that we were getting such a "great deal per square footage on the home", she said that she told the sales consultant and the lender the day we signed our contract not to offer us any seller concessions or upgrades. In response, my realtor explained to her that that particular bit of information was never shared with us and stressed that this issue was not due to any fault of ours therefore it would be in everyone's best interest if she agreed to honor the seller concession and maintain the integrity of the sale. This remark was not meant to be demeaning but it triggered Ms. to become defensive saying CC Homes had never been sued etc. The conversation became awkward and off topic so our realtor politely ended the call.

In the end, we didn't receive a dime so sadly; I feel it is my obligation to inform people of the questionable business practices and professionalism we were subjected to. Had Ms. showed some integrity and reached out to us directly explaining her reasoning regarding the VA paperwork or had she even attempted to recommend a win/win outcome by offering to pay 1/2 of the seller concession, we probably would've understood. We would have felt valued and appreciated as customers instead of victims who fell fell prey to the dark side of the real estate business.

The builder offers a $5,000 incentive towards closing on certain homes and under certain conditions. Ms. signed her contract which she clearly understood did not include the $5,000 closing cost incentive. However, Ms. did receive a much larger incentive than $5,000 on her home, in fact she received a larger incentive than any other home in this community. We will not honor her desired resolution of additional concessions.

First of all, my name is ***. Not***. My husband did sign a sales contract (not me) when I made our deposit however, at that time, as I've already indicated we were pursuing using our original lender therefore any seller incentives to use the in house lender would not have been indicated in the contract at that time.

It is a fact that my realtor and I were told on several occasions by your very own sales consultant as well as the in house lender that our home was subject to the closing cost incentive of $5K should we use the in house lender (which we did do less than 2 weeks after the contract was signed). You can't offer that incentive to buyers and then when the paperwork for the loan is being processed and finalized, decide you no longer want to honor it. That is false marketing and unprofessional sales practices.

You indicated that I received "a much larger incentive than $5,000 on her home, in fact, she received a larger incentive than any other home in this community." Please explain in detail what "incentive" you are referring to, as the only incentive that we EVER discussed with any person affiliated with the sale of the home was the seller concession of $5K toward closing costs. No other incentives were discussed nor written in the sales contract or closing documentation.

CC Homes is building the homes in Ave Maria and multiple complaints to them about faulty building issues are unattended even when under warranty.
We bought our home from CC Homes in October 2016. The structure of the house is covered under our warrantee for 1 year. In May, I complained that the gutters are not collecting the water even when it rained moderately. Their gutter company, Installed Building Products (IBP) of Miami, came out and said they would fix only the front gutters. I refused to have them come and fix the front gutters only when the entire gutter system around the house does not work. Multiple calls to CC homes failed to resolve the issue and I was basically left on my own to resolve the issue with IBP. Eventually, after multiple emails to CC Homes Vice President and to the sales person who sold me the house, IBP came out and worked on the front and the rear gutters only. The sides were untouched. Since they came out, the gutters are worst in the front because now the water is channeled onto our lanai making it impossible to exit through the front door when it's raining.
My roof has began to leak water in the kitchen. We contacted CC Homes and were told they would have someone out to fix the roof the following day. It's going into the third day and no one has come to look at the roof. Subsequent calls to CC Homes' service center, and we were told to cover our appliances to prevent water damages and that someone will come out weather permitting. It's been sunny and no one came. Several of my neighbors have the same horrific experience with CC Homes - they refuse to have their subcontractors honor these warrantees while they continue building new homes at an alarming pace. We feel like now, since CC Homes have already been paid for our homes, they have left us on our own to solve any problems we have with these subcontractors who are reluctant to fix and to honor the warrantees.

We just want CC Homes to be more proactine and force these subcontractors to come and repair their faulty installations!

We at Codina *** Homes understand that Mr. is unhappy with the gutter package he received with his new home. When Mr. first reported this in May of 2016, the complaint was addressed and Installed Building Products (IBP) reported to the home immediately offering to install a valley shield to help diffuse the water run-off. However, Mr. declined this offer. Codina *** Homes worked with IBP in order to fix the issues covered within the limited one year warranty provided to him and all homeowners. Since then, Mr. has experienced additional issues related to the installed gutters, therefore; our customer service team has continuously worked with Mr. in order to get these issues resolved. We value our homeowners and want Mr. to have a new home experience that he is happy with, thus we will continue to work towards a fair resolution.

While the roof leak was addressed and fixed one week after I first reported the matter to CC Homes, the gutter issue is still unresolved. I initially declined IBP's request to fix my gutters only because, after talking to their supervisor, he informed me that they would only come out and fix the front gutters (and not the side and rear ones). He told me that they would not fix the rear nor the side gutters because they were working properly and appeared to be malfunctioning only because it was raining too heavy when I noticed the overflow. This is the sixth house I've owned, but the first and only one with gutters that cannot properly channel away rain water that is coming down moderate to heavy! I showed a video to the company's workers who were at my house at the time, proving that the rain was not falling heavy as was suggested by their supervisor. This revelation was never taken into consideration subsequently. After several calls and emails to CC Homes, IDP did come out to "fix" my gutters. They only worked on the ones in the rear and front of the house and totally ignored the ones at the sides of my house. The gutter at the front of the house is now functioning worse than before because some of the water is now channeled onto the front patio.
I have noticed similar problem with my neighbors' gutters!

Codina-Carr Co is refusing to replace two defective window screens. When I purchased the home they stated that you have a 1 year warranty on the home.
We purchased a brand new home and closed on July 7, 2016. The home comes with a one year warranty from the developer (Codina-Carr Company Homes Builder). While cleaning all of the windows in the home on May 28, 2017, we noticed that the two window screens located on the second floor windows were damaged. The screens each measure 14" X 16". On Tuesday, May 30, 2017, I called Codina-*** Company Homes customer service and spoke to Ms. and advised her that the damaged window screens were placed on the windows, by the window company. One screen had the pegs that you pull back to remove the screen missing and the other window screen had a hole in it where the screen was clearly damaged, and since we were within our one year warranty that we were requesting them to replace or repair them. Ms. stated that she would follow it up with her boss.

On Friday, June 2, 2017, my wife, *** contacted Codina-*** Company Homes customer service office and she spoke with *** and asked her if she knew what was Codina-Carr Homes going to do about replacing the window screens. Ms. advised *** that her boss was not going to replace the screens. *** is referring us to our one year warranty which reads in part " For a period of 60 days from Commencement Date Seller shall inspect, adjust and /or repair the following items in your home: doors, windows, caulking etc. Now if you read this statement well, their limited warranty refers to the "seller". I am the buyer and based on this statement, this responsibility belongs to the seller "CODINA-CARR HOMES" to insure that these items are all working properly. Ms. further stated "This date clearly reflects your request is out of the warranty range included for this particular item." and "that these newly found issues with your screens has been denied."
When CC Homes sells you their product they have the sales associates tell the buyer that you have a one year warranty on your home from the day of closing. We have found out that they are only giving you 90 days of warranty from day of closing on Irrigation and Landscaping issues which this information was never previously disclosed to us. Now we are also finding out that the window screens are also not covered repairs or replacement. So the bottom line is that CC Homes is falsely telling all buyers that you have a one year warranty on your home when infact you do not have that full one year coverage on any issue you encounter on your home and they are now advertising this as "A Limited One Year Warranty". That is not right to tell buyers that are spending over $400K, per home to use this line to make a sale and telling the buyer that they have "a one year warranty", when you really do not have a one year warranty on your home. If I have to speak to the media regarding their false advertisement then "yes" I will.

Desired Outcome

That they contact the developer Codina-Carr Company Homes and have them correct the issue as they said when we purchased the home that you have a one year warranty. If they are not honoring that warranty then they should not tell the buyer such lie. This is False Advertising in order to make a sale. It is quite deceiving to discover that you actually have a "Limited One Year Warranty" as opposed to a "One Year Warranty" on our home. In the email, I received on Friday, June 2, 2017, from Ms. it clearly states "For a period of sixty days, from the commencement date, SELLER shall inspect, adjust and/or repair the following items in your home: doors, windows, caulking, etc." I am the BUYER not the SELLER. These issues with these screens should have been taken care of by the SELLER, Codina-Carr Company Homes, within those 60 days and they never did. The window company placed these damaged screens on the windows and Codina-Carr Company Homes failed to inspect their sub-contractors work.

Mr. and Mrs. are well aware of our contractual warranty. The warranty Mr. is referencing is the "limited one-year warranty", as advertised and was reviewed and executed by Mr. . Mr. has been serviced several times for customer service issues that fall in line with the very generous limited warranty that we provide all of our homeowners. According to our one-year limited warranty, the seller is responsible, for inspecting, adjusting, and/or repairing certain items (detailed below) in the home within the first 60-day period.

The original claim was documented on May 30th, 2017, several months after the closing date (July 7, 2016) and outside the 60-day period detailed within the limited warranty. "For a period of 60 days from the Commencement Date Seller shall inspect, adjust and/or repair the following items in your Home: Doors, Windows, Caulking..."

Our records indicate, Mr. the settlement date on your home was July 07, 2016. This date clearly reflects your request is out of warranty range included for this particular item. Regretfully, these newly founded issues with your screens has been denied. Please review the Limited One (1) Year Warranty which was provided to you at close for further explanation.

CC Homes shares detailed documents with all homebuyers, which outline the specifications of the warranty, and responsibilities of both seller and buyer, upon purchase of the home. Additionally, all sales associates are trained to clearly state warranty specifications.

First of all, I would like to clarify to Mr. *** that my name is MR. not *** I disagree with the response from (CC Homes, Codina-*** Company) the business. Mr. states "all Sales associates are trained to clearly state warranty specifications." In this case, this is cleary not true. Codina-*** Homes Sales Associates only tell you that you have a "one year warranty" on your new home. Our Sales Associate, told us that we had a One Year Warranty. Even the representative from Codina-*** Company, who did our walk thru with us, also lead us to believe that we had a one year warranty and told us that if we have any problems with our home, to contact Codina-*** customer service. No Sales associate has ever covered any warranty specifications. This is the problem, Mr. will not disclose the fact that the sales associate handling your sale, will tell you that you will have a one year warranty. Their Sales Associates tell you this in order to make the sale. Its a sales catch all. Then after you close on your new home, and you call customer service, you now find out that you have a "LIMITED 1 YEAR WARRANTY" and not a one year warranty. Then to make matters even worse, Codina-*** Homes picks and chooses, what items to fix and what items not to fix. For example, I called about sprinklers not working, I was told sprinklers are only covered for 90 days, I called about landscaping, dead grass, missing tree, again I was told I only had 90 days, and now I called about my window screens and now I was told that after 60 days, its on me. I guess nothing here is covered for one year. This is why Codina-*** are now saying that its a Limited One Year Warranty cause its easier for them to tell the homeowner that its on the homeowner and not them. Currently, there are many homeowners in the Bonterra community, not satisfied with this developer because of thier constant lies to the customer, including the warranty for the home. Mr. has made it very clear based on this issue with the window screens, that he will not take care of the issue nor any other problem that may arise in my home. He is being vindictive and refuses to service my home as a "payback" because I filed a complaint with Revdex.com. Furthermore, on Tuesday, June 13, 2017, I called Codina-*** customer service again and spoke to Ms. *** again and advised her that I had discovered several windows that needed to be adjusted, because when you open them the window slides down. *** stated to me that it would not be a problem. Then on Wednesday, June 14, 2017, Mrs. called my wife *** and told her that since we had filed a complaint with Revdex.com about the window screens, that her boss, Mr. *** was going to refer us back to the LIMITED 1 YEAR WARRANTY, and that he further stated to tell us that "he was not going to fix any other issue we may have in OUR home" and that "he was done with this house.". Mind you that my one year warranty expires on July 7, 2017. Again,this is a clear indication of a Codina-*** Company employee being vindictive towards us, over a complaint I filed with Revdex.com, with reason. Based on his determination, I will not recant this complaint at this time.

CC Devco Homes Response

Attached within this complaint is a document that details the Limited Warranty discussed herein. This document includes Mr. and Mrs. signatures. The builder will not respond further to this complaint, given that the document provided dismisses the credibility of Mr. claims stating that he was not aware of the "Limited Warranty", when he signed a document that has the headline "Limited Warranty".

To Clarify my dispute with CC Homes when we initially signed a contract our sales associate verbally told us that we had a one year warranty on the purchase of the home.

Even during our walk thru again we were verbally told that we had a one year warranty and if we had any problems not to call the vendors but call Customer Service. When we initially did our contract it was January of 2015, and we did our walk thru May 27, 2016, all along no one ever explained anything regarding a Limited one year warranty. This document that was included in the developers response was not included in our closing package. We were never explained by anyone from CC Homes about any Limited one year warranty as previously stated by Mr. *** that his sales associates are trained to explain to the customer purchasing a home. At this time I will continue to say that CC Homes needs to ensure their sales associates are properly trained.

Furthermore, I will never purchase another home from CC Homes and I definitely will not recommend them to any of my friends or family. This complaint will not be RECANTED!
