Improperly installed the drainage for my pool. Causing extreme amounts of standing water, reaching my crawlspace, and also flooding the neighbors yard
We contracted with Corey R (CCR Backyard Design) on 9/11/19 for a patio and draining around our new pool. He worked with the pool company (*** & *** in the early stages and suggested the pool/patio level be built ~1.5ft higher (my estimate) than where the ground level was previously, to align with the steps on the back of the home. The raised pool area blocked all the natural drainage that existed previously on the property. He installed drain boxes as listed on the contract, however they were placed far too high to prevent water from flooding. Now after a rain, an area of roughly 6000 sqft in the yard is under roughly a foot of water. The water reaches the crawlspace of my house, and also floods into the neighbors backyard. I have to run two sump pumps for days at a time after there's rain. Corey agreed to meet me back at the house to prove to me there was no slope in the yard. He refused to measure the slope from the location where I had set the pump in the center of the flooding, and instead measured from a lower point roughly 30 feet away from the location, still finding there was a negative slope, but claiming it wasnt enough. He did not show me the reading so I can't confirm the results. He then claimed that I had told him during the job that I was "fine with standing water", which is absurd. I now have to contract with another company to come and correct his work, which I'm being told will likely involve ripping up parts of the patio done as part of this contract. The town of *** sent an engineer out who reported back to the town planner that the drainage work done here was insufficient, blocking the previous natural drainage, and that the system put in place would not be enough to handle the volume of water necessary for the property, even if it the basins had been located correctly.

The new grading and drainage done for this job requires so much water to collect before beginning to drain, that it enters the crawlspace of the home and floods the neighbors backyard as well. The neighbors have also lodged complaints to the HOA about this work.

Desired Outcome

CCR charged me $2960 for "Installation of Drainage" per the contract. Given that the drainage installed was unreasonable and inadequate for the property - I would like a refund of that amount, that I will use towards having the issue fixed by a company with more drainage expertise.

The drainage that CCR Backyard Design was contracted to be installed on this property is working as it was designed; to prevent water from going into his pool. CCR Backyard Design was installing the patio area around the pool only, not areas outside of the pool project. I informed the homeowner that additional drainage will be required during the landscape phase, which is normal when doing a backyard project of this size. The homeowner was told on two occasions that water would continue to back up in the yard, but he told me at those times that the yard was draining properly. I have photo's of the yard being overran with water before the project began. I also showed laser level readings in person on 2 occasions (Once before the project and once after) that a gravity drain would not work on his property and he will have to install a sump pump to drain his yard. I have tried to communicate this with the customer on numerous occasions now both over the phone and in person with no resolve. CCR Backyard design prides itself on honesty, integrity and the best quality of work. We never want a customer to be unsatisfied with our finished product. Although what needs to be done was not a part of our contract and we do not believe we are at fault for the drainage issues that were already on this property before work began. We would like to come to an agreement on a fair resolution to this concern. Thank you.

This is incorrect. I actually informed Corey that the drainage looked insufficient when I first saw the placement of the drain basins before the projection completion in September 2019. His response was that the yard would naturally drain and that the basins would be sufficient. At no point did he mention additional drainage being necessary until after I showed him pictures of the yard flooding in December 2019 after a period of rain. He never suggested a sump pump until December 18th when we met again at the property. Also, there was no "landscape phase" to this project, so I'm not sure what he's referring to there. Also, he was on site, doing drainage - If additional drainage was required, it would only make sense that I would contracted him to do it while he was there, instead of letting my yard flood, my neighbors yard flood, and having water enter the crawlspace of my home.

The photos he's referring to from before the project (from a period of heavy rain in July 2019), I actually sent to him on December 13th which clearly show water "flowing" to the natural drainage point, a culvert on the east side of the property, which flows down to a lake, the water is not "standing". While water is visible in these photos, I explained to Corey that it would drain away in a matter of minutes. The natural path of the stormwater was also confirmed by the town of *** engineer. There was never standing water on the property before this project, which the previous owner and the affected flooded neighbor will attest to. An area that measures .2 acres now floods after rainfall.

He did measure the levels one time while I was on site with him in December, but he did not show me the readings, and also refused to measure from the location I asked (directly next to where I set up the first sump pump after the December flood). Even after picking the lowest point on the west side of the property, his readings showed that there was still negative drainage to the culvert on the east side of the property, despite his continued claim that there is none. So I'm not sure how he defends the claim that there was "standing" water prior to the project after proving the existence of negative drainage himself. It is worth mentioning that the very first company (highly rated drainage solution company) I had analyze this work, also laser-measured and then proposed a gravity drain, the solution Corey continues to claim is impossible. Unfortunately this solution now involves ripping up part of the travertine patio CCR installed as part of this contract.

In short, there were no drainage issues on the property before this work began, I'm going to have to contract a company to do the work I've already paid CCR to do, and then also pay them to redo part of the patio CCR installed. I believe a fair resolution, at an absolute minimum, would be for Corey R/CCR Backyard Design to return the amount of $2960 I was charged for drainage which clearly serves no purpose. I will use that money to apply towards a proper solution that does not threaten the foundation of my home or create floods reaching into my neighbors yard, from a company with drainage expertise.

I still stand by the fact that the contracted work was completed and functioning as it was designed to do by my company. If the customer feels that my 2 drain boxes near the area in question are not helping, I will return the cost for those items, which carries a value of $1,140. Other than that the other drain boxes that are installed around his pool and the downspout drains are all working as they are designed to do, so I do not feel I should reimburse the customer for something that is working properly.

I've been told by a team of professionals that 4 out of the 5 drain boxes installed serve no functional purpose, given the water would have to rise to a level that it would first pour into my crawlspace before reaching the height of the basins. I've also spent about $350 on pumps/hoses/cords to prevent further damage to my home. $1140 is not a fair number to resolve this situation. $2280 at a minimum, $2630 if you want to be fair. Choose a number inside that range and I'll be willing to close this complaint.

I will agree to reimburse the customer the amount of $2,280 to resolve this complaint. I still stand by my original comments that the drainage system was installed the way it was designed. I want to ensure that by accepting this reimbursement the customer agree's that this complaint is resolved.
