The business has been contacted by me several times (in person, via phone and letter) to collect for a damaged garment in their cleaning process.
The owner refuses to take responsibility for their action. The coat that was damaged by Cd One Price Cleaners was in perfect condition when dropped off at the cleaners. The owner of CD One Price Cleaners claims that the coat has improper labeling however this same coat was previously dry cleaned at a different cleaners business and was not damaged then.

The damage is a "pleather" (faux leather) trim on sleeves. It is peeling. (Will attach picture.) I called the customer and she immediately began to say it was out fault. I explained we followed the care label and asked how long ago the coat was purchased. She said within the year. I then suggested she take the coat back to Express, the store where it was purchased, and let them know what happened. It was a manufacturing issue as we followed the care label cleaning instructions. They probably would exchange it for her or give her something similar. Immediately, she got upset and said she was not taking coat to Express. She kept on that it was our fault and I needed to pay her $150. She would not stop yelling so I told her I was hanging up the phone.

Today, I get this complaint. I called Express customer service line to explain situation. I gave them the info off the labels in coat. They then proceed to tell me the coat is 7 years old. Now it makes sense why she did not want to take it to Express. She knew they would not exchange after such a long period of time.

In our business, we follow a Fair Practice textile claims chart by the International Fabricare Institute. It is based on the age and condition of the item. (Will attach to this email.) Based on the age and condition of this coat, I am willing to give her $30. I am basing it on a wool coat being older than 5 years, which has been verified, and it being in Excellent condition, instead of good or poor - giving the benefit of the doubt to to customer. And I am also offering this in good will as if we were negligent, which I do not believe we were. We do not pay claims if it was a manufacturing issue. Customers understand this once it is explained, especially on an older item.

I think the main issue here is age of coat. No court would expect us to pay 100% replacement value on a 7 year old coat. I feel I am being more than fair, especially after being lied to by customer.

I understand how you may think the age is not an issue, but the best example I can give you is a car accident. If you are in a car accident and you don’t feel it’s your fault, the insurance company is going to give you what it is worth at the time, not what you paid for it 7 years ago. I will go up to $50. Please remember we cannot separate that trim from your jacket and it says it can be dry cleaner I’m sorry but this is the best we can do.

I am rejecting this response because:

I appreciate your response however I do not agree with your analogy.

As a professional knowledgeable in the trade, by accepting the coat in its current state, age and material composition, without stating any conditions, you (the business) create a contract with your customer and agree to return the coat in the same condition/state. This has not happened and therefore the contract was broken.

In attempt to finalize this dispute now, avoiding lengthy proceedings, I am willing to accept $100.00 (not negotiable). I'd like a check prepared and ready for pick up at your Arlington Hts location by this Friday, January 18, 2019 at which point I will also collect the damaged coat for future donation.

If we cannot reach an agreement, future proceeding will start, where I will look for the originally requested reimbursement ($150) plus any and all court/attorney fees.
