In response to complaint ID #***On August *, 2015, *** *** came into our facility looking to sign up her two daughters for a gym membershipBoth of her daughters signed up for a payment agreement membership for $19.99/ month and an annual fee which would be due on 12/** of
every year they are a member of the gymUpon joining, no fees were paidThe first billing date for the membership was not until 09/**/*** signed a credit card authorization form for both daughters accounts stating she agreed to pay for their membershipsThe credit card authorization stated "* *** *** *** *** ** *** *** *** *** *** *** *** *** *** *** *** ***" This form was signed by *** on 08/**/2015, the same day her daughters joinedAnd also signed a minor waiver for her younger daughters account, giving her full permission to utilize the gymWhich was also signed by *** on 08/**/2015, the same day as her daughter joiningUpon joining, a copy of the agreements were emailed to each memberBoth daughters put their own email addresses on file.On 11/**/2015, Rohina, members mother, came into the club looking to cancel both of her daughters accountExplained to her the cancellation policies and what her daughters signed up forI explained to *** that her daughters joined for a payment agreement and would be unable to cancel at this time*** was upset with this information and stated she was informed by the employee that signed her up she could cancel in November and avoid the annual feeI informed her that all of our employees are trained to explain the agreement the exact same way and an employee here would not make that promise to herTo accommodate the members mother, I offered to freeze both of her daughters accounts for her at a $charge for months since they were both in school and not utilizing the gym at the timeI also explained to the mother she would still be responsible for the annual fee on of $49.99, but the monthly dues would be waived*** signed a change form agreeing to the freeze for monthsThe next billing date of $would be 02/**/2015. When the annual fee was tried to be charged on 12/**/2015, the card was declinedOur billing company, ABC Financial called on 12/**/and said they had spoken with *** and she was upset and misrepresented with the agreementBecause the members mother was so upset, I waived the late fees and service charges off of both of her daughters accounts.*** then reached out to our Director of Operations about the issue and he informed her the annual fee is part of the agreement and it is a payment that is dueOn 12/**/2015, *** called the gym and stated she reviewed the agreements and wanted to only take responsibility for one account, not bothTold her I was unable to make a deal with her and the Director of Operations let her know she would be responsible for payments for both accounts.On 01/**/16, *** came into the club and requested a printed our copy of both of her daughters agreements and to show her where she agreed to an annual feeI showed her on page that it is a payment agreement of $and an annual fee of $on 12/**I also explained to members mother that after joining, legally she had days to change her mind and cancelShe stated her daughters put their own email addresses on file so she was unable to review the agreements and she never read itI told her that is not something the gym can be held at fault for, if she chose not to read what her daughters were signing up for and what she was agreeing to pay forShe then told me to write off of her childrens annual fees and she will pay the other, told her I would not be able to waive it for her, she then told me she'd paid $1.00/day and nothing moreShe paid $for each account and left the gym.On 3/**/I emailed both daughters letting them know their account is past due and was in danger of going into collections.Rohinas older daughter contacted me at the club upset about this email and wanted to come in and speak with me about accountMember came into club on 3/**/and I informed her of the agreement she signed for and also the past due balanceShe is a college student and has no time for the gym and also would be studying abroad soon after the semester is overOffered her an extended freeze for the time being that she is away, she said she would pay off her overdue balance only if we agreed to cancel her after the payment was madeTold her since she signed a payment agreement, her only option would be to delete her auto renew and be responsible for all payments within agreementShe did not want to do that, she wanted me to speak with the Director of Operations again and let her know what we could do for her situation. At this point, I pulled BOTH accounts from collections, waived ALL late fees and service charges until we could figure out an accommodation for both members.The next day, 3/**/2016, *** came into the club to discuss both account and cancelI explained to her the cancellation policies once again and also that the overdue payments would need to be madeMember refused to leave the gym until I canceled the accounts, she threatened to call the police on me and also to sit here all night if she had to until I canceled the accountI told her that would not be necessary but she needs to follow the proper gym policies to cancel the accountI then again showed her the credit card authorization she signed, the minor waiver for her younger daughter and agreementsShe did not want to pay for anything and wanted to speak with the Director of Operations*** and myself stepped into my office and we contact *** ***. *** *** made a deal with *** that if she agreed to pay the overdue balance which was $88.97, on both accounts, he would cancel both accounts for herMember at first agreed to it but then changed her mind and said no, if she is owning fault we should too*** *** tried to explain to her this is a great deal because she would not be responsible for the total contract balance*** did not settle*** *** offered $for each account, totaling to $and he would cancel the accounts immediately. *** agreed, she made a payment of $for each account that same day and signed off on a cancellation form that the account have been canceled immediately effective that day, 3/**/She also wanted confirmation the accounts will not be sent to collections*** signed a 2nd form stating members accounts will not be sent to collections.Members mother left happy to be done and have this over with.Audrey D***
