IIResponse to Complaint ID ***- Received December 21, 2015CearnaiCo serves a property manager for the owner at *** *** *** ** ***We received anapplication to rent the property on November 13th through their Realtor with a different brokerageTheIproperty was current'y
occupied and no comments were made by previous occupant regarding any makeready issuesThe applicant asked that the carpets be cleaned prior to move in which was completedTheapplicant asked that ~e get the property ready for occupancy November 23rd so their family could move beforeThanksgivingAt additional expense & hardship, the previous occupant moved out quickly and the propertywas made ready with' some minor repairs and cleaning including the carpetsThe applicant moved into theproperty on the 23rd[ upon paying prorated rent of $for 11/23-11/and did not return the PropertyCondition Report that was due within days of move in or November 28th.When December rent was due on Tuesday, December 15t, at 1:01AM the applicant texted us saying that shebelieved there was an active rodent issue which was our first time to receive notice of an issuePreviousoccupant never repored or mentioned any issuesThat day we contacted *** *** to come out thefollowing day to evaluate the issue and come up with a treatment plan that could be executed expeditiously.IWe did not hear from *** *** that the house was unsafe but just needed to be treatedOn Wednesday,December 2nd, at j\.* *** *** came out to the house and provided a treatment plan that CearnaiCo• I prov1ded to the owner.I While working on timing and payment options that day with the owner & Critter Control so that the issue couldbe corrected as soon as possible, at 2:20PM the applicant sent an email and said they were uncomfortableliving in the house and wanted to be immediately released from their lease and they would be out by DecemberGth if the owner woul~ agree to release them from the leaseWe understood via that email they would not beseeking reimbursemJnt for any moving or additional expenses with an agreement from the owner to releasingthem from the lease I agreementThe owner agreed and also informed them that she would not seek theunpaid rent in December of $for the days they occupied the home, a termination fee, a reletting fee orany of the unpaid rent per the lease agreement previously executedThe owner was not required to releaseIthem from the lease and was working on contracting to have the issue fully treated as soon as possible so thatthe applicant could s~ay and the property could be made back to whole since being made aware of an issue.IThe applicant agreed that if they could get their security & pet deposit back of $3,then they would vacateby the GthThe applicant signed the termination of contract on December 4th, moved out December 6th andthe deposit was returned to their office via certified funds on December 7thWe received an email prior tomove out asking for iepayment of November rent but explained that was not to be refunded per the previouslydI.agree upon term1nat1on agreement.We have not received any communication from the applicant since December 7th and were never asked forrepayment of moving or other expensesThe property is currently for sale a'nd lease but the rodent issue hasbeen professionally 1emediated and is currently under a continued professional treatment plan to ensure nofuture issuesWe were really hoping that the applicant would work with us to stay in the property since it putsIthe property owner at a major hardship to have the property vacant especially in December when there arenot as many tenants looking to make a move over the holidaysWe also offered to help The applicant findanother property to I lease if their Realtor was having trouble or unavailable as an accommodation to theirRealtor and have s~nt them options that we had hoped would work and really thought they had foundsomething already since we hadn't heard back
