Initial Business Response /* (1000, 6, 2017/06/09) */
This letter serves as a response to the complaint filed against one of our real estate agents as the result of the sale of the consumer's home.

The consumer had lived in their home for less than 2 years when they decided to move. They...

called one of our agents who was the person that had sold them the property. A conversation ensued about how there might not be a great deal of added equity to the property once closing costs would be considered due to the short time of ownership. The Seller understood and said they would like to receive [redacted] in net proceeds so as to have a down payment for their next house without having to touch their savings. All were in agreement and on March 16, 2017 the owners decided to move forward with the selling process.

On March 21, 2017 an offer was presented for [redacted] with a [redacted] seller concession to the buyer's closing costs. That translated into an effective offer of [redacted] prior to the Seller's mortgage payoff, property tax settlement and other closing costs. The Seller countered with a price of [redacted] and a [redacted] seller concession. Buyer came back again at [redacted] and [redacted] concession. Seller countered once again at [redacted] and the [redacted] concession. At this price our agent worked out the numbers and it was determined that it met the Seller's net proceeds goal of [redacted] The Buyers agreed and the paperwork was signed (see attached counter offer).

Several days later the Seller called our agent and decided they wanted to settle with the Buyer for an effective price of [redacted] rather than the [redacted] minus [redacted] seller concession). The agent explained that everyone had agreed to the amount and the contracts had been signed. She went back over to the consumer's home to once again go through the documents and numbers. Everything was explained and the Seller was fine at the end of that meeting. A few days later the Seller contacted the agent again and insisted that they wanted [redacted] for their house and that the agent should make up the [redacted] difference from personal funds.

The Seller went on to call the agent derogatory names and took an unreasonably aggressive tone throughout the remainder of their time together. When both I and the vice president of our company contacted the consumer by phone to discuss the matter we were met with numerous expletives and racist comments, making impossible to have a dialogue.

The consumer received net proceeds from the house sale totaling [redacted] which included a tax holding check of [redacted] sent to them shortly after the closing. We believe the consumer's complaint has no merit as our agent made it very clear what they were agreeing to in the sale of their home and the Seller signed the agreement. We are declining their request for [redacted]

Initial Consumer Rebuttal /* (3000, 8, 2017/06/09) */
(The consumer indicated he/she DID NOT accept the response from the business.)
No racial comments where never made toward [redacted] the realtor so her company is lying in we feel they should answer to what they are saying. Bye the way my wife is BLACK and we would never make those kind of comments to her. She need to own up to what she promises us PEROID. Can we take this to another level for saying we slander her.
