to whom it may concern, first of all I would like to apologize for late respond, my computer crashed last week and just got it back Tue. Also would like to apologize to [redacted] and and [redacted]. [redacted] booked a 1 hour ride a week before under [redacted]. The morning of...

the ride she called and asked if she could bring her dog. I told her no because of safety reasons. We spend 20 minutes doing a safety and riding introduction. [redacted] and [redacted] said they had ridden before. Our records indicate that [redacted] and [redacted] had ridden with us on Feb 14th 2013. Same horses same trails. Yes we go up that same rocky trail 2-3 times a day. the horses are in great shape and very sure footed. One of the couples that rode same time, the gentleman had ridden with us several times, he brought a new friend that had never ridden before, she rode same horse he had ridden when he came before. She did fall off her horse before the horse lost his footing and fell, we had a vet come next day and check horse out and said he was fine Not Sick. after careful assessment, when we saw some deer and the lady was behind me she wanted to take pictures of deer when she picked up her camera with bridle reins in her hand she pulled on the horse he  stepped sideways and then kept pulling on his reins he stepped on the rocks  and lost his footing on the rocks on side of trail. She did fall off sideways. I quickly got off my horse and went to her to check on her, yes she said it hurt but was ok, I told her I watched her when she fell of the side of the horse,  I told her she did  Not fall hard, she fell gracefully. She Did not fall into a tree. The horse fell on a down hill and was having a hard time getting up. This is the first time a horse has ever fallen.  After we got him up I checked him out and seemed to be fine, I put her on my horse and I rode that horse back. On the way back about 15 minutes we came to a large rock. At our original safety and riding intro all riders were instructed when they go downhill to lean back and put feet forward to balance both horse and rider. right before the large rock I reminded every body to do big lean back at the large rock, yes I say it every time for the last twenty years. after discussing that with vet also, it was determined she did not lean back and when the horse did stumble, he did not fall. she lost her balance and fell forward over his head. I got off my horse and went back and checked on her, she said she was fine. She got back on same horse and rode back. as we rode back I asked both of the lady's several times if they were Ok and both said yes. When we got back I told my wife what had happened and yes we both apologized for what happened several times. [redacted] told my wife she was p*ss*d and didn't think she should pay. Yes at that time we informed them of the liability release form they signed, which is posted on our website under horseback/trail riding page. Also pointed out the warning signs posted all over of the NM equine liability act. ride at your own risk. the lady that fell off the her horse was very positive, said was hurting but was Ok and would come back, I did say she had a good attitude I asked [redacted] several times if she was Ok and she said she was, even when I came out to there car to have them sign credit card form I asked her again. she kept saying she was fine. I told everyone  I would not charge the two lady's for there ride but all others had to pay. On 10-26-17 we did refund [redacted]'s credit card $38.30 that was originally charged. We truly are sorry this happened and yes Thank God no one was hurt seriously.
