Bardo Ramirez Roofing Inchas received and responded to all claims made to our bond and Liability insurance by the client *** ***. B.R Roofing Inchas tried to resolve this matter of the cracking windows and door/trim damage that is claimed by the costumer, *** ***, is due to the
weight of the roof. We proposed to Mr*** to: - Remove the door and trim, like our engineer *** *** had suggested written in a detailed letter- If determine that the weight was also affecting the bracing and framing of the home, and window and door damage was caused by the weight, Bardo Ramirez Roofing Incwill take responsibility of damage. - We have offered to pay for a second engineering report from a Structural Engineer for second opinion and Liability Insurance request. Mr*** refused and has not let any of our Crew, neither Sales Representatives nor our engineers find out if the roof is the cause of the broken windowsBardo Ramirez Roofing IncFiled a claim with the Liability Insurance (Claim# ***)

Company states: The consumer was concerned about pipes that were related to her solar panelsWe explained to her and indicated in our contract that I am not the installer nor have any liability with the solar panelsShe had contacted us for a leaky roof and problems with the roof which we
addressedTheir were pipes that needed to be moved to another area of the roof because it was causing the issues in her roof she complained aboutWe had to make a cut to the pipes to get to the area of the roof that had issuesI came back to her house and explained this to her and she said she understood this nowShe also had an issue with a leaky gutter so we installed screens for her which resolved that issueWe also gave her a tarp as a good will gesture in case she has any further issues

I am rejecting this response because: Mr Ramerez, is not being accurate or factual with the responseHe stated he would "take care of it" but went on to avoid me and my calls for several weeks despite doing roof work on several of my neighbors homes during that time and passing my house dailyHe then said he would " pay for it by splitting the bill with the structural engineer" He then received the estimate and told me the engineer he chose was not insured and he would now like to split it with meHe also stated he was " married to the jobHe then came up with a plan to tare off siding and dry wall of my home so the second engineer of his choosing could determine if it was the roof that caused the damageBut if HIS engineer determined some other reason I would be left with my homes damages and further now torn apartI asked for an independent evaluation form a neutral 3rd party and was told his insurance would only except his guyI subsequintley found out that was a lie as well when I asked his insurance companyI have lived in the home for years no issues with doors, dry wall, floor tiles or broken windowsAs soon as he put the roof on I have all of these problemsThis is not an issue that requires an engineer its simpleIt requires a man and his company to honestly stand by their work

I am rejecting this response because: It is factually untrue. Mr Ramerez on several occasions said he " would take care of it" . He stated ' he was married to the job". He stated "get it fixed I will pay for it". He then told me he planned on splitting the cost with his engineer who he was now saying he didn't realize didn't have insurance. So he would now need to split the cost with me. This was the opposite of what he had already said. It came on the heels of him going weeks of driving by my house to service my neighbors without stopping of calling me back. Finally he brought a guy named [redacted] to my house who was the Tile sales person who suddenly became an engineer and gave a myriad of ways that it might not be the roof causing the problems. Again this was the opposite of what Mr. Ramerez said previously. Now the solution was to take my home apart and have the party who was responsible for the damage be the ones who decided if it was their fault. Completely unfair and no where near what we talked about through the process. Also, the notion that I have spent my time " running around getting expensive estimates is bogus and misleading. I got the quotes at his requests because he had agreed to pay for the damage. I would invite him to get his own quotes. He wont because he has proven he has no intention of handling this. So now I would have to let the same people tear up my siding, dry wall and framing and if 'they decided what they saw determined it was not their fault they would walk away from my house with even more damage that what the originally caused and simply say doesn't look like our fault. It is also unfair that they keep deciding who the engineer will be. I am not a contractor and I don't know or have " 10 year relationships with engineers that we have both scratched each other backs for a decade or more. That said I simply requested a 3rd party not known by either side. He then said his insurance would only accept his engineers evaluation. When I spoke with his insurance they denied that and the fact he had made a claim he told me he had. Again I am not an engineer I am a consumer that paid a contractor to do a job. Previous to the job my door was attached to my house, my interior doors closed , I had no broken windows , tiles or dry wall. Since I hired this contractor I have all of those things. My hope would be rather than try and figure out all kinds of ways to avoid me and the situation they would just stand to their work, and more importantly do what they say.

Consumer states: The company did come out and settled issues and there are some things that they are still working out but I am thankful they came out.

Bardo Ramirez has been working with Mr. [redacted] for the last 10 years and trust that the suggestions made by him are accurate form start to finish. Our Engineer  had some doubts as to the roof creating the front door problem and [redacted] but  cannot be 100% sure without removing the molding and possibly door casing to look at the nailing schedule of the door casing, previous repairs,  the header and  whether there could be any shims possibly creating movement.  It is doubtful a load on the entry header could cause such a movement.  Also, the front door is not binding-up causing the door not to open. The [redacted]’s stated their concern is the door may fall out. On October 2, 2017, Bardo Ramirez   and a worker went out to the home of the [redacted]’s to pull off the molding and casing as  per the Engineer’s instructions, but was stopped by and told not to proceed by Mr. [redacted]. At this point our intentions were to see and determine if any other signs of weight cause the cracking Doors and windows, then call a Second opinion from another engineer other than [redacted] to take a look at the problem.   At that point nothing is moving forward.  Our opinion is with-out an inspection no one will not be able to determine cause. Should the owner want a second opinion,  we have spoken with [redacted] of [redacted]  (PZSE) who we have agreed to pay to diagnosis the problem.Mr. [redacted] just keeps running around getting expensive (Non-comparative) door estimates and threatening to tell all of our past and present customers in the neighborhood we do not stand behind our work if we do not give him this new door.  Mr. [redacted] is also claiming  Bardo Ramirez said it was Bardo Ramirez Roofing’s fault, this is completely untrue.  According to the engineer the wall has not moved but the door, side lights and casing have slid outward out at the top of the entry.  ·        The estimate the owner has obtained is many times more expensive than a new consistent with the existing entry door and side lights type. ·        Photos are available taken at the time of the meeting at [redacted] and in attendance were Bardo Ramirez and [redacted].   They  show the door has been repaired and painted with touch-up paint in the past.   Please request the photos should you need.·        Photos are available showing a broken window prior to the roofing project starting. At this point, our intentions are not to deny a claim but to determine the cause.   I have filled claims with both my bond and Liability insurance but the general Liability is requesting a seconds report from a Structural engineer that either supports or differs from the first report in order to further to investigate. Mr. [redacted] has not let this proceed.
