My complaint involves shoddy building practices on my home.
I bought my home in 2014 as brand new. The HVAC has never been right. I have had to have freon added every year. Within the first several months I lived in my home my parents were visiting and when I was at work they turned on the heat for the first time. They immediately smelt gas and turned it off. When I got off work we called the gas company and they came out and said it was a slow weak. This is on a brand new unit that had never been used before and it was inspected and signed off on by Escambia County. Luckily this was found before it could have potentially blown my house up and killed me and my family. I have a front porch on the front of my house and when we had a storm with a lot of rain evidently the rain somehow got in, I don't know if the roof leaks or what, but one day the water started pouring out of the ceiling of the front porch.
When I signed the contract to buy my home they were to grade the backyard because if was a significant drop from the front to the back. I hounded them about it but they refused to do it. As a result I had to add a deck which extends all the way from the patio to the back fence so that no one hurts themselves stepping off the back porch.
My patio and the driveway both have cracks in the concrete. The carpeting inside of the house in places has split apart and of course it is getting worse.

I was living in Virginia when my home was being constructed and luckily my real estate agent came by frequently to check up on the builders. I had paid extra for granite, under mount sinks, California blinds among other extras. When the agent came by to check during the build, a couple of times she caught them installing the wrong sinks and one time laminate instead of granite. Even after I moved in I noticed that the kitchen sink was not undermount. It took the builder seven months to get someone out here to fix it.

I recently contacted the builder and they refuse to do anything. I am outraged, especially about the HVAC. It is unconscionable that a builder would install a faulty HVAC system in a brand new home and then refuse to replace or fix it. I used the companies they had me call when there were repairs. Now, they want nothing to do with me. I refused to let it lie. Houses cost a lot of money and I refuse to be left with the results of shoddy workmanship. It is just ridiculous.

Desired Outcome

I would like all defects to be corrected or they can give me the money to pay for all of the repairs myself.

My name is Dave *** and I run the warranty program here at Celebrity Home Builders. Ms *** purchased a home from us on 5/19/2014, at which time she entered into a third party administered warranty agreement with CHB. The warranty agreement covers the entire house for 12 months, with a 24 month "systems" warranty, and a 10 year structural warranty, as outlined by Bonded Builders Warranty Group, the third party.

Even though the warranty agreement is very clear about what is covered, we strive to go above and beyond, in the interest of building good will with our customers. After reviewing the records we have from the applicable warranty period for Mr *** home, I found all of her reported warranty issues have been resolved. Further, I found that we did step outside the warranty agreement and go above and beyond for her on at least one issue that was not covered by warranty.

On 9/13/2018 I received a letter from Ms *** detailing 2 issues she is having with her home, 4 1/2 years into ownership. She claimed that one issue extended back to her warranty period, which required me to go back into her records and confirm. If this was the case, she would naturally be "grandfathered" into the warranty. Unfortunately there is no record to show any such complaint before 9/12/2018 on either issue. This leaves my hands tied as far as the warranty agreement is concerned.

As I responded to her letter, there is just no provision whatsoever in the warranty agreement that allows me to justify moving on maintenance issues 4 1/2 years later. The warranty agreement is clear and concise so as to prevent us being perpetually responsible for homeowner maintenance.

I have attached my response to Ms Iron's 9/13/2018 letter.
The records/photos from her initial warranty period (5/19/2014 thru 5/19/2015) are available on request.

Summary: We stand by the warranty agreement that we enter into with every one of our homeowners, including Ms ***.

We received your warranty request on 9/13/18.

I have done research on the issues, and without documentation that they were reported to CHB as warranty issues inside your 12 month warranty period, there is no provisions in the warranty for me to act on these items 4 1/2 years after closing.
I take pride in advocating for my homeowners, even going above and beyond the warranty as much as I can possibly justify to my employer, but in cases this old, I have no wiggle room.
I apologize I could not push anything through for you.

I am appalled by the reply from the builder. I most certainly will not accept their position.

If they refuse to make right the wrongs and nothing is able to be done through Revdex.com, I will next file a complaint with Department of Professional Regulation for Florida. I also have an attorney and I will file a civil suit it they refuse to make things right.

I am not the only homeowner who has had issues with this builder. My next door neighbor moved in approximately year ago and have had sewage back up into their washing machine and have also had their garage flooded. Luckily my daughter happened to be at home and was able to alert someone or the entire house would have probably been flooded. On our cul de sac there is not proper drainage. So, when we get heavy rain there is no where for it to go.

I just can't believe that a builder can get away with such shoddy practices. There is no reason I should have to replace or pay to repair my HVAC since it has had a leak since I bought the house. I am going to go through all of my paperwork and receipts in relation to all of the problems. I will need them for further filings.

This business accuses me of trying to get them to "fix" my HVAC. They are lying. When I took possession of the house the HVAC was defective, it has a freon leak. When I bought my home I should have not had anything defective. I have explained all of the defects in my original complaint and I am not going to repeat them all again.

I will however repeat that I am filing a complaint with DPOR and if that doesn't work I am hiring an attorney and suing them for damages. I have already started compiling my documents for said complaint.

This company is not done with me yet. And I will do all I can to dissuade any potential buyers of their homes from purchasing a home from this shoddy builder.

We won't get into a back and forth with this owner. We go above and beyond all the time with customers and I believe it shows with the lack of complaints that we have on record especially considering the number of homes we have built over the years. She needs to do whatever she feels like she should do. Remember this is all because we won't service her HVAC system (adding freon, a std $150 service call) on a 4 1/2 year old house. What would you or I be told by the local Ford dealer if we took our car in for brakes or a/c work on a car 4 1/2 years old. She should be careful on social media though. We understand the law when it comes to slander.
