for Property Subject to Mandatory Membership in a Property Owners Association did not require the title company to order a Resale Certificate prior to closing so unfortunately, we, the title company, would have no knowledge of the compliance issue regarding the shrubs. Also, when speaking with the HOA, she stated that the first notice was not mailed until May. This was after our date of closing. Because Celebrity Title does not make a visual inspection of the property, we would have no knowledge of the issues pertaining to the shrubs. I do apologize that you received this notice, but we did our due diligence in respect to the work we were asked to perform. Again, I apologize for any dissatisfaction you are dealing with concerning the HOA requirements. Mr. ** followed up by sending the following response: Thank you for your reply. But I still do not think it is fair for the buyer to pay for seller's violation. I will file a complaint to Texas Department of Insurance for a fair resolution.Unfortunately, we are not in a position to represent either the buyer or the seller in contractual matters, and once a client threatens us with TDI contact, we have been advised by counsel to cease all communication until the official complaint is received.
