***, we do have a phone number and it is listed on our website ***You never mentioned this was a giftWhy not until now?It is a bit odd how you never once have responded directly to why you can't provide proof it was not financed - especially when it is so easy to doJust send a copy of your cell bill.Just do that and I will happily send you the $check

[redacted]I am rejecting this because they have not paid the full amount or returned the phone The can resolve it by doing one of the above.I would think that they would ask such a valuable question on the application process. I would think every phone would be asked this. I didn't answer the Jan 16 email at all or ever. I was accepting there offer of $840. There was never any mention of a recalculated amount. I never said my phone was financed. It was actually from a gift. My response on the 25th was from receiving the check in the mail for $560. When I rejected their recalculated offer of $560 on the same day as receiving it. Their way of informing people of a recalculated amount. When I said NO it was no I am not going to send, not that I couldn't send. I'm sure if I have to, in court, I will get proof from the giver of the gift. I told them again I would take the phone back if they were not going to pay the $840. I have all the emails if you would like them. It's our only communication, since they don't seem to have a phone number.

On January 16th we sent [redacted] an email asking if his phone was financed. We ask our sellers this question because if they owe money to their carrier on a finance plan and stop making payments their carrier will blacklist their phone. A blacklisted phone will not connect to the network so it is...

essentially an expensive paper weight. If we were to resell a phone that was later blacklisted our buyer would be very upset (and rightly so).  We would accept a return on the blacklisted phone issue the buyer a full refund and then resell the phone as parts only/blacklisted at a large loss to us. Therefore, it is very important we know the finance status of a phone. [redacted] did not response to our January 16th email asking if his phone was financed until January 25th, nine days after he received the email. Our terms of agreement stipulate that if we don’t receive a response within 24 hours of your receipt of our email that you have accepted our offer. In this case he acknowledged that his phone was financed. We purposely gave [redacted] several more days to respond, but did not hear from him so on 1-22 I mailed [redacted] a check for $580, the value of his financed (blacklisted) *Phone. By the way, nobody in our industry would have paid anywhere near that amount for his phone without proof it was owned free and clear. Then on January 25th [redacted] finally responds to our January 16th email and says if we aren't paying him $840 he wants his phone back. I explained we had mailed him a check for $580. I said if you will send me proof that your phone is not financed I’ll mail you a check for the $280 difference (840-560=280). During later emails between us we asked again if he could send us proof his phone was not financed. He never responded to that question at all, never sent us proof he owned his phone free and clear. The above is a condensed synopsis of multiple emails between my company and [redacted]. We would like [redacted] to be happy with Cellbeach, we have thousands of past customers who are. Our offer still stands as far as proof that his phone is not financed. The easiest way to show the phone is not financed is to scan and email us a copy of a recent cell phone bill from his carrier. A monthly charge will be on the bill for any financed phones.

[redacted]whether this phone is a gift or paid for or not, was never asked for on the application process. It's not wether I can provide proof, it's that I won't at this point. I rejected your recalculated amount within 24 hours of hearing of it. You should have sent my phone back, but since you no longer have it, my only option is to accept the original amount of $840. These are your terms and conditions. If I go to court, it will be for the return of my phone, a $1150 value
