Initial Business Response / [redacted] (1000, 5, 2015/04/24) */ We received a call from the buyer indicating a problem with their purchaseThey notified us that the phone they purchased (Casio Commando Cfor [redacted] was listed as having a storage capacity of 16GB and GSM compatibilityUnfortunately, for the Cmodel those two features are in correctThe Cmodel only have an internal memory of 1GB and 512GB of RAMThis model only works on the CDMA network with [redacted] Therefore, the phone was advertised as a locked phone to [redacted] without a sim cardWhen we were informed of the issue, we advised the buyer that we do have the correct model they were looking for (c811)However, being that the Cis a newer model, it was higher in priceWe sell the Cfor around $The Cwas only $We advised the buyer that they would have to pay a difference for the model that they actually wantSeeing, that we did indicate on our listing the correct model we are selling, along, with the carrier that this model is only good withThe buyer received what they paid forWhen we found out about the two problems on our listing, we attempted to correct the listing to reflect the correct informationUnfortunately, on some listing the seller cannot change the information without contacting eBay's catalog departmentWhich is the only department that has control over their listingSee as that we list phones on eBay, we have to use their catalog to list our phonesWe notified the catalog department to correct the listingWe also, took down the incorrect information that was displayed on our listingWe contacted the other buyers who purchased the phone, to make sure they didn't experience the same problemHowever, those buyers knew that the phone that they were purchasing is the Casio CmodelSince that information was on the title of our listingOur buyer, who filed this claim, opened a case with eBayWe responded to their case, and asked the buyer to return the phone back for a full refundThis buyer threatened to leave us a negative feedback (which was done) and write bad reviews about our companyAt this time, we are waiting to receive the phone back from this buyer, and to process their refundTheir tracking number for the return package is 1ZXXXXXXXXXXXXXXXXIt is being sent via UPS Initial Consumer Rebuttal / [redacted] (3000, 7, 2015/04/24) */ (The consumer indicated he/she DID NOT accept the response from the business.) CellularStream is a cell phone resellerTheir business is strictly focused in this fieldTo claim that it was a simple mistake and also an [redacted] catalog error is playing the negligence angleIf a car dealership claimed a specific make/model had a Vengine and all-wheel drive and sold it to people with that intent, only for one of their customers to find out that the vehicle actually has a 4-Cylinder and front wheel drive, it would be a very similar situationOffering a refund or having to exchange the original purchase but having to pay more, is an insult to the buyer; as the company falsely represented their product with clear intent and knowledgeThis not a single scenario and this isn't the first time they have sold any type of cell phoneEither they are reputable sellers and willingly lied or they are have no clue what they are doing and they shouldn't be in this line of businessThere are multiple listings by individual persons and other companies, on***, which accurately represent the C771's featuresHow is it that the majority has it correctly advertised but CellularStream happens to be one of the few that "mistakenly" screwed up? [redacted] item number:**SSN**was purchased by me as "NEW AND NEVER USED" cell phone however that is simply not accurate for a number of reasonsSeller sticker inside the phone box states "tested, ready for REUSE", Sim card removal tool is MIA, protective plastic coating is MIA on phone, no seal on the box, not original box, no headphones, etcso this was a USED PHONE...NOT "NEW NEVER USED" AS this seller DESCRIBE IN THE [redacted] LISTINGDo not do business with cellularstream or [redacted] *** who is a known cell phone refurbish service provider, not a retailer of NEW cell phones BEWARE!!!

Horrible company and ridiculous return policiesI ordered a [redacted] off of their website and I was told it was new, however it was water damaged and clearly a used itemdid not come with hardly any of the accessoriesI contacted them to get a refund, so I returned the phonei was then told that they would take 20% off of my refund due to "damage to the back" this is ridiculous as they illegally sold me a used damage phone that I was told was new, then refused to give me my full refund backI was unable to get my refund back from cellular stream, so I had to contact [redacted] and [redacted] to dispute my charges..ridiculousnever buy from this sellerthey are scammers

We received a call from the buyer indicating a problem with their purchase. They notified us that the phone they purchased (Casio Commando C771 for[redacted] was listed as having a storage capacity of 16GB and GSM compatibility. Unfortunately,...

for the C771 model those two features are in correct. The C771 model only have an internal memory of 1GB and 512GB of RAM. This model only works on the CDMA network with[redacted] Therefore, the phone was advertised as a locked phone to[redacted]without a sim card. When we were informed of the issue, we advised the buyer that we do have the correct model they were looking for (c811). However, being that the C811 is a newer model, it was higher in price. We sell the C811 for around $90.00. The C771 was only $49.00. We advised the buyer that they would have to pay a difference for the model that they actually want. Seeing, that we did indicate on our listing the correct model we are selling, along, with the carrier that this model is only good with. The buyer received what they paid for. When we found out about the two problems on our listing, we attempted to correct the listing to reflect the correct information. Unfortunately, on some listing the seller cannot change the information without contacting eBay's catalog department. Which is the only department that has control over their listing. See as that we list phones on eBay, we have to use their catalog to list our phones. We notified the catalog department to correct the listing. We also, took down the incorrect information that was displayed on our listing. We contacted the other buyers who purchased the phone, to make sure they didn't experience the same problem. However, those buyers knew that the phone that they were purchasing is the Casio C711 model. Since that information was on the title of our listing. Our buyer, who filed this claim, opened a case with eBay. We responded to their case, and asked the buyer to return the phone back for a full refund. This buyer threatened to leave us a negative feedback (which was done) and write bad reviews about our company. At this time, we are waiting to receive the phone back from this buyer, and to process their refund. Their tracking number for the return package is 1ZXXXXXXXXXXXXXXXX. It is being sent via UPS.

CellularStream is a cell phone reseller. Their business is strictly focused in this field. To claim that it was a simple mistake and also an[redacted] catalog error is playing the negligence angle. If a car dealership claimed a specific make/model had a V10 engine and all-wheel drive and sold it to 26 people with that intent, only for one of their customers to find out that the vehicle actually has a 4-Cylinder and front wheel drive, it would be a very similar situation. Offering a refund or having to exchange the original purchase but having to pay more, is an insult to the buyer; as the company falsely represented their product with clear intent and knowledge. This not a single scenario and this isn't the first time they have sold any type of cell phone. Either they are reputable sellers and willingly lied or they are have no clue what they are doing and they shouldn't be in this line of business. I have left negative feedback, I have filed to have a one-to-one exchange through[redacted], and I will continue to make sure that others know that CellularStream has done nothing to help the 26+ buyers, which were also lied to. This was an error on our listing, that was addressed to us. We took the correct action on correcting this issue. We have updated the listing to show the correct features the phone offers, and as mentioned before contacting our buyers to notify them of the error. However, since the title of the listing did state that the phone we're selling is the Casio Comamndo C771 not C811, our buyers knew that the phone they will be receiving is the C811 model. Once we receive the phone back from the buyer, a full refund will be provided within 1-2 business days. Once the refund is processed, we'll send a follow up email to the buyer with their confirmation number.

Ebay has refunded me because I refused to allow CellularStream to handle any more deals with me. They have done nothing but dodge all responsibility in this manner and they shouldn't be in business period. I have nothing more to say about this situation.
