He did sign a contract with us and a deposit was paid to us as described.  Mr [redacted] did not have to miss work, he wanted to be there for the day we were to do work. I scheduled two days for this job, because we are working in a small town with a small town inspector and a utility company that...

puts outages and etc before disconnecting and reconnecting services for work.The town of Brazil Indiana has one inspector he is not full time, you have to schedule for them and the utility company to be there the same day. This can be a problem and I have seen it many times but customers have always understood that the local jurisdiction (i.e) Utility company and local inspectors have the authority not the electrician. We cannot control the utility company nor the local town hall.
In this case the utility company could not be there early enough on Thursday 8 October to complete and get an inspection.  I called Mr. [redacted] and told him I would schedule on Friday the 9th of October.  Duke energy stated they could be there at 8;30 am I then called the inspector in Brazil and he was not working that day (9 October).  I called Mr [redacted] and told him this would not work because of scheduling, he then stated what was my plan I told him we could do it on Monday 12 October.  He stated that won't work he wanted a refund. 
I am licensed in Brazil Indiana and I am sending a copy of the permit that was filled 7 October 2015. He stated I lied about licensing and scheduling, false assurances again I scheduled two days for this myself and I do not control those who I have to abide by to do a job properly.
We spent our time going to the town hall getting permit filed.  Even though this was a binding contract I agreed to refund minus 10% for time already spent on this job.  I explained to him that we pay out on the 3rd and 24th.  The 24th was a weekend, as of today his check has been mailed in the amount of $466.20.
A complaint was filed on October 14, 2015 even though he agreed to the terms to resolve this matter, he prematurely filed this claim.
In closing of this matter ERI Electric was ot the one who could not follow through with this matter nor keep appointed scheduling.  The utility company and the town inspector could not meet his schedule. I explained this to him at the time we talked at the signing of the contract.
