The vehicle in question was towed per order of the *** Police department for being an unregistered/insured motor vehicle on a public way. The vehicle owner, *** ***, came to the body shop to retrieve his car. He did not register nor insure the vehicle. He was told what the
charges were. He called several times and said he was on his way to pay the bill, he never arrived.Per MA General Law M.G.LCS.39A: The vehicle was auctioned off to pay the fees. The new owner applied to the registry of motor vehicles and received a new title to the vehicle. Mr*** was sent certified letters advising him what would happenThree legal ads were in the newspaper advising the public as to what was going to happen. Mr*** was then sent a letter telling him what his car sold for at auction and what balance he owed after the auction

On 11/25/2015 @ 7:15 AM Center Auto Body received a call from the [redacted] Police Department requesting a tow for a disabled [redacted] Commander.  The officer stated that vehicle was in a bad location and needed to be moved ASAP.  We arrived at 7:30 AM and towed the vehicle to our storage...

lot.  The owner of the vehicle asked if we could tow the SUV to [redacted] where he purchased the vehicle.  He was advised that as long as they are willing to pay for the tow we could tow that to them. Mr.[redacted] called [redacted] and was told by a person that answered the phone that they will not pay for the tow.  Mr. [redacted] was concerned about the storage rate for the tow.  He was told that we will be closed for Thanksgiving and on Friday.  He stated that he could not come up with the money right now.  He was told that we will only charge him for the tow and one day of storage.  The tow and storage rate are regulated by the Commonwealth of MA.  We do not make up our own rates for police ordered tows.  The actual amount that Mr. [redacted] should have been charged is $197.07.  We understood the difficult situation the Mr.[redacted] was in when the [redacted] refused to pay for the tow after the [redacted] broke down.  We gave him a discount in an attempt to make a bad day not so bad.  As far as arriving at the shop at 6:00 PM to retrieve his car.  That might have been true but it was the night before Thanksgiving and we tow cars 24 hours per day but the physical building is not open 24 hours per day.  Secondly Mr. [redacted] arrived after normal business hours to retrieve his vehicle with out bringing the agreed upon $130.00.  He returned on Friday 11/27/2015 to retrieve his vehicle.  He had the agreed upon figure and was not charged the two additional days of storage.  The tow driver for Center Auto Body spoke with Mr.[redacted] and states that he was pleasant and happy except for the fact that his recently purchased vehicle wont start.  He paid the bill with out reservation and left with his vehicle on the back of the other ramp truck. The tow should have been: $90 , fuel surcharge of $2.25, storage of 3 days at $35.00=$197.50.What was charged: tow $90.00,storage of 3 days $40.00 no fuel surcharge.= $130.00
