Dr. [redacted] is an excellent physician who specializes in Sports Medicine and practices at IU Health Physicians Orthopedics & Sports Medicine.  Dr. [redacted] does not normally accept Worker’s Compensation patients, but due to a clerical error accepted this patient.  Dr. [redacted] saw this...

patient on four occasions.  He thoroughly examined this patient, properly diagnosed him and treated him.  Dr. [redacted] completed all of the requested paperwork from the United States Department of Labor’s Office of Workers’ Compensation Programs.  This patient is angry because Dr. [redacted] would not cooperate in this patient’ attempt to defraud the United States Department of Labor’s Office of Workers’ Compensation Programs.  This patient filed a claim for Traumatic Injury indicating that he sustained an injury as a result of his employment as a Nurse with the [redacted] of [redacted] in Indianapolis.  The patient claimed that he was injured because he carried two bags of nursing uniforms, with a combined weight of 12 pounds, into the [redacted] Medical Center.  The patient’s claim was denied.  The United States Department of Labor’s Office of Workers’ Compensation Programs’ Notice of Decision states: Specifically, your case is denied because the evidence if not sufficient to establish that the medical condition is causally related to the accepted work event(s).  The reason for this finding is that your physician has failed to provide a clear and accurate history of your claimed traumatic injury of 08/25/2015.  Furthermore, your physician has failed to provide clear, detailed, and unequivocal opinion as to how lifting two bags, weighing approximately 12 pounds between the two, resulted in the claimed condition, lumbar paraspinal strain.  The medical evidence lacks any discussion regarding the item you lifted; it merely claims that you had carried a plastic bag “full of your old uniforms” from the bus stop to the uniform office.   This patient believes that this, not unexpected, result was caused by Dr. [redacted] failing to fill out forms; however, that is not the case.  Dr. [redacted] truthfully completed all the requested paperwork, but his expert medical opinion is that this patient’s injury was not caused by this “event.”  The patient would like Dr. [redacted] to opine that his acute lumbar paraspinal strain and spasm was caused by carrying two laundry bags, but Dr. [redacted] will not do so because it is not true.                    Dr. [redacted] was accompanied by a Fellowship physician during all of his encounters with this patient and dealt with the patient in a professional manner at all times.  Barclay W[redacted]Drewry Simmons Vornehm, LLP 736 Hanover Place, Suite 200 Carmel, IN 46032 (317) 580-4848(main) (317) 713-6052(direct) (317) 580-4855 (fax)
