I contracted *** (Centermark Group) on March 25, 2020, to replace floors and paint walls in the home I was moving into on April 18, 2020. By April 30, 2020, he had finished less than half the work and left the house uninhabitable. By May 4, 2020, he had not been to the house in five days to work and had removed all of his tools and personal effects from the house; he had walked off the job. Our contract stated the house would be finished by April 16th and that the final payment of $6,430 would be due on that date or when the work was completed. There was a $1,500 down payment to start the work paid on March 25, 2020, when the contract was executed. An additional $6,430 was paid on April 8, 2020, per the contract terms, making the total payment to *** (Centermark Group) $7,930. However, only $4,657.51 of estimated work has been completed making an overpayment of approximately $3,272.49. Because I refused to make the remaining $6,430 payment until the work was completed (per the terms of the contract) *** has refused to complete the work, and explicitly stated that in a text to me. He has also taken the custom cabinet doors and custom drawers from the kitchen and utility room and refuses to return them until I pay him the balance of the contract, even though #17 in our contract states "upon expiry or termination of this agreement, the contract will return to the client any property, documentation, records, or confidential information which is the property of the client". There is no collateral for the contract and he did not complete the work. His services were terminated by me for lack of work progress completion, refusing to do further work until I paid the balance of the contract (outside the contracted terms), and walking off the job. He is also threatening to file a mechanic's lien against the property, which I do not own. The homeowner did not sign the contract.

I hired Centermark, here in Corpus Christi Texas, in December 16th 2019 to fix my home after a mold remediation project. It has been 5 1/2 months now and they are far less than even half way complete with my house. We were originally told this project would take 3-4 weeks. They have been paid in full since February. It has been one excuse after another. Lastly, *** the owner, told me that his truck broke down and he needed a truck to complete my house and he needed to borrow the money from me so he could get this truck. He asked to borrow 7000.00 for 3-10 days. I reluctantly loaned him this money out of desperation to get my house finished. It has now been over a month and this hasn't been repaid. This whole project has been a nightmare. I bring this to your attention because he proudly stated in the beginning his association and good standing with the ***. Is there anything that you can do to assist me to get my money back and to get my house finished? ANY help, direction or advice would be greatly appreciated. Thank you
