This is in response to the complaint: 1. We did scrub the number in question attached is the website that shows this number is not on the Do Not Call list. So we did not violate the Do Not Call Compliance. I would suggest if you thought you were on this list to re-add your
number as it is not listed with them as a number not to contact. 2. If in fact the Columbus Police Department was contacted asking how we would have got her number they should know that Accident Reports are public records. We do reach out to people involved in accidents as we are a Collision repair shop and this is one way we bring in business. We sent one text message to this person it is a lengthy text that sometimes splits into multiple texts when they receive it. She did call our shop yesterday and ask how we obtained her information and we explained to her how it was obtained. She at this point made up a ridiculous story stating that she called the Columbus Police Department and that they told her we were driving around town causing accidents, so we could then contact people for business. How would we have randomly hit a car and then known how to contact this person, not possible. Again accident reports are public records and this is how she was contacted. She was not listed on the Do Not Call Registry. I do apologize if she did not want to do business with us, she just simply had to ask. Central Collision did not do anything wrong this is legal to solicit business in this manner. She has been removed from our contact list. It is sad to have a complaint listed with the Revdex.com and we did nothing wrong

I am rejecting this response because:My only issue with their response is that I didn't make up any ridiculous stories. I just told them what the CPD told me and warned them that the CPD may contact them in my accident investigation. I was trying to be nice. That's all. I reported them to the Revdex.com because when I called the woman on the phone was rude and hung up on me, which was confusing if they were trying to solicit my business. I certainly won't ever do business with them now. Nor will any of my family members (all car owners in the central Ohio area) - one relative manages a fleet for Medical Mutual of Ohio. So their tactic is really a big fail. And, yes, my number is registered on the Do Not Call Registry

I have attached again the website that shows we did scrub the number and it showed ok to call.At this point I don't know what she wants, she isn't a customer of ours and we reached out to her to her do to a public record about an accident. When she called yesterday and stated the Columbus Police Department would be contacting us about her Hit Skip Accident because we could be involved. I explained then that I did not know why the police department would ever say something to that nature. Again we are a Collision shop and this is common practice from shops to reach out to people involved in accidents. The Columbus Police Department should be well aware of this and if they did make accusations that we may have caused her accident just to get business then again this seems completely ridiculous. We apologized and she will not be contacted again

The business has still not addressed ALL of the required actionsOnly number one out of the four required actions has been addressed with the business's responseThis includes the requirement BY LAW to register with donotcall.gov for the full list of do-not-call numbers for both calling and texting purposesBy law, texting still requires the additional requirement of an existing written permission from the owner of the cell phone number prior to being texted.1) This business will cease and desist all contact[Addressed by Business response]2) This business will immediately register for a subscription to the database maintained by www.donotcall.gov and then maintain that subscription until such time as they cease advertising to the public via phone or text, including texts originating by email[Not addressed by Business response]3) This business will submit itself to both the FCC and FTC for sanctions based upon their violations of the do-not-call mandate for any and all numbers called or texted that are currently found in the database from www.donotcall.gov[Not addressed by Business response]4) This business will immediately cease and desist all phone and text solicitation until it has implemented all of the preceding requirements[Not addressed by Business response]

I have called this lady everyday for the past going on weeksShe will not rerun my calls I should not owe them anything since I have Ben working on this and they will not talk to me She also hung up on a call with my finance and insurance company How can this get resolved when she is lying??? Why would you fix a car that is said to be totaled?

Yes the customer did bring their car to Central Collision for repairs. They signed the attached authorization for repairs, which states if Central Collision does not repair your vehicle there will be charges due to pick the vehicle up. We did the teardown which is to reveal any
damages that are behind the bumper and wasn't visible to the insurance company during their initial visual estimate. Customer was never told they no longer own the car. Customer was told in order to have the car released back to them and so Central Collision will not to be held liable to have the car released back to them that a few things had to happen: Fees had to be paid, (which insurance would pay if the car was being totaled by them and they won't pay because customer is canceling their claim with the insurance company)so this is now the customers responsibility, we would need a letter from the customers lender, insurance company and the customers stating they are allowing the customer to take the vehicle back knowing it was a total loss car with frame damage and Central Collision is not liable for this vehicle being given back to the customer. Customer was not told to leave the building I tried to talk to her and she kept getting angry and threw her rental car keys on my desk and left. I never told the customer they owe $I have not given them a total of what is due because I just spoke to their insurance company last night and told the adjuster I would figure fees and give them to her today. I never told the customer that Central Collision owns her vehicle. The process is once a car is totaled the insurance company takes the vehicle and pays the fees. Because this customer is electing to keep their vehicle they are now responsible for the fees and again in order for them to get the vehicle back Central Collison requires the fees be paid, the lender put in writing they are ok with the customer taking the car back instead of having it totaled out as well as the insurance company. Also we will need a letter from the customers as well that they are aware that the car was totaled out by their insurance company. The total fees due as of today are $and go up by $a day for storage + tax. The forms of payments we accept are cash or money order. Once all of this is received then the customer can have their vehicle back. This has been explained to them, their insurance company and their lender

Contrary to the claim by the
business, I did receive successive text messages in violation of the lawI also have the do-not-call confirmation showing that my number has been listed for years (aka more than days) prior to that contact by the business or by another party on behalf of the business. The response from the business is little more than a platitude without merit or substanceAs the business has clearly violated the law, they are required to perform the actions requested.-------------------Do Not Call confirmation of registration:Subject: National Do Not Call Registry - Your Registration Is ConfirmedThank you for registering your phone number with the National Do Not Call RegistryYou successfully registered your phone number ending in on February 12, Most telemarketers will be required to stop calling you days from your registration date.Visit https://www.donotcall.gov to register another number or file a complaint against someone violating the Registry

In regards to this complaint. We did do repairs on this vehicle it was very minor and some of the parts per what their insurance paid for were recycled (used), which was the engine cradle and this is what was replaced with a used part. Per the authorization they signed it states the
actual repairs may differ from what the insurance company estimate was. The radiator hose they are referring to was not actually on the insurance estimate it was disconnected from their vehicle and this is what caused their vehicle to over heat, so it was reconnected and coolant added to get it back to the correct level (so this is actually something we did free of charge). This also went to Goodyear and had an alignment done as well

I reviewed the response made by the business in reference to complaint ID [redacted], and find there is no way to prove if the work was done or what happened to the car while in the collision centers possession. We had to replace the McPherson struts immediately after getting the car back of which was not an issue prior to leaving the car.  There is no point arguing over used parts! But, will end our compliant unresolved.

I reviewed the response made by the business in reference to complaint ID [redacted], and find the resolution is satisfactory to me.
Regards,
[redacted]

Again we apologize you were contacted.  We do scrub numbers before they are contacted.  Your number has been removed from our contact list you will not receive any further contact from us.

I do apologize that you were contacted.  We do scrub every number prior to contacting them. If they are listed on the do not call list we do not contact them by text or phone call.  The only thing they would receive from us is a postcard in the mail.
