on 3/02/ [redacted] came in to are store and purchased a new Corsicana Kennedy setThese mattresses come straight from Corsicana manufactures in a completely sealed bagAs of the mattress being defective there issue with the mattress is not being ripped torn or fabric stretching or a spring popping out that mattress is not defectiveas for the issue of the mattress being used, it has a manufactured date on itsince the mattress is now used we can not do any kind of exchangeunfortunately if you are allergic to the mattress that is not a warranty issueit is your responsibility to know If any thing in the product will harm you .Like allergens or any thing of that nature, it is your responsibility to notify us if there is anything in a mattress that you could be allergic to , and to do research ms [redacted] me about the issueI explained to her that she purchased a new mattress has been pulled out of plastic is considered a used mattressThey have slept on it and have been sick for unknown reasons on the mattress it selfNow that it is a used mattress we can not sell it or send it back to manufacture because it is not a warranty issueSo there for I would have to dispose of the mattress I have also explained to her to try and sell the mattress to purchase anotherThey are saying that it is causing health issue for her entire yet said it has sent only her to the urgent care twiceif it has sent her to urgent care once why would she keep and continue to sleep on itAfter the fist time to urgent care? Mr & Miss *** came into the store (Friday October 14, 2016) to purchase two floor model twin mattresses onlyIt was clearly stated to the couple that our floor model mattresses are "As Is", "No Cash Refunds", and "No Exchanges" That they are floor models they've been displayed and comes
from other store floors and warehouses up and down the pacific northwestThe definition of a floor model states, "A floor model is a piece of equipment placed in a retail shop's sales area for display purposesFloor models are taken out out of their packaging and displayed how they would be usedBecause floor models see considerably more use and are subject to more wear and tear than they would if they were not used for display, stores may sometimes discount them when selling them." With the information they received and to their consent, the couple fully inspected, chose the two mattresses and purchasedThe next day (Saturday October 15) I received back to back phone calls from a private number with them approaching to me as a solicitor, the reason being I hung up the phoneThe couple then called shortly after stating they've disputed their credit card purchase (before getting a hold of the business to resolve any problems the couple may or may not had) and wanted a refundI reminded the couple of our store policy that we don't give back any cash refunds or exchanges and are as isThe couple came into the store with the two floor model twin mattresses voluntarily and left the product at the store with them knowing we don't take back sold productThey made threats to contact the health department, the Revdex.com and anyone else they could to my business and as a business owner I take that as threats to my business and with the husband calling me names such as "Psycho" and him becoming more angry, I asked for the husband and wife to leave my storeMr & Miss *** needs to take full responsibility in the purchase they've made and advise them for future purchases they make to other businesses to contact them prior to making a dispute if they have any problems and not attempt to get more product out of them all in one transaction, that's called theftOnce again, when you dispute a credit card transaction and still have the product, that's called theft

First of all, I did NOT cuss out the employee I called and said that it was obvious that the mattress was used and I felt like he had lied to me and cheated me There was NO cussing involved He never did say to speak to his boss, just proceeded to hang up on me
In response to the text where I allegedly "cussed" him out Also incorrect I simply asked why he had hung up, and that I would proceed to post a negative response on their facebook page as well as submit a claim to the Revdex.com.
It is correct that I got home from purchasing the mattress, only to find that I had not been given a receipt That was not a problem, because he was kind enough to write me another one to give me upon delivery
Yes, I was told that the mattresses were sold "as is", but was also told they were not used Upon taking the plastic off of the mattress, I notice two patches covering apparent holes, and several spots that were extremely worn, with the threads and fabric fraying off of the mattress I had no reason to lay down on the mattress at the store, since I was under the impression that they were new, and would not have a lot of wear from being slept on My husband, after seeing the condition of the mattress, went online to view reviews of this company, only to find that several other customers also realized that their "new" mattress, was not new
I would be happy to provide pictures of the mattress with the patches and worn spots

Thank you for following up on my complaint against Central Oregon Sleep Center.
The business response was much how I anticipated it would beBasically stating that selling mattresses “as is” gives them immunity towards addressing customer complaints. My concern remains that other consumers will purchase mattresses they will not realize are damaged or worn out until they have slept on them for a while at which point the business will do nothing to resolve the issue. I would like to see the business post signs that mattresses may be damaged or heavily used floor models and they will not address customer complaints after the purchase is completed

On 12/27/15 [redacted] came to the shop. My employee had helped her out she asked for a full mattress and boxspring set . As she was showed the mattresses that we had in stock she had asked if they were used . He told her no, that they were Floor model mattresses. She...

had said no problem and proceded to pick out her mattress and box spring . Once she had picked out her mattresses  with out lying down on it or testing. She had said she was getting it for her daughter and did not need to lay on it. They then went to write the reciept he had  explained to her that our beds are as is & that we do not do any kind of cash refunds or exchanges and she had no issues with that. She then signed her receipt stating that there was as is & no cash refunds or exchanges and asked if we could deliver it on 12/30/15.   She was givin a businesse card, She had called a day or two before the delivery  and stated that she was not givin a reciept, and was inquiring about her delivery time.
    Approximately 12 o'clock on 12/30/15 my employee  delivered her mattress &  a new reciept she had him  set the mattress set off to the side and he left. A few hours later at approximately 2:14 p.m. 12/30/15 my employee  received a phone call from her, calling him names cussing and screaming at him that he had cheated her, stole from her, and lied.  So at that point he had told her. You need to speak to my boss then he hung up. She then proceeded to harass him through text message persisting & calling him names and cussing and screaming at him.  At no point did she attempt to get ahold of  me about this issue.
     In her statement it says that he told her that these beds are new floor models which he did not he told her they were floor model mattresses. Our new mattresses come with a warranty (if she had bought a new mattresses she could have used the warranty. )  Floor models mattresses are As Is, and come in clear plastic with no warranty.  Once they are out of plastic they are considered used. Also stated "that the company refused to do anything about the false advertising and then hung up on me". The reason he hung up is because she was yelling, cussing, and screaming and calling him  names and this issue did not concern my employee. Also he had told her to call me. As far as the false advertising goes there was no false advertising. He told her before she picked out her bed that they were floor model mattresses  that have  never been in any body's  home, slept on or used, but they had been  on the floor for people to test out. "not new".  
    I will also be  intelling pictures of her receipt that she signed stating that they are" as is" and that there is no cash refunds. What's more she has not declared what the issue is with the mattress besides the fact that we supposedly told her it was a "New" floor model mattress. She has not stated any issue with mattress it's self. (rips,tears,odors etc) stating there is nothing wrong with the mattress it's self. A new floor model is a oxymoron. ( you have new, or floor models).
    SHE CAME INTO THE STORE AND PICKED OUT THE MATTRESS. SHE LOOKED IT OVER AND SAID IT WAS THE MATTRESS THAT SHE WANTED EVEN THOUGH WE HAD A LOT MORE OF A SELECTION . SHE HAD NO ISSUE IN THE STORE OR APON DELIVERY ABOUT THE MATTRESS SET.
1st picture is her receipt which shows her agreement to the as is and no refunds also that she had picked out her bed and had no issue with it .
Second picture is to show that all of our floor model beds have the as is written down on the plastic to keep any confusion at bay that our beds are as is no matter what.
 
SHE DID NOT BUY A NEW MATTRESS AND WE DID NOT STATE IN ANYWAY THAT IT WAS NEW, IT WAS A FLOOR MODEL MATTRESS SOLD AS IS- NO WARRANTY.

on 6/4/16 [redacted] came to the store to purchase a mattress set. he was told it was a floor model as is he was allowed to lay to test out comfort. at that point any sags or worn  out spots in the mattress should have been seen felt or noticed by him . he was then...

told if the mat was adequate to what he was looking for. he had obviously liked the set due to the fact that he bought after tested it out. if there were any issue with the mattress why would you wait for two plus weeks  to call AND LET US KNOW even after there was a IN STORE  exchange for the original mat. fact is like you so pointed out they are ASIS, NO CASH REFUNDS, AND NO EXCHANGES. If did not like the mattress that you tested and looked over and liked. you should not have purchased it or took it home . we do not know what you have done to that mattress in the last two weeks for all we know your renter could have damaged it. if you had a issue with it why did you not get ahold of me when you unwrapped?

In regard's to the fact of buying the mattress "NEW". When you were talking to my employee he told you that they were floor model. That means that it is not new. it has been on the floor to be displayed, and tested. why would a company sell a mattress set new with no warranty? in regards to you buying something as is do you not look over the product you want to perches? ,its not like that was the only mattress that we had for you to pick out from.
as for noticing patches, spot, extremely worn spots. threads and fabric fraying off the mattress. once again you purchased a floor model mattress. something that has been displayed on floors, layed on , looked at ,thrown around. with you being under the impression  that it was a new mattress we never stated it was "NEW". we stated it was a floor model mattress. which is why it was stated on the plastic and receipt. my employee stated this to you several times that they are floor models not new with warranty.
     if you are under impression  it is a new mattress. then why did you buy a new mattress that had patches on it, or no warranty.  You state in here that a new mattress would not have a lot of wear from being slept on. a new mattress is new. floor model mattress Is  displayed on store floors. for up to a few years. in regards to her husband looking online at our complaints. there is two bad reviews. in the five years we have been open. we have a lot more good reviews then bad, of people that enjoy there floor model mattresses. they looked over there as is product before purchase and understand that the mattress is not "NEW".in statement if they bought a new mattress it would have a warranty and we would gladly exchange it. but they bought a floor model. meaning NOT NEW NO WARRARTY. while you were in the store you were looking at another mattress and desired to go with that one. as for the cussing , it is a expression and when you call some one yelling slandering a company that gives them all right to tell you to  call the boss and hang up. and you know that the one you called was not the boss. you had my number and could have simply called me. not my employee!
