I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to meHowever, I would like to add that the promises made on 12/1/2016, are just another in a long line of promises made by Central Paving,IncThey contacted me in 11/23/and said they would be here by 12/2/Now they are saying they will be here No later than 12/9/Because of their history of broken promises I can not trust that they will comeI did advise them of a secondary heat source, but I also advised them that the pellet stove does not hear my entire homeThey did advise me in August that it may be fall before they would be hereBut they made promises to come since the end of September

The partial payment was a verbal discussion with ***The project was 90% complete when we received the payment of $11,was in contact with *** throughout the project*** was told the Village of Ilion water department was called when we were on site in NovemberThe Village Water Department representative *** *** informed us that the village will not allow installation of water taps in winter monthsIn this case the water sewer and concrete floors were on hold until the ground Is frost freeThis was also stated in our letter to *** on 2/5/This project has since been completed

concreteThe day our crew was pouring the concrete floor Mr*** asked them to put door threshold that fell off Into wet concreteThe crew did do ask he askedWeeks after project was competed and paid for, Mrs*** called the office about a gap between bottom of door and threshold.The owner of Central Paving IncFrank *** met with Mrs*** and brought along a carpenter to observe her complaintThe carpenter replaced the threshold to her satisfactionIt wasn't until February when Mr*** called the office to complain about water melt near thresholdWithout a floor drain system which was not there before nor can there be one Installed, Its common practice to pitch the concrete floor so water runs to front of garageCentral Paving advised Mr***what needed to be done and he Insisted on using old threshold and Installing It Into fresh concreteIce Melt off vehicles Isn't under our controlPer Central Paving Inc.contract agreement no warrantee exist on concreteI have attached a copy of the agreement for your use

For your reference, details of the offer I reviewed appear below.The original floor in the garage did have a drain in the center of the floorWhen we were getting quotes the owner Frank advised my wife and myself that per a law there cannot be a drain in the garage due to oil pollutionThey advised me that the garage floor would have to slope towards the front (garage doors) of the garage to disperse the waterThe slope is not properly draining the water from the car that is in the garageThe water pools up about a foot from the garage doors then flows towards the single side doorIn the winter months the water freezes and causes a slip and fall issueThe door that is on the side of the house had a threshold that was on top of the prior floorWhen they excavated the old concrete they dug under the thresholdIn doing so they knocked off the bottom of the thresholdI did talk to the foreman prior to leaving for workI advised him that I wanted the threshold the same way it was prior to them removing the concreteThe foreman was not one of the ownersIt was only after getting mice in my garage that I noticed the gapWhen I called the office they did come out with a carpenter to fix the gapIt was an acceptable fix per the situationPer our agreement the slope of the garage floor which was to slope towards the garage door not the exterior single doorWater flows towards the garage door then slopes towards the side door and pools upSo the original slope of the floor was not properly done. Contract agreement was 1/2 down payment, and balance due upon completion. The project walls were completed by Thanksgiving as discussed with [redacted]. Project will continue on February 10, 2014 installation of water line (WEATHER PERMITTING). The pouring of floor will be determined upon weather conditions.

Original contract is attached to this email. There is NO MENTION of a need for a partial payment.
Despite this fact, we DID pay the 1/2 payment requested on 2.6.14. Attached is a copy of the cancelled check from [redacted]
Also attached is proof that [redacted] received this check on 2.7.14. He picked it up from me at my place of work, in the parking lot. I find it hard to believe that he does not remember receiving it. At that time I handed him a check, a letter dated 2.6.14, and a copy of the original contract. I asked him to sign for these items and that proof, with his signature, is also attached.
The letter dated 2.6.14, copy attached, outlined my COMPLETE frustration with the handling of the project by Central Paving. It goes into detail the many problems and delays we've had, all due to their lack of follow through. Despite receiving this letter in early February, no one at Central Paving ever contacted me with a resolve to my concerns.They completely ignored the situation. They keep falling back on the "weather permitting" excuse. But, there were MANY opportunities of good weather between the signing of the contract on 10.23.14 and today. Their crews have been all over the [redacted] working on other projects and my project sits incomplete for MONTHS! And, the work that needs to be done is now, and has been since the 2nd week of November, under a roof and enclosed in the structure. I was told, several times, that weather will not be an issue. They will complete by the end of 2013.
You will notice that his letter to me on 2.5.14 states that if 1/2 of the payment was made they would begin work on 2.10.14. In good faith, I paid him 1/2 of the contracted total on 2.7.14.NOTHING has been done by Central Paving on this project since Christmas week 2013. The "weather permitting" excuse doesn't fly. The building is almost completely enclosed and he mentioned on SEVERAL occasions that they can "warm it up enough" to continue work.
PLEASE reread the letter I submitted to [redacted] on 2.7.14. It goes into complete detail all of the problems we've encountered.
YES, he has said that work would continue on Monday 4.14.14. I would think that typical springtime weather would not keep him from starting on Monday and finishing next week.

While paving and repairing bridge I repeatedly asked not to block my driveway but again today for this fourth time I am again ave no exit from my home on [redacted] Road. I am 68 years old and what if I had an emergency.
