May 19, 2015Dear [redacted] :Per your request, I write to respond to the above-referenced complaint you received on May 9, regarding the Central Pennsylvania Youth Ballet (“CPYB")A true and correct copy of CPYB’s Refund Policy is attached heretoThis document can also be accessed via the hyperlink “CPYB Refund Policy,” which is clearly listed on the tuition page of the 5-Week Summer Ballet Program handbook: [redacted] CPYB has returned to the customer all amounts identified as refundable in accordance with the terms of the Refund PolicyAs noted therein, “There will be no exceptions to these policies.”The customer states: “It is absolutely outrageous that [CPYB] would keep $tuition and re-sell the same spot for yet another $tuition.” This is simply not the case; CPYB has not “resold” the spot, nor has it “double[d] [its] money on one spot,” nor does it “bank on the fact that children will become injured,” as the customer claimsThe Refund Policy provides, “Those students who suffer a major and debilitating injury preventing any dancing after full payment of fees but prior to June may submit a letter of explanation from a licensed physician; at that time, CPYB will consider renegotiation of credit for the following year’s Program.” The student is more than welcome to participate in the 2016Program.' To that end, and in accordance with the terms of the Refund Policy, CPYB is happy to reserve a space for this student in next year’s Program and apply the non-refundable tuition credit accordinglyTo be sure, this practice goes above and beyond industry standardsThank you for your attention to this matterShould you have any questions or concerns, please do not hesitate to contact meSincerely,Nicholas AChief Executive Officer

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: There policy is NOT clearly stated when you register for the programIt is buried under a multiple of hyper links in a student handbookWhen you register the only policy that is visible is that there are no refunds on security deposits and annual registration fee, see attachedTo bury the policy on tuition refunds under multiple hyper links is an extremely deceiving business practiceThere is no reason that it should not be stated on the same page as the one I attached, unless they do not want you to know when you sign your child up for the program Additional MrA [redacted] lies! There website said when I informed them that [redacted] would not be able to attend that they were only accepting applicants off the waiting listNow the website says that the program is completely filledThis clearly means that they have in fact filled the spot that [redacted] had and have accepted an additional $tuition for the same spot, twiceThis clearly demonstrates their policy is designed to profit from children becoming injured prior to the program There is no chance of [redacted] attending the program next summer as she will be studying abroad and not be here to attendAlso from reading Mr A**'s response you could assume that this heartless CEO would treat the death of a student the same as any other reason to withdrawjust another chance to double his revenue! May 29, 2015Dear ***:
Per your request, and in connection with the above-referenced complaint regarding the Central Pennsylvania Youth Ballet ("CPYB”), I write to respond to the additional concerns raised by the customer as noted in your letter dated May 21, 2015.
In "rejecting” CPYB’s initial response his complaint, the customer claims that the Refund Policy at issue is "buried under a multiple of hyperlinks in a student handbook," This is simply not trueThe very document the customer attaches to his additional concerns clearly provides: "I have read and understand the Refund Policy as outlined in the Student Handbook, I understand that there will be no exceptions to these refund policies." Far from being "buried,” the Refund Policy: (1) is listed on the Table of Contents of the Handbook; and (2) takes up the entire fifth page of the Handbook; accompanied by large, conspicuous print on the right-hand margin, which states "PAYMENT & REFUND POLICIES.”To be sure, and as noted in my previous response, the customer has been refunded all amounts in accordance with the terms of the Refund PolicyOn April 29, 2015, an amount totaling $3,was refunded to the customer's credit cardOn May 11, 2015, a credit of $1,400,was placed on the customer’s account for use toward the Summer ProgramThe customer now claims that “[there is no chance of [the] student attending the program next summer," but this does not alter or change the fact that the credited funds are non-refundableAgain, this practice goes above and beyond industry standards.I find the customers actions and accusations against CPYB, and against myself personally, to be entirely beyond the pale, wholly repugnant, and borderline slanderousNo one has died, and CPYB does not "profit" off the backs of injured childrenEver since the customer has been denied his request for an exception to the Refund Policy, he has engaged in an online campaign to spread lies and misinformation about CPYBHe has also sent multiple emails to me, which are littered with offensive language and veiled threats Examples of this conduct are attached for your records, prevent the customer from engaging in these actionsHowever, should the need arise, CPYB is fully prepared to take all necessary legal action to protect its interests.Thank you for your attention to this matterShould you have any questions or concerns, please do not hesitate to contact me.Sincerely,Nicholas AChief Executive Officer

I am rejecting this response because:
Mr A** is correct in that I have sent him emails that are not pleasant to readI always begin trying to settle issues with a very nice demeanor and try to find compromiseHe has left me no option then to be tough and mean He is wrong in his claim that the tuition refund policy is not buriedWhy is the deposit refund policy right where you agree to the payment but the tuition refund policy is under multiple links in a student handbook? Why make this deceptive and not clear by simply stating in one place, where the deposit refund policy is, there are no refunds on deposits or tuition, unless of coarse you really do not want parents to see thisWhy not a parent handbookI am not the studentIt is simply deceptive and misleading and not doing business in good faith.
I have not slandered him or the programSimply telling the truthHe says that there are "no exceptions to the policy" therefore it is fair to assume that should a student die there would be "no exception".
I told them from the very start that our daughter could not attend next summerI even offered to let them keep the funds till next summer and allow me to offer my tuition to another student from my daughters boarding school for next summers programI was told that I was not allowed to transfer the tuition to another studentI feel that this would have been a fair compromiseHis refusal to accept this compromise clearly shows his callousness towards an injured student and that his only concern is for doubling his money on one spot.
Clearly the only fair end to this issue is a refund of the $period.

I am rejecting this response because:
There policy is NOT clearly stated when you register for the program. It is buried under a multiple of hyper links in a student handbook. When you register the only policy that is visible is that there are no refunds on security deposits and annual registration fee, see attached. To bury the policy on tuition refunds under multiple hyper links is an extremely deceiving business practice. There is no reason that it should not be stated on the same page as the one I attached, unless they do not want you to know when you sign your child up for the program.

Now the website says that the program is completely filled. There is no chance of [redacted] attending the program next summer as she will be studying abroad and not be here to attend. Also from reading Mr A**'s response you could assume that this heartless CEO would treat the death of a student the same as any other reason to withdraw.... just another chance to double his revenue!
I am insisting on a refund of our $1400.00 tuition.
