Complaint: [redacted] I am rejecting this response because:My complaint regarding the 2011Softail Deluxe is not about the price I paid for the bikeCentral TexasHarley-Davidson continues to return back to the NADA book as a reference The information regarding roughly the amountof bikes that have sold since they initially sold the Softail Deluxe to [redacted] and the roughly amount of repair orders that Central TexasHarley-Davidson has completed really has no relevance to my complaintAs faras when [redacted] began employment with Central Harley-Davidson, that is notany of my businessWhat the fact is, [redacted] does work there now and hedid at the time of the traof the Softail Deluxe and when I purchaseditHe did in fact, as did Central Texas Harley-Davidson, deny knowledge ofknowing any type of history of the Softail Deluxe’s gas tank whenquestioned I understand that everyone hasthe right to customize their bike as to the way they want it to be customized, however,the bike was sold as a Softail Deluxe (regardless of the paint and othercustomizations) but the gas tank was not a It was an older tank from aprevious Softail Deluxe that [redacted] ownedThe age of the motorcycle VINwas disclosed but the age of the gas tank was notAgain, if I was to have anissue with the gas tank, i.e– fuel pump failsI go to a Harley-Dealer thatis located near where I broke down, the repairing Harley-Davidson dealer, asmyself, would have assumed that the tank and the internal parts where a 2011because the VIN is a In fact the VIN says that the paint was a two toneRoot Beer according to Harley-Davidson corporate But we all know that we can all paint ourbikes the color we want to when we own themI was going to do thisI wasgoing to paint the bike a customized color that I liked but when it was discoveredthat the tank was pre-that changed the whole idea of getting it paintedOn December 19th I didreceive a call from [redacted] who identified himself as the [redacted] for Central Texas Harley-DavidsonHe called in lieu of theowner/manager [redacted] [redacted] started by asking me questions which Itold him was already addressed in the letter [redacted] denied any knowledgeof the previous history of the bike as did [redacted] the previous owner.Please understand that I was told by my sales representative, [redacted] ,that at any time if I had any questions regarding the Softail Deluxe thatI purchased that I could just call the previous owner [redacted] and that heis the [redacted] Thatis what I did as I noted in my initial letter regarding this complaintAs Isaid [redacted] was not very forthcoming with information when it came to theage of the tankHe just finally told me that “it’s not my bike”My conversation with [redacted] continued to become uncomfortable as he was very intimidating, I asked him ifhe just called to upset me and he told me that I had asked him to call me I don’t think I ever asked him to call meOnNovember 6, I called and asked [redacted] to have [redacted] call meback and I asked for a response to in my letter I wrote on December 17, Icertainly didn’t need to be intimidated [redacted] then proceeded to ask mewhat I wanted and as I had already so noted in my Revdex.com complaint I would like tobe reimbursed the parts that I had to pay and Central Texas Labor rate cost toinstall the parts for a Softail Deluxe gas tankHe then proceeded to tellme “That’s not going to happen.” From the correspondence that Ihave received so far from the folks at Central Texas Harley-Davidson they arein denial about the age of the gas tank on the Softail Deluxe I purchasedeven the previous ownerIn order to help everyone’smemory regarding the age of the gas tank on the Softail Deluxe that wassold to me please see the attached photos from the Central Texas Harley Owners Group chapterfundraising cookbook for MDAThis cookbook was published in and the olderSoftail Deluxe is in the photo on the far left hand side Please also note the name [redacted] on thecover to identify whose bikes that was in front of the Bob Bullock Museum The cookbook is still being sold at theCentral Texas Harley-Davidson dealership today to help raise money forMDA Also see attached of the photostaken at Central Texas Harley-Davidson of the Softail Deluxe that IpurchasedSame paint, same tank as the photo taken and put on the cover of thecookbook.There is something just notethical about putting older parts on a newer bike and selling it as a newerbike saying it’s upgraded and customized The gas tank is a vital part of the bike inorder to make it functionalHarley-Davidson manufacturer changed the fuel pump assembly parts afterthe age of the tank that is on the bike that was sold to me A fuel pump assembly would not fit inthe tank that came with the Softail Deluxe that was sold to me Again, I don’t see this as an upgrade.I could see this being done at aused car lot or a used motorcycle dealer but not a dealership that is supposedto be a reputable dealer for Harley-DavidsonAgain, I would appreciate beingreimbursed the cost of the fuel tank assembly parts and the labor to install whichwould be roughly $that will fit on a Softail Deluxe motorcycle.This is what I thought I paid for when I purchased the bike on October 31,2014.Please do not allow [redacted] or anyone else to contact me from Central Texas To Whom it May Concern: I have spoken with [redacted] ’s salesperson, [redacted] ,the former owner of the bikes spouse [redacted] , reviewed the paperwork andspoke with the [redacted] after he had called her tospeak about her purchase [redacted] purchased a highly customized motorcycle 2011Harley Davidson FLSTN Softail Deluxe for roughly 25% off of Sept-Dec NADA,average mileage on that year and displacement bike is 24,as per the mileagechart I have enclosed copies of the front of the book, page andmileage chartIn the four years since we sold that bike new we have soldroughly 4,motorcycles and completed roughly 27,repair orders, so no onewould know about a specific bike and the particulars without a fair amount ofresearch Which was not a contingency [redacted] had on the purchase [redacted] was not employed at the time of the transaction forthe FLSTN nor was it his bike He takes offense of any insinuationotherwise, and trades his vehicles and his wife trades hers in because they donot want to deal with the selling of their personal vehiclesWhy a bike is customized is a personal decision, and we paintand order factory custom paint work to install on new motorcycles every year,it is not uncommon nor a sign of any issues The other customizationincluding chrome, bags, pipes etcis also as the average buyer spend$personalizing their bike in the years following their purchaseIn this case over $6,was spent, if it is not your taste then you probablyshouldn’t purchase itThe bike was represented as customized and is fully coveredunder the terms outlined in her HD Extended Service Plan including the fuelpump All aspects of the transaction were and there doesn’t seemto be any issue with the mechanical workings or safety of the vehicleRegards, [redacted] P.S Please address all future contact from the Better BusinessBureau to [redacted] at this address 1/1/forward

[redacted] was responsible for verifying his income to the bank at the time he signed his documents here at the dealership. He supplied us with pay check stubs at which time we informed him that the finance company he was going thru would be calling within the next 7 days to do a 2nd verification of...

employment and that if he thought this would be an issue to let us know up front. He told us that this would be no issue and that everything with his employer would be fine. The finance company did call a week later to verify employment at which time his employer notified them that he was not employed there. (This particular finance company does these types of verifications on all of their applicants.) Once this happened the finance company informed us that the approval of [redacted]'s loan was no longer valid and that they would not be giving [redacted] a loan for the bike any longer. This is a 3rd party lender that we use for customers with credit challenges and what they say goes meaning we have no way of changing their minds once the decision has been made. We called [redacted] at this time to notify him that we would need our bike back due to the fact his financing was no longer valid due to the fact he was not employed as he had first told us and the lender. [redacted] refused to return our property and would not return messages that we had left for him over the course of two months. We gave [redacted] ample time to return our bike to no avail and thus forced us to go thru a recovery service in order for us to recover our property. We started trying to recover our bike back on November 17th 2015 and did not recover it until 01-16-2016. As you can see we have been more than patient with [redacted] and gave him every opportunity to come in and see if we could come up with an alternative solution.The trade in that he refers to was the only cash down so to speak of on this deal and upon the return of our property an inspection was done. There is a multitude of damage on our bike that is going to require more in repairs than his trade in is worth. At this time we have no choice but to hold [redacted]'s trade in cash value as payment for the damages and parts that have been removed from the bike. This is a very unfortunate turn of events and at no time do we ever want to go down this path. [redacted] signed multiple documents stating the financial information he supplied was true and accurate most importantly his employment information. Once the lender that we have no control over found this to not be accurate and misleading all loan options were removed from the table and left us with no option but to obtain our property back. It is very unfortunate that [redacted] chose to damage and remove parts from our bike during his time of possession due to the fact that if he had not done so and returned our bike promptly his trade/the cash value would have been returned to him at that time. Just the recovery cost of our unit was half of his trade in value and with the large amount of damage and missing items his trade in will not even cover half of the cost associated with getting the bike back to the condition it was in when [redacted] took delivery of it. [redacted] is more than welcome to come by the store and meet with me personally to discuss if he is so inclined. At this point I must move forward and begin repairs on my bike so that I can try and recoupe some of the loss due to the dealings with [redacted]. concerns of purchasing a 2011 Softail Deluxe that had parts installed from a Softwail Deluxe from prior years. Was there any type of letter attached or just a scanned copy of something that I don't quite understand what it's purpose was?  So yes I'm rejecting CTHD's response to my complaint as I don't see a response unless it is missing from what was sent to me.
