To whom it may concern, The firearm that is the subject of this dispute was brand new from the factory, had never been displayed or handled by retail clientele, and under full factory warranty Our ad for the sale of this firearm clearly states "NO RETURNS" in the body of the advertisement (see attached) The manufacturer's warranty provides for 100% of the shipping and repair costs for the list of the firearm The customer had the option of returning the firearm to the manufacturer for warranty service if he subjectively believed a defect was present Instead, the buyer accused us of knowingly shipping a revolver with a "locked up" cylinder We advised the buyer that we had fully inspected the firearm prior to shipment, and that it functioned flawlessly Due to the customer's accusation, we authorized the return of the firearm in order to verify the accusation through and inspection of the firearm for a "locked up" cylinder While the returned firearm was still in transit back to us for inspection, the customer requested that we exchange the returned firearm for a much more expensive once that was almost double the price, a firearm that is of a much higher quality, and of a more prominent brand The customer offered to pay the difference in cost, but still demanded that we pay the shipping and registration fees on the returned firearm We suspect that the customer's true motivation for returning the firearm was more likely "buyer's remorse" with respect to the firearm he originally selected, which is plainly suggested by his desire to exchange the firearm for one almost twice the price, and of a much higher quality than his original selection We were entitled to verify that the returned firearm actually had a "locked up" cylinder prior to our paying any additional costs associated with a return Return of the original purchase was granted based on our verification that the firearm actually had a "locked up" cylinder, and not based merely upon the buyer's subjective opinion that a defect existed, or his mere accusation that we had purposefully and knowingly shipped a defective product.Had we received the firearm with a "locked up" cylinder, or other obvious defects that should have been observed prior to shipment, it would have served as sufficiently convincing evidence to us that we had missed defects prior to shipment, which may have justified our agreeing to absorb the additional costs associated with a return However, no defects whatsoever were found upon a detailed inspection of the firearm The cylinder of the firearm was not "locked up" in any way, and there were no other "defects" of any kind observed Because we have possession of the returned firearm, and the customer has rejected our offer to exchange the firearm, provided he agree to some reasonable preconditions for completion of an exchange, preconditions that became necessary because no defects were found with respect to the returned firearm, specifically no "locked up " cylinder, and because there is no evidence that substantiates to us the accusations of the buyer with respect to our failing to inspect the function of the forearm prior to shipping, we have issued a refund to the customer's credit card in the amount of $525.00, which was the purchase price of the firearm, not including the original shipping cost and the credit card convenience fee We will not be absorbing any additional costs associated with the return of this firearm because no defects exist The buyer's accusations concerning our due diligence with respect to our inspecting the firearm prior to shipment for defects are completely and totally unfounded Thank you very much! I am rejecting this response because:
This is a complete inaccurate report. This seller sold me an item that was clearly defective. It was inspected by my FFL Dealer who also confirmed the item was not working correctly. The item was never inspected or he would of known this item was not working correctly. I have emails from this seller stating the "Bur" of the item appears to be defective. If this is the case why was the item shipped to me? I will not accept $525 as a credit fee. I will only accept the full $575.00 my credit card was charged. I am not responsible for any fees associated with this transaction. I was charged fees by my FFL for the transfer and paperwork of this item that I have not asked the seller to pay. The seller agrees to pay them upon returning the firearm. Clearly a lie which he has not honored. This seller has misrepresented all information in his previous email. The seller also threatened me that if I placed any negative comments regarding the sale of the item he would clearly not ship the item. I have contacted my attorney regarding this matter, my credit card company and I am willing to take all necessary steps to make sure I get refunded the full payment paid for this item.
