Review: On November *, 2013 I sat with my [redacted], [redacted] in her office to review and sign my apartment lease. All terms were agreed upon and both [redacted] and I signed. On November **,2013 my landlord sat with [redacted] to sign the lease as well which at this point [redacted] altered the rider stating that I would pay $20/month in addition to my $1,300 rent for basic cable services even though the rider stated that basic cable was included. I was never told about these changes. The lease should have been re-drafted in which I would of had to either sign or initial the changes made. What [redacted] did was completly illegal. I have both copies of the lease in my possession as well.Desired Settlement: I would like my $1,300 brokers fee refunded. I paid for a specific service which I feel was not completed. I did not pay for someone to break the law and put me through grief and financial hardship. The whole purpose of hiring and paying a realtor is so that these issues do not arise.

I got an email from her wanting information to see my listing at [redacted]. It is a legal apartment in town of [redacted], #[redacted].

I called [redacted], to inform him of the interest. We set an appointment to meet, he was willing to take her two dogs, and accommodate her concerns. When they started to discuss cable, Wifi and such, I lost the track of the conversation. His wife and son were present and I gave them my attention. I did hear mention about the $20 for the cable box and she seemed agreeable.

She came to my office to supply the credit information, references and sign the disclosure that I was working for the landlord and rental offer document. I called [redacted] to go over items on the standard lease form and what he wanted in rider. Because of their conflicting work schedules, I had to meet them both at 2 different occasions. [redacted] came in first, we reviewed the lease and rider, and she signed and gave me the $1300 for security and broker’s fee of $1300. The landlord came in to sign on the 11th. When he reviewed the lease, he instructed me to add to the rider that the tenant was to pay $20 for cable. He led me to believe it was discussed and agreed to by both. He then signed the lease. I mailed her the fully executed lease that day for her review.

I received an email from her on December *, 2013 stating she LOVED her new apartment and [redacted] and family were so nice. She thanked me for all of my help and said I was absolutely wonderful. I will recommend you to everyone I know, Enjoy the holidays. I have a copy of all emails.

The problem arose on Jan.*, when she called me, to ask me to call the landlord if the driveway would be cleared. [redacted] had called him, but wasn’t comfortable with his response. I did call him at work, and explained because of her family emergency, she had to get a definitive answer from him. He agreed and told me to tell her not to be concerned. When I called her back, she was beyond reasoning. It seemed she then first looked at the lease and noticed the $20 month addition for cable. I tried to calm her, and said I would speak to him about. I also said I would be responsible for it and speak to the landlord and my broker.

She proceeded to call my broker and demand her fee for services, My broker also tried to reason with her to no avail. She then started to threaten to complain to all who would listen.

The landlord called me and told me how she was going to file complaints with BB, Dept. of State, and Century 21 Corporate, which she has. The landlord was willing to remove her responsibility for the cable from the lease.

He arranged a meeting on the [redacted] of January to strike out that addition on all our leases. [redacted] informed [redacted], that I was taking responsibility at MY loss. We did meet to remove the addition of $20 cable as her obligation. I never benefited from this addition and now incurred the liability of the $20 month for the term of lease, which is costing me $240. [redacted] still is not satisfied and is looking for her broker fee returned.

My broker, does not intend to give her the fee back, since we did our job and was able to arrange all to her satisfaction. [redacted] is trying to damage my career of over 30 years. I have an excellent reputation with my clients and fellow peers. All real estate agents know my integrity thru the years, and most of my business has always been referrals.

No malice was intended in this matter, and I am sorry it came to this end.
